Title: Warrants Issued For Family Who Cheered At High School Graduation

arrested-for-cheering

A graduating teen’s father, Henry Walker, shouted: “You did it, baby.” That was enough to have a warrant issued for his arrest.

The Mississippi school had asked parents, friends and family to hold their applause until the end. But Walker was so overjoyed that he shouted this cheer out and waved a towel.

The crowd was far from angry at him, as his comment drew laughs from the crowd.

That was all there was to it. There was no interference with the graduation ceremony, just a proud father who couldn’t contain his pride in his daughter.

The Mississippi family was shortly thereafter kicked out of the graduation ceremony. But as surprising as that reaction was, they were even more floored when they were charged with disturbing the peace.

Superintendent Jay Foster defended the police state response, saying that he had warned audience members to hold their cheers until all names had been called.

Local WREG-TV reports that Ursula Miller admitted that she too had called out the first name of her niece, Lanarcia Walker during the graduate’s walk across the stage at Senatobia High School.

For that “crime” she is now being charged too.

About a week after the ceremony, the family was informed that there is a warrant out for each of their arrests.

Superintendent Jay Foster filed disturbing the peace charges against all of them.

“It’s crazy,” Walker exclaimed. “The fact that I might have to bond out of jail, pay court costs or a $500 fine for expressing my love – it’s ridiculous man. It’s ridiculous.”

“I can understand they can escort me out of the graduation, but to say they going to put me in jail for it,” Miller added. “What else are they allowed to do?”

Watch the local video from WREG-TV…

If you agree that this is ridiculous then help us SPREAD THE WORD and hold the police and this superintendent accountable for their bullying this family!

Sometimes the petty tyrants are the worst.

Superintendent Jay Foster filed disturbing the peace charges against all of them.

"Disturbing the peace"?

Uh - OK, sure thing fascist.

What an officiously petty little prick.

I'm not trying to be rude, but, do you have any idea how many times Deckard has posted an article and other posters have discovered very important details that were left out of the article to purposely make LE look bad?

Don't worry, not taken as being rude. I have no idea of the answer to your question. I do not keep a running total of bogus articles posted by posters here. If I did, it would prove I have too much time on my hands. As to the article posted, your reply seems to infer that your only concern is if something makes LE look bad. As a former LE official, I would assume your main concern would be with the facts.

Maybe you can investigate further on this matter, and further inform all of us. It would appear from the article, that the school official is the one being made to look bad. As to the LE involved, if as you assumed that the family had made threats, then the LE involved should have arrested them on making threats. Otherwise, seems to be a waste of LE assets.

BTW, How do we know that this is a " YELLA WRITTEN ARTICLE ", and that facts were omitted?

A journalist must always report only the facts and never have a personal attitude toward the facts to either spin them or omit some.

Most importantly, a journalist must present both sides.

Look at how many time the Millers were directly quoted in the article and point to me one place where Senatobia Municipal School District Superintendent Jay Foster was directly quoted.

Did we get his side of the story?

I fear not.

Telling both sides of the story is good journalistic practice.

Failing to do that and pushing one side of the story is yellow journalism.

Does this answer your question?

No applause, cheering or towel waving allowed.

Nothing said that applause, cheering or towel waving was not allowed. It was said there would be a time for it.

The line between forcefully and excessively expressing one's uncontrollable enthusiasm at a public meeting and disrupting the enjoyment and peace of others is a fine one. Public officials at every level have experience those rowdy ones who desire to make a spectacle of themselves from time to time.

While one person may need to vocalize slightly to express happiness, yet another may stand up continuously waving a towel and excessively screaming. The former is likely protected by the First Amendment, but the latter is not under a recent published decision of the United States Court of Appeals for the Ninth Circuit.

The school was apparently having a problem that continued to grow over the years, in that the family and friends would go into lengthy and wild celebration akin to those at a political convention when someone was nominated to run for President. The celebrating after each name was called were getting out of hand and causing long delays in the ceremony. The superintendent asked everyone to delay their celebration until after all the names were called. That request was even clearly printed in the program.

This is a free country, after all...

However a great paradox of freedom is that it really cannot be had unless we limit it in some cases. Freedom always has boundaries, dictated by the norms in society….and freedom is defined by society and culture. Socially, one’s freedom is limited by others' freedom. The other attendees had the freedom to enjoy the ceremony uninterrupted and not delayed. Yes, this is after all a free country, but expressing that freedom gives no one the right to interfere with the freedom of others.

"When we got organized as a country and we wrote a fairly radical Constitution with a radical Bill of Rights, giving a radical amount of individual freedom to Americans, it was assumed that the Americans who had that freedom would use it responsibly.... [However, now] there's a lot of irresponsibility. And so a lot of people say there's too much freedom. When personal freedom's being abused, you have to move to limit it."

I had a buddy that had a Triumph Bonneville 650. He bought it cheap from a guy that was getting a divorce. It was really nice. Problem was prior to that, he had only ridden on a Suzuki 125 trail bike. He went down on the Triumph, minor scratches. But it scared him bad. It stayed in his garage until a few years ago. He got a wild hair, and sold it cheap.

I have been looking. All I could find at first was giving the Miller’s side of the story, while Superintendent Foster declined an on-camera interview but told WREG he’s determined to have order at graduation ceremonies. So I figured they don’t “support this story” when they only repeats the Miller’s side of the story?

I finally found a local story that mentioned “over the past over the past few years, the yelling and screaming at graduation has become too disruptive and made the ceremony unbearable. They yelled out and excessively celebrated during the calling of names.” It also said that “the superintendent of a Mississippi school system is not backing down after issuing four disturbing the peace arrest warrants for people who cheered at a high school graduation?” Furthermore, “attendees at the ceremony were given plenty of warning about the no cheering policy. The second page of the program states what type of behavior is acceptable and not acceptable and the warning was undeniable.” It appears everyone except the Millers and two others went along with the rule which was established with good reason.

When individuals make a conscious decision to ignore the rules and disrupt a public ceremony by excessively yelling out and they wildly celebrate, what consequence for those individuals is too harsh? We shall find out on June 9 when the whole story from both sides comes out in court.

So, in Mississippi, a school superintendent has the authority to issue arrest warrants? Very odd!

Around here, that power is only vested in a Judge. Odd state Mississippi is.
