If it wasnt caught on video, few would have believed it. I think we all know what would have happened if he wasnt there, Octavius Johnson said about the video.
It was his childhood friend who had secretly recorded four police officers abusing him in the video.
It would have been swept under the rug, Johnson said without hesitation.
Is he right? He certainly seems to be.
But now, because of the quick-thinking of his buddy, all of the four officers involved have been fired.
Omaha Police Chief Todd Schmaderer was very animated when he talked reporters at a press conference about the embarrassing incident.
Many of the police actions that took place that day are in violation of our policies and do not represent how I want our officers to conduct themselves, he said.
The final resolution will be fair to the citizens of Omaha, the Omaha Police Department and the specific employees involved so that we can move forward and restore any public trust that may have eroded with this incident.
The Johnson family is not satisfied with the firing. It doesnt go far enough, they said.
Now, with the help of the American Civil Liberties Union (ACLU) have filed suit seeking damages for the anxiety and depression that have surfaced in the months since. A full eight officers have been named in the suit with another 24 who remain unnamed.
This incident will live with our family for the rest of our lives, Sharee Johnson the mother of the two young men said, None of us can call 911 when we need help and believe that police would be there to help us. We live in a city where we feel we have no protection.
The suit alleges that dozens of Omaha police officers turned a parking violation into a brutal arrest, unconstitutional raid on the familys house, and confiscation of video that was taken of these illegal police actions. All of this stemmed from Octavius Johnson parking his truck on the wrong part of the street. A secondary video taken by Johnsons childhood friend shows the incident from a second story vantage point. Police can clearly be seen grabbing an non-resisting Johnson by the neck, and throwing him to the ground, then punching him numerous times, as other officers rush in.
He went around my neck, threw me to the ground, choked me out to the point where I couldnt breathe or speak, Johnson said of the illegal assault by police officers. The officer told me to stop resisting, punched me in the face. As if this were not enough, they implied that they would murder him right there in the street, saying do you want to die today?
Octavius brother Juaquez, was chased and then arrested for filming the arrest on a camera phone, even though he was on private property, and did not interfere with the illegal arrest.
It is a breath of fresh air to see the Omaha Police Department act quickly to fire these officers, but the Johnson family is right, were it not for that second video of the assault, no action would have been taken on their complaints alone. They would have been ignored, shrugged off and ultimately they would have been prosecuted for the crimes alleged in the illegal arrest, crimes which they never committed.
Then watch the actions of Octavius brother Juaquez. It is easy to see that the cops knew he was video recording the entire event. The officer gave Juaquez ample warnings to stay on the curb, it looks like he did at least twice. It was only after the warnings and when Juaquez stepped down off the curb did he start to run because he knew he was going to be arrested .and the officer gave chase. The officer did not chase him to confiscate the camera, he already knew it was there and could have taken it at any time earlier. He chased Juaquez because when he stepped down from the curb and did not follow instructions, he was going to arrest him for interfering.
That is totally ridiculous. That he chased him down and arrested him for stepping off the curb, and he didn't care that he was being recorded? Stepping off the curb with a cam is a crime?
Please, he clearly went after him for recording it more closer so we wouldn't be sure what happened and so we would give them the benefit of the doubt of what happened, just Like you just did.

There is probably a good reason for the large number of officers responding, that is one tough neighborhood.
There are never "too many" officers for a call like this. 5 more would have been better. Officers can never be too safe.

I am normally willing to give the police the benefit of the doubt in these cases but when they go after those for simply camming them in these public situations, its time to get suspicious.

I really have absolutely no factual knowledge whatsoever upon which I can determine why the cops chased him. It would therefore be pure conjecture for me to assume they were chasing him for simply camming them in these public situations. I make ever attempt to avoid getting suspicious over conjectures.

He could have been 15 yards away on private property and still have been arrested for refusing to stand back.

It is hard for internet-qualified lawyers to understand that ANY act which prevents or impedes an officer from performing official duties is interfering with a police officer. A person can be on public property, private property, underground or suspended in the air and interfere with a police officer.
A person can legally be charged with interfering with a police officer if, among other things, they are purposely slowing the officers response to a crime scene investigation or making an arrest by shouting or trying to draw a crowd to the scene when an officer is questioning or arresting someone. The latter of these chargeable offenses is a cause of great concern, since an officer (or a group of officers) can become outnumbered and at extreme personal risk.
The police officer determined that he was interfering with the arrest, the officer has the legal right to make that determination. The fact that the perp was also shooting a video is incidental. He would have been arrested if he had an ice cream cone in his hand instead of a recording device.

My wife and I have just returned from shopping. While we were driving back home, a motorcycle cop pulled up in the left lane and stopped at the light next to me. It did not surprise me that I felt no uncontrolled fear with him being so close by.
I looked over at him, and I am sure that his highly trained senses let him see me doing that in his peripheral vision .so he looked back over at me. When he did, I gave him a big thumbs up. A pleasant smile broke out on his face and he returned with a matching gesture. When my wife saw this going on, she leaned forward and also gave him a big thumbs up. Octavius Johnson filed suit 6 Jan 2014. Several defendants have been dropped from the suit as indicated in the Docket Report, among them the Omaha Police Department. In Doc #81, it states "Jury Trial set for 11/30/2015...." Docs #88, #91 and #94 are Motions for Partial Summary Judgment Based Upon Qualified Immunity. Doc #103, provided below, is the most recent document on the Docket Report, filed 29 May 2015 and is the Plaintiff's Brief in opposition to the Defense motions #88, #91 and #94.

I'm probably the only poster here that's been recorded... and it's been many times. I've never arrested anyone for it, I fully agree the public has the right to film anyone in public. I've never stated otherwise. Deckard couldn't find a single post of mine where i don't support recording the police.

I see that people should be buying into facts and not suppositions, it was excessive force that resulted in their firing.
Nowhere in the official announcement of the firing, or the lawsuit filed by the family, is a video mentioned.
The only proof of excessive force was the second video, the first video taken from closer was obviously destroyed by the police who arrested the person who took it.
Without the video they would have gotten always with it, as I am sure they did many times before this.
The fact remains, the 6 officers were dismissed for using "excessive force" and the "video" is not mentioned nowhere, including in the lawsuit.
So, I still say they were NOT fired because of the"video" as you say they were.
