Sacramento cops are rolling out a new program this Memorial day to allegedly combat drunk drivers. While the reasoning for this new program may sound just, its implementation is anything but.
If you are out in a bar this weekend, be prepared to have multiple officers come in and ask the patrons in the bar to blow into a breathalyzer.
DUI roadblocks are apparently not invasive enough, so the Sacremento PD instituted a program to attack the source, the places where alcohol is consumed.
Obviously the site of several armed officers walking into a bar with breathalyzers in hand is a buzz kill, to say the least.
One of the bar patrons whos been exposed to the program explains, Admittedly we were a bit put off when we were gonna walk in and saw a bunch of cops with breathalyzers.
A bit put off is an understatement, however.
While these officers are promising not to test and arrest, the very idea of police entering private property and having people submit to breathalyzer tests is appalling. The inside of your body is no business of the state and when this clear violation of your personal space is accepted, freedom loses.
This program also leaves the door wide open for entrapment and further rights violating searches by creating unnecessary confrontations.
Hopefully, this program does not take wings and spread to other municipalities as it is a leap forward for the nanny surveillance state, and giant step back for liberty.

If we want society to be safe, we need to extend this tactic to the war on drugs.
Perhaps going to coffee houses and other places where "potheads" congregate - maybe rock concerts and so forth.
It would be easy enough for our heroes in blue to go to these places and "request" a cheek swab or maybe even a blood sample.

I don't see the problem here. They aren't forcing anyone to take one. Some people probably don't know how few drinks it takes to put them over the limit.
Maybe bars should put breathalyzers in voluntarily. So their patrons would know.
I just got to thinking about this. If those cops walk into a private business and suggest patrons volunteer to take a breathlizer, 1) they revoke their right to receive any commission from any arrest they make while in that bar because they do not have jurisdiction to walk into a private business in the first place unless they are called upon by the business itself. Such a notion of suggesting patrons volunteer to taking a breathlizer violates the Fourth Amendment unlawful search and seizure.
They were there to educate and hand out literature.
Even if that were the case, this is just one more example of the government conditioning people to accept the encroaching police state.
Why not just "request" that the patrons contribute a cheek swab to test for weed?
It's the next logical step, right?
It was all voluntary.

If I, as a patron, had been in a private bar handing out literature and such to people, I would have been cited for solicitation. What makes those cops think they are above those solicitation laws? Even if they were just handing out literature to educate the people, they could have just done that on the public sidewalk outside the bar where the sidewalk area belongs to the public.
Now, I know they have tanks and body armor, I know they have fifty cals and .338's, I know they feel above the law and as if no harm can come to them, but, they are verging on pathetically stupid.

The "Breathalyzer" is an old, outdated "scientific instrument" that's too big to walk around with and needs to be plugged in, it uses ampules and also requires a known solution container that needs to be plugged in 24/7 and kept at the same average temperature as a persons deep lung air.
Maybe they have "Alco Sensors". Small roadside boxes that confirm the presence of alcohol in ones breath and runs on a single battery?
