The FBI cleared an Oklahoma sheriff’s deputy of violating a suspect’s civil rights in the case of a Tulsa County reserve deputy fatally shooting an unarmed man after the volunteer grabbed his revolver instead of his stun gun, the sheriff said Monday.

But it remains unclear if 73-year-old Robert Bates was qualified to use the gun he fired April 2, killing 44-year-old Eric Harris, said Sheriff Stanley Glanz.

Bates, a wealthy insurance executive who has known Glanz for 25 years on both a professional and personal level, faces a second-degree manslaughter charge for accidentally killing Harris during a gun-and-drug buy sting. A report by the Tulsa World found that supervisors falsified training records for Bates, a deep-pocketed donor who has supplied the department with cars and electronic equipment during his seven years as a volunteer reserve deputy.

In his state, the most he can get is a couple of years in jail or prison.

I'll be surprised if he gets any prison time. The local cops, embarrassed at letting him carry weapons he didn't have training for, will be shielded by the local prosecutors. There is the matter of the police supervisors who faced repercussions when they refused to certify this rich nutjob for training he did not complete so there could be some lawsuits from that as well, given the attention this case has received.

Obviously, the supervisors who refused to give him certification have been vindicated by subsequent events. Hopefully, their careers didn't suffer from having integrity and being responsible, regardless of political pressure.

Apparently, he got this special treatment as a reserve for buying the local PD a bunch of equipment. At least two police cars, some radio equipment, etc.

You think those will look like such a bargain by the time they pay off the lawsuit? I have to wonder how much the PD's liability insurance costs will rise as a result. That's something the public rarely sees any reporting on. But someone is paying off those lawsuits, almost always by liability insurance. And insurance costs go up when they have to make a payoff.

However in cases where the individual police officers are not as well off, the department, the city and ultimately the taxpayers end up footing the tab.

It makes sense to me that what should happen is that each individual officer have his own malpractice insurance.

I would have gone with first-degree manslaughter but there may be reasons why the prosecutor didn't, either to CYA for the local cops or the state's criminal statutes wouldn't support it.
