Taos County, NM — In 2013, a mother and her children feared for their lives when a  stop for a speeding ticket turned into much more.

Oriana Farrell, 39, of Memphis, was bringing her children across the country on a family road trip, when things took a turn for the worse.

After Farrell had been given a citation, she decided to drive away from police. Several short chases then followed, before one of the cops, Elias Montoya, unloaded his pistol into the minivan as it drove off.

Common sense prevailed, for a short time, and Montoya was fired from his job as a New Mexico State Trooper. However, he was just rehired with the Taos County Sheriff’s Department as a deputy.

According to Taos Co, Sheriff Jerry Hogrefe, Montoya was chosen from 17 different applicants to fill just one of two available positions.

Did the other sixteen applicants actually kill children? Is that why a person who shot at children was hired?

Insidiously enough, after the incident got swept under the rug, the State Troopers actually tried to hire Montoya back, but he refused.

Apparently Sheriff Hogrefe thinks that shooting at a van full of children is just fine and dandy and has stated that Montoya has a clean record.

“Nothing from DPS [or] the training academy pertaining to his certification or qualifications…so he has a clean work history,” Hogrefe said.

According KOB, the sheriff defended Montoya’s actions in the dash cam video, saying Montoya didn’t know there were kids in the van and that he believed the driver had a gun.

“I cannot fault anyone for making a split-second decision,” Hogrefe said.

According to Montoya’s new boss, shooting innocent until proven guilty people in the back as they flee is justifiable, as it was a “split-second decision.” Seems like Montoya will fit right in.

Why disrupt traffic for a speeding ticket? Bill the license plate holder.

Police should only pull people over if they are driving unsafely - and by unsafe I mean they need to stop them from driving and arrest them. Driving offenses that require just a ticket should not result in being pulled over any more.

I know Americans are stupid - but one more time - the police should only get involved if it is for an arrestable offense - as I wrote above. If all that was to hand out a ticket and not take the driver/car off the road then it is a waste of time.

The driver could have been loaded and an officer has no idea unless they stop the speeding vehicle and evaluate the driver. Also operating a MV w/o insurance is an unclassified misdemeanor in many states. Again, only by stopping the vehicle can this be determined.

So in the case of a freshly stolen car, one where no report has yet been made to the police, an officer should scan the license plate of the speeding vehicle and issue a ticket, electronically, to the crime victim ignoring completely the occupant of the car? Also, you haven't addressed the matter of DUI & traffic stops for violations of the MV law. Speeding is a common offense for intoxicated drivers and an officer doesn't know who is intoxicated w/o stopping said vehicle.

Ok, one more time - a DUI is an arrestable offense - and a drunk is not controlling his car - not just speeding. Speeding is just speeding. In Germany there are no speed limits so this supposed safety factor is BS - slowing down endangers lives on highways as does pulling cars over for speeding or not having a working tail light of other non arrestable offenses.

Speeding is just speeding.

A speeder is stopped because it is often the indicator of something more serious, be that a crime, medical condition, etc.

Using your logic a car speeding away from a crime scene, a crime unknown to the police at the time, wouldn't be stopped but rather issued some type of electronic citation. This is absurd on it's face for reasons already explained, but ignored. Same goes for an acute medical condition. The number of babies born in the back seat of a police car are too numerous to list, as are people who are rendered CPR.

You're amusing in a sad kinda way.
