Taos County, NM — In 2013, a mother and her children feared for their lives when a stop for a speeding ticket turned into much more. Oriana Farrell, 39, of Memphis, was bringing her children across the country on a family road trip, when things took a turn for the worse. After Farrell had been given a citation, she decided to drive away from police. Several short chases then followed, before one of the cops, Elias Montoya, unloaded his pistol into the minivan as it drove off. Common sense prevailed, for a short time, and Montoya was fired from his job as a New Mexico State Trooper. However, he was just rehired with the Taos County Sheriff’s Department as a deputy. According to Taos Co, Sheriff Jerry Hogrefe, Montoya was chosen from 17 different applicants to fill just one of two available positions. Did the other sixteen applicants actually kill children? Is that why a person who shot at children was hired? Insidiously enough, after the incident got swept under the rug, the State Troopers actually tried to hire Montoya back, but he refused. Apparently Sheriff Hogrefe thinks that shooting at a van full of children is just fine and dandy and has stated that Montoya has a clean record. “Nothing from DPS [or] the training academy pertaining to his certification or qualifications…so he has a clean work history,” Hogrefe said. According KOB, the sheriff defended Montoya’s actions in the dash cam video, saying Montoya didn’t know there were kids in the van and that he believed the driver had a gun. “I cannot fault anyone for making a split-second decision,” Hogrefe said. According to Montoya’s new boss, shooting innocent until proven guilty people in the back as they flee is justifiable, as it was a “split-second decision.” Seems like Montoya will fit right in. It's a stupid, f**king speeding ticket! You were speeding. Take the ticket and be on your way, for crying out loud. But no. You gotta resist, flee the scene, assault the cop, flee again. With a car full of children. Hey, if momma don't care about the keeds, why should the cops?
She took the ticket and left. No surprise seeing you cheer a cop shooting at a minivan full of kids, losing his job, then being hired by a different police department.
Two points. First, shooting at the car was not justified... it should result in the officers termination and be charged if that state has a written law like reckless endangerment. Second, you are a deceptive liar. Nobody with a single digit IQ would suggest what you did above, unless you are intentionally lying. You will remove any credibility you have to remove all culpability by a criminal. The officer was never justified to shoot, but if this inner city dysfunctional zoo animal just took her ticket and COOPERATED, non of that incident would have happened.
It was justified. The occupants of the car assaulted the police officer and fled. The shooter didn't know kids were in the car and couldn't assume there were kids in the car. Who a) assaults a police officer and b) speeds away with kids in the car? But there was a case of reckless endangerment. Against the driver.
During the assault... yes, shooting an unarmed thug because his physical assault could mean taking your gun, resulting in your death... can be justified. See Missouri Vs Brown... Haaaaaa. Shooting as they FLEE is reckless and not justified per Tennessee Vs Garner. Case law... it's a bitch.

After assaulting the officer (a violent felony), they fled in a vehicle, posing a significant threat of death or serious bodily harm to other officers or other civilians.
That's stretching it a bit. A reasonable officer should have assumed they were fleeing because they're ignorant inner city animals and they aren't functional enough to live in a society based on law and order. Not that they were gonna run people over in a rage. Her actions screamed from start to finish... I'm gonna leave so you can't ticket me. In her warped mind, that should work. lol I'll tell ya what, I wouldn't risk a grand jury based on his decision to shoot. Screw tgat. I'll pursue the vehicle and stop it with stop sticks to deflate the tires and defuse her dysfunctional actions. I'll tell you the same thing I tell tpaine. That officer polices in the freest country in this universe. He's free to be as reckless as he's willing to gamble at grand jury time. Use excessive force at your own risk.
