Taos County, NM — In 2013, a mother and her children feared for their lives when a stop for a speeding ticket turned into much more. Oriana Farrell, 39, of Memphis, was bringing her children across the country on a family road trip, when things took a turn for the worse. After Farrell had been given a citation, she decided to drive away from police. Several short chases then followed, before one of the cops, Elias Montoya, unloaded his pistol into the minivan as it drove off. Common sense prevailed, for a short time, and Montoya was fired from his job as a New Mexico State Trooper. However, he was just rehired with the Taos County Sheriff’s Department as a deputy. According to Taos Co, Sheriff Jerry Hogrefe, Montoya was chosen from 17 different applicants to fill just one of two available positions. Did the other sixteen applicants actually kill children? Is that why a person who shot at children was hired? Insidiously enough, after the incident got swept under the rug, the State Troopers actually tried to hire Montoya back, but he refused. Apparently Sheriff Hogrefe thinks that shooting at a van full of children is just fine and dandy and has stated that Montoya has a clean record. “Nothing from DPS [or] the training academy pertaining to his certification or qualifications…so he has a clean work history,” Hogrefe said. According KOB, the sheriff defended Montoya’s actions in the dash cam video, saying Montoya didn’t know there were kids in the van and that he believed the driver had a gun. “I cannot fault anyone for making a split-second decision,” Hogrefe said. According to Montoya’s new boss, shooting innocent until proven guilty people in the back as they flee is justifiable, as it was a “split-second decision.” Seems like Montoya will fit right in. Buttressing my claims that the worst cops move from jurisdiction to jurisdiction. Usually, they do switch states though. It's a lot like how the Roman Catholics move child-predator priests from parish to parish. Meh. I see no proof offered and don't see how this would become public info. I see fat-ass Montoya fire three shots at the tires of the minivan. Since he didn't crouch, he greatly reduced his chances of hitting a tire. He did not shoot into the van. He shot (incompetently) at the left rear tire.
It's a stupid, f**king speeding ticket! You were speeding. Take the ticket and be on your way, for crying out loud. But no. You gotta resist, flee the scene, assault the cop, flee again. With a car full of children. Hey, if momma don't care about the keeds, why should the cops?
She took the ticket and left. No surprise seeing you cheer a cop shooting at a minivan full of kids, losing his job, then being hired by a different police department.

Why disrupt traffic for a speeding ticket? Bill the license plate holder. Police should only pull people over if they are driving unsafely - and by unsafe I mean they need to stop them from driving and arrest them. Driving offenses that require just a ticket should not result in being pulled over any more.

Two points. First, shooting at the car was not justified... it should result in the officers termination and be charged if that state has a written law like reckless endangerment. Second, you are a deceptive liar. Nobody with a single digit IQ would suggest what you did above, unless you are intentionally lying. You will remove any credibility you have to remove all culpability by a criminal. The officer was never justified to shoot, but if this inner city dysfunctional zoo animal just took her ticket and COOPERATED, non of that incident would have happened.

And when the ticket recipient gets his ticket in the mail, and he pleads not guilty BECAUSE HE WASNT DRIVING AS A DEFENSE... how does the DA prove, at a trial, beyond all certainty, that the registered owner, was in fact, driving at the time of the offense, Einstein? It was justified. The occupants of the car assaulted the police officer and fled. The shooter didn't know kids were in the car and couldn't assume there were kids in the car. At this point in time, speeding tickets are like pay booths - not worth the trouble. Keep cops around for crimes that are serious enough to jail someone not revenue enhancements.

In the video, the cop says at the start that she was going 71mph in a 55mph zone. That's pretty reckless, especially with kids on board. 7-10mph over the limit is speeding. 15+mph over the limit is more than just speeding. I'm surprised no one is commenting on Montoya trying to shoot out her rear tire as she fled.

Not to mention it was pathetic his potbelly was stuffed so full of donuts that he couldn't crouch properly to actually shoot out the tire. Three shots from that close and he couldn't hit the tire? It is a primitive system - you can link insurance to the driver's license like they do in Europe taking the guess work out.
So in the case of a freshly stolen car, one where no report has yet been made to the police, an officer should scan the license plate of the speeding vehicle and issue a ticket, electronically, to the crime victim ignoring completely the occupant of the car? Also, you haven't addressed the matter of DUI & traffic stops for violations of the MV law. Speeding is a common offense for intoxicated drivers and an officer doesn't know who is intoxicated w/o stopping said vehicle.

Ok, one more time - a DUI is an arrestable offense - and a drunk is not controlling his car - not just speeding. Speeding is just speeding. In Germany there are no speed limits so this supposed safety factor is BS - slowing down endangers lives on highways as does pulling cars over for speeding or not having a working tail light of other non arrestable offenses.
This wasn't germany... and USA will never be Germany. I've stopped over 25,000 cars... never caused and accident doing so. How many cars have you pulled over to back your claims that V&T stops are traffic hazards?

A speeder is stopped because it is often the indicator of something more serious, be that a crime, medical condition, etc. Using your logic a car speeding away from a crime scene, a crime unknown to the police at the time, wouldn't be stopped but rather issued some type of electronic citation. This is absurd on it's face for reasons already explained, but ignored. Same goes for an acute medical condition. The number of babies born in the back seat of a police car are too numerous to list, as are people who are rendered CPR. You're amusing in a sad kinda way.
