MADISON, AL – An Indian man in the process of moving to the United States was left paralyzed after police brutalized him early Friday morning. The man, Sureshbhai Patel, 57, was walking on the sidewalk near his son’s house in Madison, Alabama when a neighbor called the police. According to the police report,

“The caller, who lives in the neighborhood, did not recognize the subject and thought him to be suspicious.”

Police say the caller said Patel was looking into garages, but his family’s lawyer, Hank Sherrod, maintains he was not on anyone’s property or looking around.

Nevertheless, as soon as the cops arrived they approached Patel. He speaks only a few words of English and according to Sherrod, told police, “No English. Indian. Walking.” He told him his son’s house number and pointed to the home.

The police report refers to a “communication barrier” and claims things escalated when they attempted to pat Patel down.

“The subject began putting his hands in his pockets…Officers attempted to pat the subject down and he attempted to pull away. The subject was forced to the ground, which resulted in injury.”

If this is true, it is reasonable to assume that a man from outside (or inside, for that matter) the United States would back away from a uniformed stranger placing their hands on him. This is not a justification for excessive violence against a non-aggressive man.

Nevertheless, Sherrod disputes the police claim. According to AL.com, he met with Patel at the hospital and relayed that

“…there were two officers present and that Patel was patted down and did not pull away. Sherrod said one officer then pulled Patel’s arm up behind him and slung him face first into the ground. He said Patel could not say what happened after that.”

What happened was that Patel ended up face down on the sidewalk, bleeding and paralyzed from the neck down.

He was taken to Madison Hospital by paramedics, but after swelling in his spine was discovered he was transferred to Hunstville Hospital. There, he underwent surgery to fuse two vertebrae in his cervical spine (neck). He has regained a small amount of feeling in his right leg but remains paralyzed in his left. He can make a small grip with his hands.

Patel’s son, Chirag Patel, was told by doctors that his father may make a recovery but will require months of therapy.

Sureshbhai moved to the United States only two weeks ago to help his son and daughter-in-law care for their 17-month-old child. He is legally allowed to reside as a permanent resident (though it is unclear if he will want to after this incident).

The ease with which two officers tackled an older man to the ground with so much force as to cause paralysis is cause for concern. As Sherrod said,

“This is broad daylight, walking down the street. There is nothing suspicious about Mr. Patel other than he has brown skin.”

Aside from the evident racism involved in this case of police brutality, what is equally disconcerting is that Sureshbhai Patel comes from a country where police are notoriously corrupt and violent. Even coming from a background like this, he could not anticipate the quickness of officers to tackle him to the ground.

Sadly, this is not an isolated case. Police are repeatedly caught brutalizing those who are considered weak by society: pregnant women, teenagers, the mentally ill, and the elderly have all been injured and killed by police in recent months. Like Patel’s, their cases are routinely investigated by the police who perpetrate them.

Captain John Stringer of the Madison police confirmed there are both video and audio recordings of the incident but said they will not be released to the public at this time. They are being used for an “internal investigation” while the officer who threw Patel to the ground is on administrative leave. The family plans to sue, though they have not officially filed.

Chirag, who is proud of moving to the United States a decade ago to become an electrical engineer, said

“It is a dream for me because I came from a very poor family and I worked so hard here.”

After the beat down of his father, however, he expressed concern about his decision to move him to the U.S.:

“I’m very devastated that I might have made a big mistake.”

Imagine how different America and the world would be if  police officers uttered this sentiment about a fraction of the people they harass and kill.

Reading the other 2 articles, it appears all the facts objectively match.

And fusing vertebrae is no light matter. A person having that done will have back pain for the rest of his life, even assuming that he regains full reversal of paralysis which is very questionable.

But we can be happy with the neighbor that did his/her patriotic civic duty by calling the goons in because they saw a "suspicious" person in the neighborhood.

Madison police last week roughed up a 57-year-old Indian citizen who was walking on the sidewalk outside his son's home, leaving the older man temporarily paralyzed and hospitalized with fused vertebrae.

"He was just walking on the sidewalk as he does all the time," said his son, Chirag Patel, this morning. "They put him to the ground."

No crime had been committed. Madison Police on Monday issued a statement saying the department had suspended the officer and were investigating the use of force in this case. The police statement wished the man a "speedy recovery."

He said his father, Sureshbhai Patel, was to help his wife care for their new baby, a 17-month-old son, so he could pursue his masters degree in electrical engineering at the University of Alabama in Huntsville.

"The caller, who lives in the neighborhood did not recognize the subject and thought him to be suspicious," reads the statement released by police.

"This is broad daylight, walking down the street. There is nothing suspicious about Mr. Patel other than he has brown skin," said Sherrod.

Sherrod says the Sureshbhai Patel told the police officers "no English" and repeated his son's house number.

Sherrod said he spoke with Sureshbhai Patel at Huntsville Hospital this morning. He said there were two officers present and that Patel was patted down and did not pull away. Sherrod said one officer then pulled Patel's arm up behind him and slung him face first into the ground. He said Patel could not say what happened after that.

"This is just one of those things that doesn't need to happen," said Sherrod, saying the police escalated to violence without cause and left Patel lying bleeding from his face, paralyzed and in need of paramedics. "That officer doesn't need to be on the streets."

Sureshbhai Patel was taken by ambulance to Madison Hospital. Hospital staff called his son at work at 9:42 a.m. on Friday. Chriag Patel found his father at the hospital unable to move his legs and with limited motion in his arms.

From there, due to swelling in the spine, Sureshbhai was transferred to Huntsville Hospital for surgery to fuse two vertebrae. He remains hospitalized. Chirag said his father can now move his right leg a little bit, but the left remains paralyzed. He said his father can raise both arms, but cannot make a tight grip.

He said his father had no health problems prior to this incident.

I never said said that I supported this, or in any way intended to do so.

There was absolutely no justification for the beating based on the information presented here.

I was merely pointing out the sensationalism in the headline.

The cops were wrong to do this.

This is much better news than him being paralyzed from the neck down as the original article sensationalized.

But it is still bad news from an event that should not have happened.

I have read they expect further progress with therapy.

I was attacking another yellow journalism article that did not present correct information and in no way supported the gross inhumane action by the police.

They cops were wrong to take this action, based on the information presented.

I do not condone the actions by the cops.

I was attacking what I saw was another case of yellow journalism with a sensationalized headline
and the article stated he was paralyzed from the neck down without ever fact checking.

Police brutality is wrong ... and I hate yellow journalism.

Chief Larry Muncey told a small press conference in Madison that he also recommended that Parker be fired for his use of force against a man who committed no crime, did not speak English and could not understand the commands.

Muncey said "I found that Officer Eric Parker's actions did not meet the high standards and expectations of the Madison City Police Department."

Five members of the local Indian community sat in the front row, along with Indian Consul Anil Kumar, to watch the video from the patrol cars and listen to the non-emergency call that led to the violent confrontation.

Conclusion

Here is the funny thing about this piece: Every bit of knowledge in this piece was conferred to me before I got to law school. Much of it was told to me BY LAWYERS who repeatedly stressed how much they HATED their jobs.

You know what I did? I ignored it. I mean, sure all of those other assholes may be miserable and may hate the legal profession, but what do they know, they're only lawyers? If you're laughing at my ignorance, you're right to laugh. I was stupid.

Don't be me. Don't go to law school. Go do something with your life that you'll enjoy, is rewarding and productive and makes the world a better place.

MADISON, Ala. - An Alabama police officer has been charged with assault and will be fired after authorities say he badly injured an Indian man whom he stopped to question as the victim was walking through his son's neighborhood. The man has filed a lawsuit, and the FBI has opened an investigation.

The lawsuit filed by Sureshbhai Patel on Thursday claims that his injuries include partial paralysis. His son said Patel had to undergo surgery to fuse two vertebrae in his spine. Hours after the suit was filed, Madison Police Chief Larry Muncey announced that Officer Eric Parker would be fired.

Last Friday, Parker responded to the northern Alabama neighborhood in response to a call about a suspicious person walking onto driveways and looking into garages, department officials said in a statement.

Parker and other officers stopped Patel, 57, and tried talking to him but he spoke little English, authorities said.

Officers tried patting Patel down but he put his hands in his pockets and pulled away, police said. A video released by police shows an officer throwing Patel to the ground. Later, after Patel was in cuffs, the video shows officers trying to lift him to his feet but Patel's knees buckle and the officers help him back off the ground. Officers then try to clean him up, picking things off of his clothing. Patel was taken to a local hospital, police said.

When Patel was stopped, he told police "no English," and repeated his son's house number, family attorney Hank Sherrod told Al.com. Sherrod claims Patel was accosted because of his brown skin.

Chirag Patel has told local news media that his father has only been to America once before and is visiting to help care for his grandson while Chirag pursues a graduate degree.

"He was just walking on the sidewalk as he does all the time," Patel told Al.com. "This is a good neighborhood. I didn't expect anything to happen." Patel said his father had to undergo surgery to fuse two vertebrae in his spine after being taken to the ground. Patel said his father is still unable to move his left leg.

The Madison police chief said Patel committed no crime and that the department is asking for the community's patience while it investigates.
