On Monday’s broadcast of “The O’Reilly Factor” on the Fox News Channel, retired Lt. Col. Tony Shaffer of the London Center for Policy Research revealed to host Bill O’Reilly that sources tell him U.S. Army Sgt. Bowe Bergdahl will face charges for desertion. Bergdahl was held captive by the Taliban-aligned Haqqani network in Afghanistan from June 2009 until his release in May 2014, which was part of a prisoner exchange for five Taliban members who were being held at the detention center at Guantanamo Bay. “Bill, the Army has come to its conclusion and Bowe Bergdahl,” Shaffer said, “Sgt. Bergdahl will be charged with desertion. I have been told and confirmed by two other sources that his attorney was given what we call a charge sheet. A charge sheet is results of the investigation listing out the articles of the Uniform Code of Military Justice that have been violated. The key violation is desertion. And this is has been done. The decision has been made. Let me be very clear. As a corporate entity, the Army has decided that they want to pursue Bergdahl for this violation.”

KD Dahl. LOL no way. If he was Bergie would be getting a martini and a massage right now. My initial take was no matter the investigating officer's findings, I expected Obola to pardon Bergie or dismiss the charges. That may still happen, but has no bearing on the integrity of the article 32 proceedings. In fact my last Article 32 investigation outbrief was taken by Dahl and he is quite the one for cross examination.

I'll make it clear. The investigating officer of the article 32 makes recommendations whether to prefer charges or not. It is up to the UCMJ approving authority to decide if those charges go forward to a Courts Martial. So if Bergie gets off, it means someone higher decided not to press or prefer those charges.

I hope you aren't suggesting that SeeBS is in the tank for Obama and the Dims.
In fact my last Article 32 investigation outbrief was taken by Dahl and he is quite the one for cross examination. Five observations: 1) Dahl's good work, the truth and justice are all going to be casualties. 2) Bergdahl's provable charges of desertion AND treason will be dismissed. 3) The Bergdahl-0dinga press conference and show of support in front of the White Hut was all the symbolism and message anyone needed to recognize Vultures of a Feather. 4) The military WILL take note of such mockery, disrespect and dismissal of traditional military codes of (in)justice. 5) 0dinga's 8 year plan to embarrass, demoralize, and sabotage the US military is a raging success.

The interesting point is it is quite difficult for Obola to circumvent the UCMJ. Only basis for dismissing charges is to prove the investigating officer had undo command influence. Can't be because Dahl is not in Bergies chain of command. Bergdahl can appeal if found guilty by Courts Martial. That is where an influence from the commander in chief can come in.

And so much for the investigation. Army Denies that Bowie Bergdahl is set to be charged with desertion. In a statement, Maj. Gen. Ronald F. Lewis, chief of public affairs for the Army, denied the reports, insisting that no decision has been made about Bergdahl. “The reporting from Fox News and NBC on Sgt. Bowe Bergdahl is patently false. To be clear there have been no actions or decisions on the Sgt. Bergdahl investigation. The investigation is still with the Commanding General of U.S. Army Forces Command who will determine appropriate action — which ranges from no further action to convening a court martial. We understand the public interest in this case and once a decision has been made, the Army will be open and transparent in this matter.”
Still pending. So that means no change.

Not so. Apparently the investigation was completed last October. It sure appears that the so-called results of that investigation are being stonewalled, if not being massaged. If this is true there is no integrity to the process, your guy notwithstanding.

f this is true there is no integrity to the process,
It is said that the report is being reviewed by commanders. but is not being released.
