Title: TransCanada Sued by Nebraska Landowners Over Keystone Path

TransCanada Corp. (TRP) was sued by Nebraska landowners in a new bid to block the Keystone XL pipeline a week after the state’s highest court rebuffed an attempt to void the approved path across the state, a leg that would complete the route from Alberta tar sands to Gulf Coast refineries.

Dual complaints were filed Friday against the Calgary-based company in state courts in York and O’Neill, Nebraska, by David Domina, the lawyer whose prior effort to halt construction of the 1,179-mile (1,897-kilometer) conduit was defeated by a cadre of judges who ruled his clients hadn’t established their legal right to sue.

The earlier lawsuit was aimed at now-former Republican Governor Dave Heineman, whom the landowners claimed was illegally given the authority by lawmakers approve the Keystone XL route. The new cases target the company trying to build it, and its right to appropriate property in its path.

“We believe TransCanada does not have a lawful route across the state,” and no right to use the power of eminent domain, Domina said Friday in a phone interview.

A ridiculous case as the pipeline will not proceed until it receives Obola's blessing. Which it won't.

This case will be dismissed. You can't sue some company for something they might do if the laws change.

Domina is likely filing these lawsuits as a shakedown tactic to get a big payoff so he will desist from these harassment lawsuits. This is often a cash cow for litigious "environmentalists" to line their pockets.

If the "environmentalists" are the rightful landowners, then they're entitled to line their pockets. The GOP and TransCanada have no right to usurp Government's power of eminent domain for private profit. If the property was being seized for legitimate PUBLIC use, such as for a freeway, then the landowners could be forced to accept a more reasonable market price. But there is no legitimate public benefit to minimize the price that TransCanada has to pay for this property.

So what if this is just a way to let Obozo OK the pipeline and it still not be implemented because of the court case.

Or he can just say "Nebraska doesn't want it so why should I allow it"?

Take your pick

Low gas prices are more likely to kill Keystone for the next few years than any court case or the Beltway. That is the Saudis' intent.

Maybe.. but I wouldn't bet on it...
In the global marketplace, the Saudis are aligned with the Western nations...
So based on that, I'd suspect that they're actually cooperating with Keystone advocates to flood the market with oil and put the hurt on Putin.
Who knows? If things get bad enough, maybe Putin will topple out of power... and maybe we'll see "aftershocks" of the collapse of the former Soviet Union with additional former soviet republics breaking away from Mother Russia.

Just wild speculation on my part, but the Keystone pipeline alone doesn't carry enough oil to make the Saudis pee their pants thobes.

Likely because it will never get to his desk. There are probably many more such challenges by "folks" before it ever really has a chance to be born.

I have some business interest in NE and have heard firsthand that not all folks there support the project routing in NE. They are not political operatives but plain, down home rural folk. At a recent meeting I attended one of them gave it to the newly elected NE governor about just how dangerous the pipeline would be. He was clearly in the minority at this particular meeting but there is a minority sentiment in that part of the heartland against the project, at least in their backyard.
