Title: OFFER TO (PARTLY) TAKE OVER LP RECEIVED

I have received the following email from tpaine, who has offered to take over financial responsibility for LP but is not interested in moderating the site.

Be aware that moderation implies control over content and a moderator may also be the target of litigation. (Lawyers tend to latch onto anyone even remotely involved in a situation to see what will stick.)

Feel free to discuss this and at the end we would need to take a vote of active posters in good standing. If the site ownership is turned over to tpaine I would end my moderation of the site and cancel the plans to move it to my own server.

Message follows:

"At this time I would like to make a formal offer to pay the bill for hosting and domain registration, and to assume the liability for lawsuits, -- As 'the owner'. --- However, I have no interest in moderating the site and would hope that someone who could get the approval of at least 75% of the currently active members would take on that job.

I would also hope that the site could retain the services of someone like Neil McIver to deal with tech issues.

Please post this on the site, seeing that you refuse to allow me to post comments."

It appears that tpaine's attempt to keep elPee alive won't fly.

I salute his willingness to make his stand, even though he's been silenced over there

Yep, it's all over but the shouting. -- I thought moderation by consent was worth a try, and am surprised how many supported that concept and voted for me. It's nice to know, and I appreciate it.

Probably, my silencing had a big influence on my support. Sort of a Catch 22 effect.

I believe all content on WAPO falls under the WAPO policy. That now includes the Volokh Conspiracy blog content.
And I believe that that policy issue is still being challenged, both in the courts, and at sites like Volokh Conspiracy.
The Fair Use exception generally does not include full articles. See the FR litigation which resulted in a $1M judgment in favor of the LA Times and Washington Post.
The FR judgement was in part based upon the fact that FR is a commercial activity. JR was profiting from his policy. LP is not.

They will wait one week for straggler posters to vote.

I see options 1,2 or 3 votes want elPee to stay alive, and that should be the way it goes IMO.

I read a court ruling a while back. They said if you are not for profit you can post the entire article. I don't remember how high of a court ruled that.

I have to say that I am rather surprised that after your initial offer that Gatlin / Palmjob / SOD and the rest of the klan did not make an offer. Really surprised.

Anyway, I still hope you get it!

That's probably the court opinion I read too.. As I said, this issue is far from settled, and IMO, the sysadmin at LP just used it as an excuse to ban me.

#317. To: TooConservative, sysadmin, All (#315)

OTOH, tpaine set a 75% approval for both becoming owner and for his moderator so, given how hard it is to get 50% of LP to agree that the sun rises in the east or any other topic, you have to wonder if his offer is serious.

What I don't understand is why if tpaine dosen't get 75% of the vote the next highest vote getter will be declared the winner. Perhaps I did not read the "rules" of this vote correctly. It was my undrestanding that the winner had to have reached at least 75% of the vote. If that is not the case it is entirely possible that tpaine gets 74% of the vote and the next highest vote getter, the declared winner, only received less than 10% of the vote. That doesn't seem to be rational.

sysadmin posted on 2015-01-11

A reading of his statement seems to be a condition after the fact of his ownership not prior to. And it is framed as a policy not as a commitment or promise. Polcies have been known to change.

If this is all there is that supports a 75% threshold on the vote offereing four choices on ownership IMO tpaine is getting hosed. Please understand that I would not vote for him and would likely not re-up or sign onto a site that he owned.

If not too much of a hardhsip on you please lift the ban on tpaine and let him speak for himself. Fair is fair.

If nothing more the exchange between him and pericles might prove quite entertaining:)
