Title: OFFER TO (PARTLY) TAKE OVER LP RECEIVED

I have received the following email from tpaine, who has offered to take over financial responsibility for LP but is not interested in moderating the site.

Be aware that moderation implies control over content and a moderator may also be the target of litigation. (Lawyers tend to latch onto anyone even remotely involved in a situation to see what will stick.)

Feel free to discuss this and at the end we would need to take a vote of active posters in good standing. If the site ownership is turned over to tpaine I would end my moderation of the site and cancel the plans to move it to my own server.

Message follows:

"At this time I would like to make a formal offer to pay the bill for hosting and domain registration, and to assume the liability for lawsuits, -- As 'the owner'. --- However, I have no interest in moderating the site and would hope that someone who could get the approval of at least 75% of the currently active members would take on that job.

I would also hope that the site could retain the services of someone like Neil McIver to deal with tech issues.

Please post this on the site, seeing that you refuse to allow me to post comments."

It took a lot of work to find a place to sign up that wasn't peopled entirely by freaks or Republican Party hacks.

You're the biggest asshole I've met in months.

You're the biggest asshole I've met in months.

You are calling someone you don't know Adolf Hitler because he wanted to let everyone know if he was posting under a different name.

Think of that for a second. You equated a man who started a war and genocide responsible for tens of millions of deaths to another who wanted to clarify a person's posting history.

...and I'm the asshole.

I was calling sysadmin Adolph. He's a jerk. And I didn't realize it until this evening.

Why doesn't sysadmin allow tpaine to post over there?

Because tpaine knowingly posted prohibited, copyrighted material that put sysadmin along with anyone else who potentially owned or operated LP at huge legal risk.

Looks like sysadmin won't let him back because of that.

I wouldn't either. This isn't worth losing my house in court.

Gatlin, misterwhite, palmdale, sod, -- have all bitch-slapped themselves by their overreaction to my possible ownership. They all have something to hide relating to their registration emails. -- I have no idea what it could be.

After looking at that train wreck for a while a few things are clear: --- 1. You were not liked by many posters there.

Thank you for another Mr Obvious remark. But I was shocked at how many did support me. It's nice to know, and they have my thanks.

2, Goldi-Lox called you a "pain in the ass" for refusing to honor your contribution commitment.

She was temporarily under the influence of the sites Rasputin, gatlin, imho.

3. People do not trust you with their personal information.

That was the plan that Gatlin and his gang tried to fly. -- I think they failed.

4. More people have requested a wipe of personal information than the ones you listed, making your statement a further example of your untrustworthiness.

I have virtually no interest in the info within registration emails, etc, -- As I'm almost computer illiterate.

5. You are on this site saying things behind sysadmin's back when you could have emailed them directly with your complaints & observations.

I did, and he didn't repost them accurately, if at all. Luckily, at that point AKA Stone fixed my registration problem.

6. You were banned for intentionally violating serious rules at LP. Further making a case that you aren't trustworthy..

That's the sysadmin's story and its debatable.

LP members may not have something to hide as your conspiracy deduces, they just don't trust someone who does and says things listed above. --- It took a lot of work to find a place to sign up that wasn't peopled entirely by freaks or Republican Party hacks. I don't welcome you coming here bringing your petty nonsense.

I initially was invited to sign up here years ago, and my registration got screwed up. You're the newbie here as far as I'm concerned.

Both you and the sysadmin swallowed the gatlin groups bull.

I have been posting full articles from the Volokh Conspiracy site for years because they had a policy of fair use for the purposes of discussion. They continued that policy when they moved to the Washbag, to the best of my knowledge.

Perhaps that policy has changed, but to date the WP is NOT attempting to put anyone at 'huge legal risk'. Get a life.

I have been posting full articles from the Volokh Conspiracy site for years because they had a policy of fair use for the purposes of discussion. They continued that policy when they moved to the Washbag, to the best of my knowledge.

I believe all content on WAPO falls under the WAPO policy. That now includes the Volokh Conspiracy blog content. The Fair Use exception generally does not include full articles. See the FR litigation which resulted in a $1M judgment in favor of the LA Times and Washington Post.

http://www.washingtonpost.com/blogs/ask-the-post/reprints-and-permissions/

How can I get professional reprints of, or permission to use, individual articles or videos?

Go to http://www.washingtonpostreprints.com/ and complete the relevant forms. You may also e-mail wppermissions@parsintl.com or call 212.221.9595, ext. 210. Please include details about the content you are requesting (headline or url, date of publication) and how you intend to use that content, as well as your contact information.

You generally do not need permission to post a link to content on washingtonpost.com or to embed videos using Post-provided embed codes.

Yep, it's all over but the shouting. -- I thought moderation by consent was worth a try, and am surprised how many supported that concept and voted for me. It's nice to know, and I appreciate it.

Probably, my silencing had a big influence on my support. Sort of a Catch 22 effect.

And I believe that that policy issue is still being challenged, both in the courts, and at sites like Volokh Conspiracy.
The Fair Use exception generally does not include full articles. See the FR litigation which resulted in a $1M judgment in favor of the LA Times and Washington Post.
The FR judgement was in part based upon the fact that FR is a commercial activity. JR was profiting from his policy. LP is not.
