I have received the following email from tpaine, who has offered to take over financial responsibility for LP but is not interested in moderating the site. Be aware that moderation implies control over content and a moderator may also be the target of litigation. (Lawyers tend to latch onto anyone even remotely involved in a situation to see what will stick.) Feel free to discuss this and at the end we would need to take a vote of active posters in good standing. If the site ownership is turned over to tpaine I would end my moderation of the site and cancel the plans to move it to my own server. Message follows: "At this time I would like to make a formal offer to pay the bill for hosting and domain registration, and to assume the liability for lawsuits, -- As 'the owner'. --- However, I have no interest in moderating the site and would hope that someone who could get the approval of at least 75% of the currently active members would take on that job. I would also hope that the site could retain the services of someone like Neil McIver to deal with tech issues. Please post this on the site, seeing that you refuse to allow me to post comments."

That's true, literacy is important, but just as important as literacy is, so is comprehension. Not everyone can bring up the words for how they feel in the way another would choose, but if you have a fare amount of comprehension then you will know what they are trying to say. I don't always say things the way they should be said, but they are true, and they come from my heart.

Some items tweeted on that short-lived twitter feed coincide with the same photos or articles being posted at LP by Pericles. Two articles and two photos from the Twitter timeline match their being posted at LP within hours. https://twitter.com/TheDestro1 You can see TPF-Destro linked back to TPF as a home site on Twitter. Not sure but I think Destro stopped posting at TPF because the audience declined to a handful, plus it was a closed site - had to be registered to lurk. I think either tpaine or Pericles would be acceptable owners and moderators. Maybe they can let tpaine own and Destro moderate as a compromise solution. Like I said earlier, the place self-moderates quite nicely. I find it difficult to believe that long time posters Palmhair and tater/Gatlin put their tails between their legs and scampered off like they did.

I think your prediction is wrong. The problem I see is that you and Pericles/Destro/Godwinson are equal candidates, at least from my point of view. I'm happy you stepped up to the plate, since I read there often. I think you and Pericles should come to some sort of mutual agreement. You own and he moderates - something like that. The vote will likely continue for days, perhaps a week. Lots of people don't check in for days at a time then check in to catch up on things, like on their day off. This idea that anyone can get 75% approval as owner (or mod) may have to be re-examined. No one who has been there long enough to be known is likely to pass muster. With a herd of cats like LP, you'd do well to get 65%. Or even 50%. sysadmin is getting some votes but that is mostly because no one has any idea of what his opinions are on anything.

I believe all content on WAPO falls under the WAPO policy. That now includes the Volokh Conspiracy blog content.
And I believe that that policy issue is still being challenged, both in the courts, and at sites like Volokh Conspiracy. The Fair Use exception generally does not include full articles. See the FR litigation which resulted in a $1M judgment in favor of the LA Times and Washington Post.
The FR judgement was in part based upon the fact that FR is a commercial activity. JR was profiting from his policy. LP is not.
