Title: Zimmerman Ordeal Not Even Close To Being Over

George Zimmerman was found not guilty on all counts last night. However, his adventure with the legal system is not even close to being over.

Zimmerman potentially has several lawsuits that should be brought against the people who caused this circus to happen. Namely:

1.) Against NBC News for doctoring the 911 recording to make him appear to be a racist. Their actions started the national lynch mob against him. If I were Zimmerman, I'd get the best trial lawyer in the country engaged, because this could be worth tens of millions of dollars in damages.

2.) Against the DA who withheld evidence from the defense team. The star witness is the government's forensic IT person who blew the whistle on this and was subsequently terminated.

3.) Against the Justice Department for dispatching paid rabble-rousers, opps... I mean "community organizers" to Florida to pressure the state for an arrest and prosecution.

Zimmerman also has to worry about two more potential legal actions against him. Namely:

1.) The Justice Department trumping up a hate crime charge against him. The NAACP is already calling for this.

2.) The Martin Family bringing up a wrongful death suit against him. I certainly would do it if I were them.

So, this is not even close to being over.

It's over for me. I expected a different result from the trial.

I will do my best to stay off these threads in the future. I won't be able to avoid the headlines, but I'll do my best to avoid reading the articles.

I doubt there will be a civil suit.

Zimmerman waived his right to have a judge determine whether he was eligible for immunity from criminal prosecution. He did not waive his right to claim immunity from civil prosecution. He will claim it and he will win. In a civil proceeding he must prevail on a preponderance of the evidence standard (more likely than not). He just prevailed in criminal court before a jury on the higher standard of proof beyond a reasonable doubt. There will probably be no attempt at civil suit as all costs are awarded to the immune defendant.

776.032 Immunity from criminal prosecution and civil action for justifiable use of force.

(1) A person who uses force as permitted in s. 776.012, s. 776.013, or s. 776.031 is justified in using such force and is immune from criminal prosecution and civil action for the use of such force, unless the person against whom force was used is a law enforcement officer, as defined in s. 943.10(14), who was acting in the performance of his or her official duties and the officer identified himself or herself in accordance with any applicable law or the person using force knew or reasonably should have known that the person was a law enforcement officer. As used in this subsection, the term “criminal prosecution” includes arresting, detaining in custody, and charging or prosecuting the defendant.

(2) A law enforcement agency may use standard procedures for investigating the use of force as described in subsection (1), but the agency may not arrest the person for using force unless it determines that there is probable cause that the force that was used was unlawful.

(3) The court shall award reasonable attorney’s fees, court costs, compensation for loss of income, and all expenses incurred by the defendant in defense of any civil action brought by a plaintiff if the court finds that the defendant is immune from prosecution as provided in subsection (1).

I heard his attorney mention something about that yesterday. Thanks for sharing this. Now I know what he was talking about. You are a good source of information. Thanks for taking your time to come here and share some of your wisdom with us.
