If there is no breathalyzer test taken at the scene, then the cops can make up any bulls**t they want.
You still don't understand. You can PASS a breathalyzer test in Washington State and still be CHARGED and CONVICTED of DUI.
The laws of every state are different. That was the point of my very first post.
About 7 years ago I was pulled over for speeding.
It was about 10pm at night. I had worked a 16+ hour day and I needed to catch a few hours sleep because I was hosting hundreds of people from all over the world the next day. My eyes were red, so the cops saw an opportunity and I had to go through the drill.
My breathalyzer was fine, so I didn't automatically lose my license. But I got arrested anyway. After they processed me, I was immediately released because I wasn't drunk!. (By the way, the towing company who took my car got $220 from me -- it's part of the racket.)
I did get charged for DUI and had to appear before a judge who sentenced me to pay court costs, a fine, and 25 hours of community service.
For some reason you don't seem to understand that the laws of every state are different, which was the point of my original post.
