MT. AIRY, OH (FOX19) - Attorney Eric Deters, who recently represented former Ben-Gal Sarah Jones, will represent the family of Erica Collins in a lawsuit. Collins, 26, was shot and killed by a Cincinnati Police Officer early Saturday afternoon after police say she refused to put down a knife. Police were originally called to the scene for a domestic disturbance within the Collins family. According to the Hamilton County Clerk of Courts web site, Collins has no criminal record in the county. In a press release attorney Deters says that "no one was in imminent harm when Erica was shot and killed by a police officer." He goes on to say "When she was shot, she was not near anyone and did not threaten the police officer in any manner." According to Deters, Collins' sister, who she was originally arguing with, maintains that no one was even close to Erica when she was shot. She and her brother, who witnessed the shooting say that Erica she had complied with the officers demands to drop the knife. Deters says that the family will be filing a federal lawsuit to allow a full discovery of all facts, for example: "What does the 911 call reflect? What do security cameras at the complex reflect? Were there audio/video recordings from the officer and cruiser? Why wasn't Erica tased or shot in the leg if she was a danger to anyone (which is denied?)" He also says that if warranted, they expect the officer to be prosecuted.
