Thomas Piatek, member of the Hutaree militia, was charged with plotting to kill police officers and overthrow the government, but was acquitted by a judge in March who cited insuffient evidence.

Earlier this year, Thomas Piatek of Indiana was freed by a judge who tossed out charges he and fellow militia members plotted to overthrow the federal government. Friday, Piatek got his guns back.

An admitted militiaman got 41 guns and more than 100,000 rounds of ammunition back from the government Friday.

The guns were confiscated when Thomas Piatek and six other members of the Hutaree militia were arrested in 2009 on charges that they planned to kill police officers and overthrow the government. He was acquitted in March, when a federal judge, Victoria Roberts, found there was insufficient evidence in the case. Piatek and the others then petitioned to get their weapons back.

The implements of destructions — which included an AK-47, handguns, shotguns, crossbows and swords — required two trips to take home, according to TV station WLS.

When Piatek arrived to pick up his property from the Hammond, Ind., police station, he was already packing heat.

“Just a piece, you know, whatever," Piatek said, according to WLS. "You got a phone, keys, whatever. It ain't a thing with me."

Other members of the militia also got their guns back, but none had a collection to rival Piatek’s.

Thomas Piatek even brought along a gun to pick up his guns. 'It ain't a thing with me,' he said.

Piatek also got back military helmets, bulletproof vests, $100 cash and his cell phone, the Detroit Free Press reports.

The judge let weapons charges stand against two members of the militia, including its leader, David Stone Sr. Both pleaded guilty to possessing a machine gun, a federal crime.

“This is a victory for the Constitution," Piatek's lawyer Arthur Weiss, who accompanied his client, said.

I was surprised that they took his edged weapons.

In Alaska they don't grab up knives when they are grabbing up guns.

We also have a form of "habeas pistola",

According to Wayne Anthony Ross ...

"Later, in an assault case, I had gotten a good deal for my client but the State wanted his firearm forfeited. I always have clients assign the firearm to me as part of my fee in cases such as this, and so I protested to the judge and filed a pleading entitled "Motion For Writ Of Habeas Pistola". The good- humored judge granted my motion and issued an "Order Granting Writ Of Habeas Pistola", finding that it would be cruel and unusual punishment for the gun to be forfeited to the State. (See Shooting' Times, November 1990.)

In 1995, our current Governor, Tony Knowles, ended the State's practice of selling forfeited and surplus handguns to the public, deciding that such handguns would be destroyed instead. In a letter to the NRA, Governor Knowles wrote that Alaskans

" are concerned about violence. I believe they trust in me to try to reduce crime and make it harder for criminals to get their hand on weapons. Destroying surplus handguns is one way to do that. As for the money we'll lose by disposing of guns instead of selling them, I have no second thoughts."

I quickly filed suit, seeking a temporary restraining order against the destruction of those firearms. The State's attorney told the court that the State was only going to destroy "sawed-off shotguns, assault rifles, and Saturday Night Specials". As a result, the judge declined to grant the restraining order and the next day some fifty guns were destroyed by burning with a welding torch. When I got to view the destroyed guns, I saw that a lovely little Colt Woodsman, an Air Force survival rifle in .22 Hornet, and a large number of like-new S&W .357 Magnum stainless steel revolvers had been cut up! The State's attorney had lied!

I immediately amended my court complaint to seek personal damages against the Governor "on behalf of the people of the State of Alaska for the willful destruction of State property". Shortly thereafter, the Governor put the destruction of firearms "on hold", later agreed that no more guns would be destroyed (instead they would be sold to licensed dealers), and paid my attorneys fees.

Then, earlier this year, I noticed the Governor's picture in the newspaper. He was shown shooting one of the brand new S&W pistols he had gotten for the Alaska State Troopers by trading in the State's surplus guns to a local dealer. The Governor was taking credit for saving the taxpayers money by utilizing the surplus guns to rearm the Troopers with newer arms! What a guy!

Governor Knowles, is very anti-gun and anti-hunting. He vetoed a bill to improve Alaska's concealed carry law. (Our Republican-controlled Legislature over-rode the veto.) He approved putting anti- hunting initiatives on the ballot, closed certain areas of the State to bear hunting, and sent hundreds of thousand of dollars of State funds to extremist environmental groups who oppose hunting and development of Alaska's resources."

So what? NONE of these statist bastards are, it cuts THEIR power.

How the F do you think that we ended up with the messiah "king" obammy?

Funny.

I'm talking about how one party has a KNOWN HISTORY of anti-2nd amendment and anti-TRTKABA ACTIONS, and you bring up your favorite EX president. Whose own beliefs are "fliers" when compared to his party's average historical record, especially when compared to the RATs, on TRTKABA.

Are you fuckwads even capable of thinking like adults?

Of acting like adults?

I swear that EVERY discussion turns into a grade school level he did she did bullshit "blame fest" which solves NOTHING of whatever the problem that we all have NOW we are supposedly talking about.

NEWS FLASH!!!!!!!!!!!!!!! FOR ALL IDIOTS!

The PAST is PAST we can't do shit about it.

The FUTURE is the FUTURE, despite our best efforts, it is UNKNOWN to us ALL.

NOW is NOW.

NOW is the PRESENT which is where WE LIVE.

NOW is the ONLY place we can ACT!

It doesn't matter at all who started it, it only matters how we STOP IT.

You couldn't parody your absurd stated position any better if you tried to.

I say that NOW is the time to ACT to save America then you claim to agree and say NOT TO ACT.

LOL!

Dude you and your ilk are politically just so plain fence post fucking STOOOOOOPID.

LOL!

THAT is the center of you and your ilk's "argument" in any case isn't it?

NO ACTION = not only real but valuable, (to AMERICA) = ACTUAL ACTION.

Then when ALL of AMERICA loses, you can strike a "superior" pose.

What a pitiful excuse for an AMERICAN you and your ilk are!

What a bunch of absurd political mo - rooons.

Your entire line of reasoning is nothing but a desperate attempt to browbeat others into supporting Romney as the "lesser of two evils". Most of the rational thinkers on this site, including myself have seen that game in action for the past 3 election cycles at least, and are not playing it any more.

The ‘Lesser Of Two Evils’ Con-Game

The moral relativism of the “lesser of two evils” philosophy has been draining the heart and soul of America for decades. Many of us in the Liberty Movement understand that it is nothing new, and have come to expect the abusive and emaciated logic it entails from time to time.

However, over the course of the past year it has become apparent to me that the talking points and propaganda that drive the hypocritical worldview are being utilized on an even grander scale than ever before.

Now, one of the first tenets or rules that a person learns when delving into the Liberty Movement is that there is no such thing as political parties in America today. There are no conflicting interests in Washington D.C. There is no “grand battle” between left and right for the minds of the masses. It is a sham. A con. A fantasy. A false paradigm.

In reality, the leaderships of both fraudulent parties support essentially the same methodology, and that methodology could be summarized thus: Centralize everything, globalize everything, control everything, grow government power, reduce the effectiveness of the citizenry, turn the public against each other, rob them while they’re distracted.

If an American does not understand this dynamic and how it is used to dominate the ebb and flow of our culture, then that American knows nothing. He is lost…

******

Another desperate tactic you clowns try is the myth that voting third party is a wasted vote.

Nothing could be further from the truth.

Myths and Lies of the Two-Party System

Myth One: The Wasted Vote

The first thing most people will tell you when you say you're voting for a "third" party candidate is that you are "wasting your vote."

This myth is related to each of the others, and is usually followed closely by one of the other myths by way of explanation. "You're wasting your vote because... (fill in blank with one of the other myths)."

But how can voting for the candidate you most closely identify with be a wasted vote? Isn't compromising your beliefs on important issues really the wasted vote? Isn't settling for second best, or the lesser of two evils really the wasted vote?

The point of having a representative democracy is for each citizen to be able to effect the future of their community. Elections are the main mechanism for "we the people" to tell our representatives how we feel.

It is vitally important that when we make that statement, it is accurate. Sending the wrong message by compromising your vote lessens your ability to influence the direction of public policy.

Again, I ask you, which is the wasted vote - A vote for a major party candidate you despise because you despise the other guy a little bit more - or - A vote for a candidate who says what you'd say if you were running for office?*****

Perhaps these words from Carroll Quigley will make it simple enough for you to understand:

The argument that the two parties should represent opposed ideals and policies, one, perhaps, of the Right and the other of the Left, is a foolish idea acceptable only to the doctrinaire and academic thinkers.

Instead, the two parties should be almost identical, so that the American people can "throw the rascals out" at any election without leading to any profound or extreme shifts in policy.*****
