TheU.S. Supreme Court’s decision Thursday to uphold all but one part of the 2010 healthcare law produced some strong reactions. Supporters declared victory and opponents vowed to keep fighting. That much was to be expected.

But Kentucky Republican Sen. Rand Paul’s rant against the high court’s ruling was a surprise of sorts. The physician-turned-elected-official appeared to suggest that the court needs a legal lesson or two.

“Just because a couple people on the Supreme Court declare something to be ‘constitutional’ does not make it so. The whole thing remains unconstitutional,” Paul said in a statement. “While the court may have erroneously come to the conclusion that the law is allowable, it certainly does nothing to make this mandate or government takeover of our healthcare right.”

The senator is right, of course, about "a couple people" deciding. But in this case, five people, who happen to be justices on the Supreme Court, declared the law constitutional. Those five individuals constitute a majority on the high court and thus are empowered to decide whether something is constitutional or not.

Perhaps Paul’s beef, though, isn’t with this court but with the 209-year-old landmark decision in Marbury vs. Madison that established the basis for judicial review under Article III of the Constitution and cleared the way for federal courts to declare laws unconstitutional.

Either way, Paul's comments were the latest in a week of decisions that sparked spirited public debate. First, Justice Antonin Scalia read his feisty dissent from the majority's opinion that struck down most of Arizona's harsh immigration law, and then a freshman senator declared that just because some people on the Supreme Court weigh in on a legal matter, that doesn’t mean they know what they are doing.

The USSC is a result of many men's follies.

BUT it is the system that is fault, because it ASSUMES that the people in it are moral honest people AND that these same people love and respect the US CONSTITUTION, and the concept of federalism and limited government.

Can I piss all of you "conservatives" off with the bottom line here?

During his confirmation hearings, Roberts stated that his job is to find a way to constitutionally uphold the laws passed by Congress.

His view is representative of the modern "conservative" view of jurisprudence, which supports majoritarian democracy above all else. Justice Bork held the same view.

The view of traditional conservatives and libertarians is that enforcing limited government and fundamental rights is more important than majority rule.

Clarence Thomas is a traditionalist / libertarian justice, who has no problem overturning unconstitutional laws. Roberts is a majoritarian like Bork, who tries to find a way to make laws passed by congress work.

Roberts, Thomas, Alito, Scalia, and Kennedy were absolutely right in determining that the individual mandate could not be upheld under the Commerce Clause (which has been abused since the Roosevelt era).

Unfortunately, Robert's majoritarian views compelled him into a convoluted opinion that the mandate is somehow a tax.

It's modern conservative jurisprudence at work.

If you don't like it, then reject modern conservatism and embrace libertarianism.

I really get it honest.

DECADES ago MENSA started bugging me to join. I have no idea where they got the data.

Anyhow my mother got wind of me ignoring them, and she pitched a serious fit!

She started talking about "networking" and "contacts" and such stuff and was on me like white on rice to go to a MENSA meeting.

My mother was not one to be ignored. I gave up and went to ONE meeting.

Jeeeeeeeeze what a "group W bench" even for Alaska! Turned out that I already knew a couple of them. I never went again because I was logging and building log cabins at the time. It turns out that MOST MENSA members aren't real interested in Scandinavian scribe fit.

All IQ is is a measure of POTENTIAL. It's what you DO with it that matters.

The average so called "genius" may dominate in some fraction of their life but in others ways WE, (hey erica claims to be a genius because MENSA wanted her, what am I? chopped liver?), are complete and absolute retards. Alot of time these do NOT balance out.

All IQ is is how large of a "jar" we have as an individual, it doesn't even try to address what the "jar" contains or DOES.

Only a MORON would even try to gain status in a conversation by claiming to be a genius.

Even if it is factually true.

Normal, (hey I only went to ONE meeting), people laugh OUR asses off at such nonsense!

It's kind of like trying to give yourself a nickname.
