With all the media hype about the shooting of a Congresswoman, understandably so...

...she is still alive, but a federal judge is dead.

If a federal judge was murdered by a gunman on any other day, it would have been even BIGGER news. Especially if he was pro-abortion. However, this was a disposable federal judge. Not worthy of mention. Judge John Roll was the leading judicial voice supporting Sheriff Richard Mack's Tenth Amendment lawsuit against the Feds. Sheriff Mack has stated that Judge Roll was by far the best Federal Judge in the U.S. (Constitutionally speaking).

So good riddance, I suppose. No discussion about his character, his grieving family, his service or his case rulings. Besides, his being pro-gun might not sync with the tea party label which was so readily applied to the murderer kook.

Judge John McCarthy Roll...A Patriot who upheld the Constitution by helping to defeat portions of the illegal federal power grab, known as the Brady Bill.

Judge John M. Roll, murdered in Saturday’s shooting rampage in Tucson, was the leading judicial voice supporting former Graham County, Arizona Sheriff Richard Mack in his 1997 lawsuit against the federal government. Mack is a speaker, states’ rights advocate and author of The County Sheriff: America’s Last Hope.

Sheriff Mack observed in an interview on Alex Jones’ Jan. 10 radio broadcast that John Roll changed his life. He has quoted Roll in his books. In 1997, when Mack was sheriff of Graham County, he joined with Sheriff Jay Printz of Montana in filing a suit against the federal government regarding the Brady Act. The resulting Supreme Court decision found the Act unconstitutional.

The Brady Act not only would have required state and local officials to carry out and fund a federal mandate regarding gun regulations, but it also called for the arrest of any law enforcement officer who refused to enforce it. On the basis of these provisions, Mack and Printz filed suit, and were eventually joined by five other sheriffs around the nation. Mack recalled of the judge:

He was really worried about the sanctions against me (or any other sheriff) — he protected me. Judge Roll stood up for me in particular because I was the only one filing the lawsuit at the time.

Mack was challenging the act as unconstitutional and in violation of the Tenth and Thirteenth Amendments of the U.S. Constitution. Judge Roll added that it was “unconstitutionally vague in violation of the Due Process Clause of the Fifth Amendment.” Mack hoped to gain a permanent injunction against the Brady Act.

Judge Roll’s 1994 decision included his defense of Mack:

Mack is thus forced to choose between violating his oath or violating the Act, subjecting himself to possible sanctions.... See Board of Education v. Allen, 392 U.S. 236 (1968) (plaintiffs' belief that statute forced them to choose between following oath and statute supplied personal stake necessary for standing). The government's position is untenable. When the language of a criminal statute is clear, as is true of 18 U.S.C. 922(s), the executive branch is not at liberty to amend that statute by fiat.

During Alex Jones' January 10 radio interview, Sheriff Mack reminded him that six months previously Arizona had returned to a constitutional form of adherence to the Second Amendment. No permits, fees, or licenses are required for Arizonans to carry. Mack said he believed that the recent mass shooting is being used to reinstate gun laws in Arizona, asserting, "This may be another spoke in the wheel of this whole story."

Not all remember Judge Roll quite so fondly. The Jan. 10 New American reported,

The other prominent victim who was killed during the shooting rampage, John M. Roll, was chief federal judge in Arizona. He was appointed in 1991 by the senior George Bush. Ironically, Roll had been the target of hundreds of threats in February 2009 after he allowed a lawsuit filed by illegal immigrants against a rancher to go forward. "They cursed him out, threatened to kill his family, said they'd come and take care of him. They really wanted him dead," a law enforcement official told the Washington Post in May 2009. But it took a madman to kill him.

Though positions such as this on the judge’s part may seem at variance with his actions in the Mack case, he nevertheless made an important contribution to individual liberties in his defense of Sheriff Mack.

Alex Jones called the judge a patriot, noting the irony that his death was “blamed on the Tea Party” and other constitutional conservatives.

Roll was known within the Tucson legal community as a conservative and even- handed jurist who, in recent years had worked hard to increase funding for an overstretched Arizona federal bench.

“He was a life-long Republican and I don’t think he would have objected to hearing anyone call him conservative,” said Ninth Circuit judge Michael Daly Hawkins, who had known Judge Roll for over 40 years. “But he was always fair- minded and absolutely attentive to everyone who appeared in his courtroom.”

Roll had attended the event Saturday in Tucson to thank Rep. Gabrielle Giffords for signing a letter to Judge Alex Kozinski, the chief judge of the Ninth Circuit, to help convince the court to declare his federal judicial district a judicial emergency due to the high number of immigration cases that were being heard in that district, according to Judge Hawkins. A judicial emergency would put certain new measures in place, such as allowing judges to delay a trial because there were not enough bodies to hear the cases.

Judge Roll was appointed to the federal bench by President George H.W. Bush in 1991, and had served as chief judge of the District of Arizona since 2006.

Throughout the time on the federal bench, Judge Roll developed a reputation as for dealing sternly with criminal defendants, especially those accused of crossing into the state illegally from Mexico. But the judge was also fair- minded, said Richard Martinez, a Tucson attorney who specializes in civil rights litigation. Martinez appeared before the judge in a high profile 2005 suit filed by Mexican immigrants, who claimed that their civil rights had been violated by Arizona ranchers who had detained them at gunpoint after they crossed the border.

Judge Roll in 2009 denied the ranchers’ motion to dismiss the case, a ruling that earned him scorn among some factions and even death threats.

Roll and his wife were provided federal protection for a stretch following the 2009 decision. He told the Arizona Republic that the situation was “unnerving and invasive.”

In recent years, Judge Roll gained bi-partisan support and respect for his tireless pleas for more resources for the federal judiciary, often telling legislators that many of his colleagues on the bench were overwhelmed with immigration and drug cases, attorneys said.

Prior to joining the federal bench, Judge Roll served as an Arizona state judge and as a prosecutor at the city, county and federal levels. He graduated from the University of Arizona in 1969 and the University of Arizona College of Law in 1972.

According to the LAT, Judge Raner Collins of Tucson is expected to replace Roll as chief judge for the district.
