Jacksonville, FL cops are being accused of attacking a teen after mistaking him for an assault suspect, then arresting his family members when they tried to stop the beating. Then police confiscated an unrelated woman’s camera and arrested her for videotaping the incident.

This happened Christmas Eve on Davis Street in Jacksonville.

Police initially responded to a call for a fight on Davis Street around 4 p.m.

Another fight broke out several minutes later that injured several people including police officers.

I spoke with the people who are accused of assaulting the police officers. They told me the incident all started because the officers targeted the wrong person.

37-year-old Jonathan Guiterrez, of Miami had just arrived in Jacksonville hours before the incident happened. He was charged with two counts of assaulting a government official, failure to disperse and injury to personal property, according to warrants.

His nephew, 22-year-old Angel Ruperto, from Puerto Rico, was charged with three counts of assaulting a government official, two counts of assault causing physical injury, and one count each of resisting a public officer and failure to disperse on command, according to warrants.

19-year-old, Jonathan Guiterrez Jr., a freshman in college, was charged with assault on a government official, one count of assault by strangulation and failure to disperse, according to warrants.

Guiterrez said he walked down the street to talk to the police officers after his nephew, 17-year-old Jose Franco, from Jacksonville, was involved in the initial fight. According to warrants, Franco was charged with assault to inflict serious injury and disorderly conduct. He was not involved in the fight with police officers.

Guiterrez then said police mis-identified his 16-year-old son, Hector, for another person. He said Police believed his son was involved in the initial fight because of his clothing.

According to Guiterrez, Hector was tackled to the ground by police.

That's when Ruperto stepped in to help his cousin out. Guiterrez said he watched as police were "beating Ruperto with a baton."

Guiterrez Jr., ran over and tried to get one of the police officers off of his cousin but he was unsucessful.

Guiterrez Jr., was then taken down by police, according to his father. Guiterrez said they pepper sprayed and attempted to taze his son before they handcuffed him and put him in a cop car.

"My whole face was burning," Guiterrez Jr. said.

Guiterrez said he only got involved in the fight and started throwing punches at officers because he was protecting his family. He said police were acting too aggressively.

"It all happened so fast and the next thing you see is a bunch of police officers running up. I was shocked. I didn't know how to react [at first]. This [was] not an arrest. This [was] abuse. This [was] a fight," Guiterrez said.

I tried contacting the Jacksonville Police Department to get answers about what happened. All they would say is that they investigate every incident involving resistance to officers. They said they wouldn't comment further until it goes through internal affairs.

Guiterrez said this was all a misunderstanding and he hopes they can get the incident cleared up before they drive home to Miami on Thursday.

"Take all legal action aside they beat the **** out of my kids. It was unbelievable," Guiterrez said.

Another woman, 57-year-old Daisy Besancourt was charged with failure to disperse on command, according to warrants. Guiterrez said she was just recording the incident on her cell phone. When she refused to turn it off, he said police confiscated it and arrested her.

Guiterrez Jr. is due in court .
