WASHINGTON — The National Restaurant Association gave $35,000 — a year’s salary — in severance pay to a female staff member in the late 1990s after an encounter with Herman Cain, its chief executive at the time, made her uncomfortable working there, three people with direct knowledge of the payment said on Tuesday.

The woman was one of two whose accusations of sexual harassment by Mr. Cain, now a Republican candidate for president, led to paid severance agreements during his 1996-99 tenure at the association. Disclosure of the scale of the severance further challenged his initial description of the matter as a “witch hunt,” as did new descriptions from the woman’s friends and colleagues of her level of discomfort at work.

Adding to the pressure on Mr. Cain, a lawyer for the second woman called on the restaurant association to release her from a confidentiality agreement signed as part of her settlement, raising the prospect that she could publicly dispute Mr. Cain’s account of what happened. The lawyer said the confidentiality agreement had left her unable to respond to Mr. Cain’s denials of any inappropriate behavior toward the women.

This begs the question whether Cain has opened the door legally for her to go ahead and talk about it. Even should this not be the case, the dollar amount of the`agreement is so low, i see vested interests opposed to Cain as very likely willing to pay what she would have to pay were she to speak

Actually, Cain never signed a confidentiality agreement, so what he has said has no impact on HER signing one in return for one years pay.

Second, should she choose to violate her agreement, the NRA has a rock solid lawsuit that will 1) get the 35K originally paid back...2) Treble damages...3) Payment of ALL legal fees associated with this agreement...4) and any financial compensation she might possibly realize as a result of this 'breach of contract'. In that regard, the case law is based upon the same legal reasoning OJ couldn't make a dime off his book.

What will come out is which campaign within the GOP primary was responsible for the leak. That blowback from GOP primary voters will most likely kill whichever campaign it was. JMHO.

Interviewed today on KTOK's Mullins in the Morning, (Chris) Wilson, of Wilson-Perkins-Allen Opinion Research headquartered in Washington, D.C. explained he was a witness to the incident.

Chris Wilson, who is a partner at Wilson, Perkins, Allen Opinion Research in Washington, is a pollster for Make America Great Again, the “super PAC” run by one of Rick Perry’s former top aides. In the 1990s, he worked for Tony Fabrizio, a leading Republican pollster who now is a senior adviser to Mr. Perry’s campaign.

Mr. Fabrizio, who joined the Perry campaign last week as a senior adviser and national pollster, worked for Mr. Cain at the National Restaurant Association in the 1990s and during his 2004 Senate bid. He said in an interview that he had no direct knowledge of any sexual harassment allegations against Mr. Cain at the time and was not behind the leak to Politico.
