I believe it has been a federal felony for decades now. I think what has happened here is that he was changed under the wrong charges. The original charges are probably unknown to the prosecutor who only knows of the 2005 Stolen Valor Act.

The way it was explained to be about impersonating a serving officer being a federal felony is because serving officers have the right (not to mention duty) of carrying loaded firearms anywhere they go,and they can't be arrested for it because if Martial Law were declared they would be the ones who became the local LEO's and Sheriffs until order was restored. If they did not have this legal right they could be arrested by local LEO's for violating local ordinances.
IIRC,this goes back to Colonial Days.
Which means chances are nobody has ever been charged under this stature in the last 200 years.

Eisenhower was nothing more than a overpaid clerk. As far as I know the only really good thing he did personally his whole life was remind everybody to "beware of the military-industrial complex" on his way out the WH door. Background: Born the third of seven sons in Denison, Texas to David Jacob Eisenhower and Ida Elizabeth Stover. His father was an Engineer while his mother was a devoted follower and supporter of the Watch Tower Bible and Tract Society (Jehovah's Witnesses). The family home served as the local meeting hall for the group from 1896 to 1915. The constant and regular exposure of Eisenhower to End of the World imagery mixed with Bible prophecy by the Jehovah's Witnesses had a profound impact on him throughout his life. It was under the guidance of General Conner that Eisenhower found a grounding in essential military strategy and politics. After finishing his term with Conner, Eisenhower was promoted again to Major and attended the Command and General Staff College at Fort Leavenworth. In 1933, he was then appointed chief military aide to General Douglas MacArthur and accompanied him to the Philippines. The Stolen Valor Act (18 U.S.C. §704) was revised in 2005. This revised version was ruled unconstitutional by the 9th Circuit in 2010. As noted, the Supreme Court has granted cert to hear the case sometime in 2012.
An infraction pertaining to the Medal of Honor provided for imprisonment for not more than one year. A federal felony is subject to imprisonment in excess of one year. The statute would only establish a misdemeanor.

Patton WAS mentally unstable. I have talked with soldiers that served under him in WW-2,and they were all in agreement that he was both insane and a asshole. At least technically. The few cases I know of where someone has gone to jail for falsely claiming a MoH always involved profiting from that claim. Which would make it a fraud and a felony. Telling your neighbor you earned a MoH is one thing. Telling audiences on speaking tours or using those credentials in order to establish your "legend" in order to promote your business and get contracts is something altogether different.

There's no question that Ike, FDR, his Commie overlords or whomever sandbagged the advance of the US military and sabotaged our own efforts by the end of WWII.
Cutting a deal with Stalin and the American Commies did NOT work out well; It should have been ridiculed by everyone at the time.
