UN Calls for Probe into Gaddafi's Death: Special Rapporteur warns the manner of the deposed Libyan leader's killing could be a war crime The UN has called for an international investigation into the death of Muammar Gaddafi, the deposed Libyan leader, saying it could well have been a war crime. Christof Heyns, the UN Special Rapporteur on extrajudicial, summary or arbitrary executions, told Al Jazeera on Friday that a proper investigation into the exact events surrounding Gaddafi’s death was a key test for Libya’s future as a democratic and accountable state. “The Geneva conventions are very clear that when prisoners are taken they may not be executed willfully and if that was the case then we are dealing with a war crime, something that should be tried.” “It’s important that the new government will be placed on a solid basis where there is accountability for illegal actions. I think it would be good if there was international investigation into this as well, and it’s not simply Mr Gaddafi but also there’s the dangers of reprisals against others as well and that is where it is important to draw the line to say that new system in place one of accountability.” Libya's National Transitional Council delayed Gaddafi's burial on Firday in order to arrange a secret location and allow for an investigation into his death, officials said. Mohamed Sayeh, a senior member of the NTC, told the Associated Press news agency that a "third party will come from outside of Libya to go through the paperwork" relating to Gaddafi's death. Captured alive In the hours following Gaddafi's capture, NTC officials and fighters gave different accounts of what happened, but several videos taken by fighters at the scene showed him being taken alive, though bleeding from the left side of his head. In the videos, fighters shout, scream and fire their weapons in the air. Some can be seen punching Gaddafi and pulling his head down by his hair. Gaddafi, appearing dazed, gestures to them and touches his wound, then displays his bloody hand. No videos have emerged showing the moment of Gaddafi's death, and it is unclear exactly how he received his mortal wound. The first video, received by Al Jazeera, showed his lifeless body lying on the pavement. An international commission of inquiry launched by the UN Human Rights Council is already investigating killings, torture and other crimes in Libya, and Colville, the UN human rights office spokesman, said he expected that panel would look into Gaddafi's death. "It is a fundamental principle of international law that people accused of serious crimes should if possible be tried," he said. "Summary executions are strictly illegal. It is different if someone is killed in combat." Jibril claims 'crossfire' According to some reports from Sirte, Gaddafi and an escort of bodyguards had attempted to break out of the siege of the city, which had lasted for more than a month. Their convoy was struck by French fighter jets and a US Predator drone, and a wounded Gaddafi took cover in a drainage pipe with his surviving entourage. NATO said on Friday it had struck 11 vehicles that were among 75 vehicles attempting to force their way out of Sirte, but said it was unaware that Gaddafi was travelling in the convoy. "The vehicles were carrying a substantial amount of weapons and ammunition posing a significant threat to the local civilian population," NATO said. Pursuing NTC fighters fired at the group as they fled, then fought and killed some of the men guarding Gaddafi and took him captive, Reuters said, quoting eyewitnesses. Mahmoud Jibril, the NTC's de facto prime minister, initially said Gaddafi had been killed in a "crossfire" and that it didn't matter what happened to Gaddafi's body "as long as he disappears". "He was alive up to the last moment, until he arrived at hospital," in the city of Misrata, Jibril said. Jibril pledged to resign after the fall of Sirte, which the NTC set as the final criterion for declaring the "liberation" of Libya. Abu Bakr Younus, Gaddafi's defence minister, and Mutassim, one of Gaddafi's sons and former national security advisor, were also killed in Sirte on Thursday.

The UN will conclude that Libyan Rebels are too dysfunctional to govern Libya and thusly.......the UN should send boots on the ground to occupy Libya and establish governence. Maybe it saves Libya a civil war...which NATO and AFRICOM would surely arrange,...so that UN can occupy Libya for the Bankers and Power Elite.

Killing someone outside a judicial procedure, even in countries where there is the death penalty, is outside the rule of law." It raised the possibility that rebel soldiers could be pursued for war crimes. Amnesty International, meanwhile, called for "a full, independent and impartial inquiry" into the circumstances of Gaddafi's death. Gaddafi's wife, Safia, also called on the UN to investigate the death of her husband and her son, according to a Syrian TV station. David Cameron, however, said Libya, not the UN, should investigate the deaths. His spokesman said: "The account of precisely what happened is a matter for the NTC." Several videos of Gaddafi after his capture near Sirte show him walking and talking to his enemies. His body was later photographed with a clean bullet hole in the left temple and bullet wounds in his abdomen and chest. His son Mutassim, meanwhile, was photographed smoking a last cigarette and holding a bottle of water, almost uninjured, before being shot in the neck. Mahmoud Jibril, the interim Libyan prime minister, admitted Col Gaddafi was relatively unscathed when he was captured. He said: "When they transferred him to the pick-up truck he had no injuries. When the vehicle started moving he was caught in the crossfire and he was injured with a shot to the head." He said Gaddafi was taken by ambulance to Misrata, but died there from his wounds. The NTC Information Minister, Mahmoud Shammam, said: "It seems like the bullet was a stray and it could have come from the revolutionaries or the loyalists. The problem is everyone around the event is giving his own story." But one member of the National Transitional Council, who asked not to be named, confessed: "They beat him very harshly and then they killed him. This is a war." The NTC said no orders had been given to kill Gaddafi. Another senior NTC official said: "There have been rumours flying around since the killing of Gaddafi after images were released, claiming that our revolutionaries slaughtered him. "No instructions were given to kill Gaddafi and we do not believe our revolutionaries intentionally killed him." Hisham Krekshi, the deputy chairman of Tripoli City Council, conceded that "revenge" may have played a part in Gaddafi's death, but added: "It's a war and everybody is happy with his death." Dr Ibrahim Tika, who examined the body, suggested Gaddafi was already bleeding to death from an abdominal wound by the time he was shot in the temple. He said the "primary reason" for Gaddafi's death was the bullet in his gut, adding: "Then there was another bullet in the head that went in and out of his head."

I don't think they should be prosecuted. The boy with the Golden Gun is innocent.
AFRICOM committed to taking Africa away from China,...and Russia so ya.....They've been planning to take Libya for sometime This was/is,...a sell out,...and a betrayal which has cost Libya her future. NATO/AFRICOM probably want to clean up their image [not that they give a shit]..but you know....for the church crowd and enviro nazi's etc. Tactical like......NATO/AFRICOM now have North Africa.... oh forgot,.... cuz we know what the Rats will do on and off the lease.

I agree these Rebels are 'dysfunctional', and a few other things I could add. I am not, nor have I ever been, a defender of Gaddafi, but just think, the future government of this nation will be placed into the hands of roving bands of savages who summarily execute defenceless prisoners of war in their custody.

No way China and Russia were tricked on the UN No fly zone and other UN/weapons ban etc...for Libya.
US has control of the mid east via Iraq's forward bases.

RATS tried to attack certain parts of Tripoli and gave that up.
A great many Libyans loyal to Kaddafy,....did not get into the fight like they could have.
some did create action committee's...and went about zapping mercs,rats and blowing shit up.
but most just sat at home.
city's like Sirte and Bani Walid were different,...your surrounded,...you fight to the death....and they put up one helluva a fight!
Its possible several citys and towns which changed hands in the past month could give the RATS trouble...unless NATO bombs them again.
All the tools for civil war are in place,
Libyan people should march out and demonstrate to world media that the majority want no part of the Rebels for Gov,...and force NATO/UN to deal with them.
