As has been pointed out before, the law recognizes a bifurcation of what occurs on a battlefield and what occurs in custody. The issue was never whether the capture of a combatant was legal. It was what DumbDubv43 tried to get away with AFTERWARD that was the issue. The SCOTUS agreed, btw. I challenge you to find any post of mine in which my advocacy of this fact changed in Janiary of 2009. 0bama starting wars in Libya and Yemen while reneging on his promise to stop the wars in Afghanistan and Iraq is honorable behavior of a Nobel Peace Prize winner, yet it's Bush and Cheney who are the "War Criminals."
