As has been pointed out before, the law recognizes a bifurcation of what occurs on a battlefield and what occurs in custody. The issue was never whether the capture of a combatant was legal. It was what DumbDubv43 tried to get away with AFTERWARD that was the issue. The SCOTUS agreed, btw.
I challenge you to find any post of mine in which my advocacy of this fact changed in Janiary of 2009.

- Started a covert, drone war in Yemen - Escalated the proxy war in Somalia - Escalated the CIA drone war in Pakistan - Maintained the military occupation of Iraq - Sharply escalated the war in Afghanistan

It goes the same for that that asshole in Yemen. A clear combatant as well as the command and control of other combatants who CLEARLY - despite your contrary myopia - would attack US citizens and interests whereever they could be engaged.

Alow me to re-focus your attention on the context of my answer which was you incorrectly stating that Obama promised to "wind down" Afghanistan which was 100% bullshit.
I will focus this strategy on five goals essential to making America safer: ending the war in Iraq responsibly; finishing the fight against Al Qaeda and the Taliban; securing all nuclear weapons and materials from terrorists and rogue states; achieving true energy security; and rebuilding our alliances to meet the challenges of the 21st century.
Now is the time for a responsible redeployment of our combat troops that pushes Iraqs leaders toward a political solution, rebuilds our military, and refocuses on Afghanistan and our broader security interests.

B) The Libya campaign was initiated by NATO and pushed for by France.

You don't lose sleep over egregious violations of not only the 8th amendment but international protocols that the US pushed to have created and, at times, have pushed to have enforced and, bottom line, IS THE STATUTORY LAW OF THE US? The US is a signatory to the UN Charter/Treaty and therefore that Treaty is the Supreme Law of the Land as is the NATO Charter. And it was France that pushed for the authorization to use force in the UNSC.
Just because you don't like an action, it doesn't give you license to change the history, facts and circumstances of that action.
