Sept. 8 (Bloomberg) -- The Obama administration’s health- care overhaul was upheld by a U.S. appeals court in Virginia, the second appellate court to find in favor of the government. The decision by the U.S. Court of Appeals in Richmond today came in two separate cases challenging the constitutionality of the law.

Accordingly, we vacate the judgment of the district court and remand with instructions to dismiss the case for lack of subject-matter jurisdiction." The 11th Circuit Court of Appeals (Federal Court) has already ruled the individual mandate unconstitutional, next stop SCOTUS......

In my opinion, 11th CCA is correct. The problem is, the State isn't the one being compelled to purchase the insurance.

AG Cuccinelli tried to take this straight to SCOTUS but that was denied. This and related cases will surely go there but when SCOTUS would act is anybody's guess. Were SCOTUS to uphold the the 4th Circuit finding of a lack of subject matter jurisdiction, it would not hear or decide this case at all.
