A second lawsuit has been filed to obtain documents from the Justice Department regarding its decision not to defend the constitutionality of the Defense of Marriage Act. Judicial Watch has joined with the Family Research Council in filing the lawsuit, based on the Freedom of Information Act, to obtain documents to explain why the decision was made.
"You know, they made this decision, and ... based on the timing of certain court filings [it looks like] it was made in concert with the homosexual activists and those who are seeking to redefine marriage," explains Judicial Watch president Tom Fitton. "... We just want to figure out what's going on."
The Department of Justice has the responsibility to defend laws passed by Congress and signed by the president.
"And our view, generally, is that this Justice Department is an arm of the political left and the activist groups," Fitton continues, "and I suspect the reason we can't get documents about the decision-making and their communications with some of the notorious folks involved in this gay marriage debate means they have something to hide."
In a press release, the JW president goes even further: "Once again the Obama administration is playing politics with the Freedom of Information Act to avoid telling the American people the truth about one of its indefensible positions. The evidence suggests the nation's highest law enforcement is refusing to enforce the law to appease another special interest group."
Fitton believes the decision by the president and attorney general, which he considers to be unprecedented, "could not have been done without the consultation from the well-heeled homosexual activist groups that President Obama was trying to cater to as he prepares for his election in 2012."
