SANTA ANA – A jury Monday found a San Clemente church pastor guilty of molesting a 14-year-old girl and sending her sexual e-mails. Ricardo Avalos Maffey, 44, was convicted of five felony charges of lewd conduct with a child and one felony count of contacting a minor with intent to molest. Maffey, a pastor at the Apostolic Christian Church in San Clemente, faces up to six years in prison at his sentencing on April 15 for kissing and touching the girl on several occasions and sending sexually provocative e-mails to her between May and August 2008. "I am very happy for the victim and her family," Deputy District Attorney Jennifer Walker said after the decision by a jury of four women and eight men in Orange County Superior Court. It took the panel about 4½ hours to reach a verdict. The pastor, who was a "quasi-father figure" to the girl, working closely with her in his office and spending time with her and her siblings at his home, became infatuated with her and was progressing toward a sexual relationship when her mother found out about it, Walker had told jurors. "This case is about a violation of trust and a violation of the law," she said in her opening statement Maffey, who works for the city of Santa Ana and had been out on bail since his arrest, was taken into custody after Judge Thomas N. Goethals listened to arguments from both sides as he weighed whether to release Maffey until sentencing. The mother of the victim and the girl testified during the trial. The Orange County Register does not publish the names of victims of sex crimes. Defense attorney William Hulsy attempted to paint the victim as unbelievable and said that the e-mails had been taken out of context. He said Maffey's conduct admittedly fell below that of a pastor but was not criminal. Maffey met the girl through his role as a pastor and began grooming the victim by spending time alone with her while the victim was volunteering in the church office, prosecutors said. His behavior escalated to kissing the girl on the cheek, then on her closed mouth on at least 10 occasions, trying to insert his tongue into her mouth, rubbing her bare leg under her dress and touching her buttocks over her clothes, Walker told jurors. The victim's mother testified that Maffey's behavior stopped only after she discovered e-mail exchanges between him and her daughter and reported his behavior to church authorities. "I didn't understand how a pastor could be e-mailing a child without a parent's permission," she testified. Goethals said Monday that Maffey exercised "horrendous judgment" but added "I still don't think it is a state prison case." The minimum sentence Maffey faces is up to one year in Orange County jail and formal probation. While Maffey left the San Clemente church in late 2008, for more than two years he has been with another branch of the same church in Santa Ana, attorneys said.
