Tim Adams Signs Affidavit: ”No government official in Hawaii could find a long-form birth certificate for Senator Obama that had been issued by a Hawaii hospital at the time of his birth.”

January 26, 2011

“During the course of my employment, I came to understand that for political reasons, various officials in the government of Hawaii, including then-Governor Linda Lingle and various officials of the Hawaii Department of Health, including Dr. Chiyome Fukino, the director of the Hawaii Department of Health, were making representations that Senator Obama was born in Hawaii, even though no government official in Hawaii could find a long-form birth certificate for Senator Obama that had been issued by a Hawaii hospital at the time of his birth.”

“I was told by senior officers in the City and County of Honolulu Elections Division to stop inquiring about Senator Obama’s Hawaii birth records, even though it was common knowledge among my fellow employees that no Hawaii long-form, hospital-generated birth certificate existed for Senator Obama.”

Adams conveyed to World Net Daily, “I can go get my long-form, hospital-generated birth certificate. And so I don’t understand, this whole controversy should have been settled three or four years ago in about five minutes.”

Adams has stated in the past that he discounts the validity of the “short form” version of the Hawaiian birth record commonly issued to applicants which is called a “Certification of Live Birth”, the same document long attributed as the sole evidence used to proclaim Obama’s eligibility to occupy the White House. Until 2009, the Department of Hawaiian Homelands outright rejected this document as a primary form of identification for confirming native Hawaiian citizenship, let alone American natural born citizenship.

Many officials, including Adams, explicitly have said the short-form Certification of Live Birth is not an authoritative form of documentation proving that Obama was born in Hawaii.

“My basic assumption is that he wasn’t born there,” Adams continued in his interview with Dr. Corsi, “Certifications of Live Birth were given to people who were born at home, or to people who were born overseas and whose parents brought them back to the islands. If his parents were U.S. citizens, or if one parent was a U.S. citizen, as was the case with Obama, the family would apply for a Hawaiian birth certificate when the parents came back from overseas. That’s normally how you would have gotten on [a Certification of Live Birth] in the 1960s.”

the basic fallacy is that they are making a claim that they can't prove. If Stone truly believes Obama was born outside the U.S. then he should be easily able to provide some evidence to back up his claim.

- birth announcements
- citizenship requirement confirmed by 50 states, the electoral college, and the House of Representatives on January 8, 2009

I spent 4 days in jail because a crankster gangster used my license from a stolen wallet in a traffic stop in Washington State. I lost the towing fee and had to pay my lawyer fees for getting proof to Clark County Washington I was working that day Dale Allan Beaty was stopped.

I also was in jail a day five years before that in Eugene for the same ID mis- use and had to clean violations he put on my license off.

I also fought a young man who did not want to get off the phone in the tier because he was talking to a female he was trying to impress. I needed the phone for legal reasons and it was the only way I got him off it.

You ain't the only person who has had shit happen to and I don't call people names because of the race of that particular kid, who was indeed Black.

Because I'm mature enough to care about humanity; something you chose to like only a part of.

Birther Debate Alive Across U.S.

The opening of 2011 state legislative sessions has been accompanied by a spate of birther-related bills, the clearest indication yet that the controversy surrounding President Barack Obama’s place of birth will continue to simmer throughout his reelection campaign.

Lawmakers in at least 10 states have introduced bills requiring presidential candidates to provide some form of proof that they are natural-born citizens, a ballot qualification rule designed to address widespread rumors on the right that Obama was not born in the United States.

The notion that Obama does not meet constitutional qualifications to be president has dogged him since the early stages of the 2008 race, despite his campaign’s posting online his certificate of live birth in the state of Hawaii.

The birther controversy resurfaced in recent weeks when newly elected Hawaii Democratic Gov. Neil Abercrombie, a friend of Obama’s parents, promised to investigate the issue and finally put to rest rumors that he was born in Kenya or Indonesia. Abercrombie later backtracked, citing the state’s privacy laws.

So far, the conservative conspiracy theorists who have pushed national media campaigns and numerous legal challenges questioning the president’s eligibility have met little success.

At the state level, however, the issue continues to fester. This year’s bills, if passed, would create a requirement for presidential campaigns to prove candidates’ place of birth, a proviso that sponsors say would finally clear up the matter.

Election law attorneys say that if the bills are passed, states may be able to kick presidential candidates off the ballot for not complying — though a legal challenge would be very likely.

“The Constitution gives state legislatures plenary power to set the rules for choosing presidential electors. A state legislature, in theory, as Bush v. Gore acknowledges, could even take away the popular vote for the president and decide on the choice itself,” said Rick Hasen, a law professor and author of the respected Election Law blog.

Cleta Mitchell, a conservative election lawyer, made similar comments, arguing that “states have had latitude historically to require filing fees, signatures on petitions and other ministerial procedures — and providing a birth certificate verifying a person’s constitutional qualifications of age and citizenship seems perfectly reasonable.”

The bills vary in terms of how election officials would sign off on the ballot eligibility of presidential candidates, a process that would be triggered by a presidential campaign’s application to get on the primary ballot. Some measures, such as one in Connecticut, would require the secretary of state to view the original birth certificate, while others would require an affidavit providing documentation of a candidate’s name and place of birth.

“We don’t think the president was vetted, and it’s just that simple,” Texas GOP state Rep. Leo Berman said, adding that he doesn’t know whether Obama is “a citizen or not” but that he believes the question has not been fully examined.

“I read different things that say he was born in Hawaii, and then I read the governor can’t find anything that says he was born in Hawaii,” Berman added. “Why the president won’t show a birth certificate is beyond me.”

Berman said that he’s received “the foulest e-mails I have ever seen in my life” since introducing the bill, but contended he has a significant amount of support — if not yet a large number of co-sponsors — within the Texas Legislature.

“My colleagues love it,” he said, adding that his bill will “pass overwhelmingly in the House.” But Berman predicted that Democrats in the state Senate would block the bill from getting the two-thirds majority it needs to pass.

In Oklahoma, Ralph Shortey is one of three Republican state senators who have introduced bills seeking proof of birth from presidential candidates, and, like Berman, said he doesn’t know if the president was born in the country.

“I don’t know one way or the other because I’ve not seen evidence one way or the other,” Shortey said, contending that the bill isn’t necessarily about Obama. “To be honest, I don’t care [if the president is a citizen]. He’s our president, and we elected him, whether he’s qualified or not.”

The Oklahoman said his bill is not so much about the birther argument as it is about the questions that prompted the theory.

“In Oklahoma, we can guarantee at every elected level that the candidate is qualified, except for president,” he said. “We need to ensure that the people on [the] ballot are legitimate candidates. ... If 10 states are taking on this issue, it seems to me that it’s a serious enough issue to have called attention to itself.”

Missouri GOP state Rep. Lyle Rowland framed his own bill as a check against illegal immigration.

“We have problems with illegal immigrants. And if something were to happen where one of them became popular with the people, we need documents proving if they are a citizen,” said Rowland, who believes Obama is a “natural citizen of the United States.”

Hawaii Democrats are working on birther-influenced legislation of their own, designed, at least, to produce some revenue for the state’s trouble with the birthers. A new bill would allow the state’s Department of Health to provide copies of some of the president’s birth records — which the state had stopped doing during the height of birther activity — in return for a $100 fee.

Because many states where the bills have been proposed are only beginning their sessions, the prospects for passage are unclear.

Arizona’s seems the most likely to pick up momentum, as a similar bill was approved last year by its House before failing in the Senate. Both chambers were, and remain, under GOP control. The bill already has enough co-sponsors to pass the House again, and the support of the Republican majority leader in the Senate makes it quite likely that the measure will at least be brought to the floor.

Arizona GOP Gov. Jan Brewer did not take a position on the bill last year and hasn’t done so this year either. Republican state Rep. Judy Burges, who sponsored the bill both times, did not respond to requests for comment.

The bills in each state have been attacked by Democrats, who dismiss the birther movement as a collection of Obama-obsessed wing nuts.

Bill sponsors interviewed by POLITICO said they had not communicated with each other or any national group, though some said they were influenced by news reports on bills in other states.

“I read about it and thought, ‘Why shouldn’t we do this? This sounds like a good idea,’” said Connecticut GOP state Sen. Michael McLachlan.

McLachlan conceded that his bill doesn’t stand much chance of passing the state’s Democratic-controlled Legislature, but said he hasn’t been deterred by opposition.

“The issue just doesn’t want to go away,” he said. “Some people are insistent that President Obama isn’t qualified to run because he wasn’t born in the United States. Why don’t we just put the whole issue to rest?”

As a bicycling advocate agree once again from knowledge of the issue. One can get a ticket for talking on your cell phone, or go to jail for drunk driving on a bicycle. If you ride on some highways where bikes are banned you are going to get a huge ticket.

This privilege aspect of conveyance is very firmly ensconced into transportation law. I have never seen anyone get anywhere trying to argue in court otherwise. Good luck trying, but unfortunately, you will get nowhere with that angle of attack on the issue.

Third Hawaiian Official Denies Existence of Birth Certificate

In August of 2008, the former Democrat Party of Hawaii’s chairman, Brian Schatz, who now serves as Hawaii’s lieutenant governor, then refused to certify Obama’s constitutional eligibility for submission to the Hawaiian Elections Office for inclusion on the 2008 Hawaiian presidential ballot because he was either not able to locate originally documented proof that Obama is constitutionally eligible to serve as president, or he was provided with an original record of Obama’s birth which confirmatively proves he is not eligible to be president.

If Obama’s records actually existed within the state of Hawaii, Schatz, as the head of the Democrat party’s authority in Hawaii and personal supporter of Obama, would have requested access to them. The "Identity Protection Law", HRS 338-18, often cited by Hawaiian officials as justification for denying access to Obama's records would not apply in a request from Schatz because the law states that a request for someone's vital records must be for tangible reasons. It was Schatz' duty to vet Obama's elibility for the office of the presidency. This is a "tangible reason". Therefore, the Hawaiian Department of Health would have released Obama's birth records to Schatz if they existed. The fact that Schatz refused to certify Obama's eligibility proves the records do not exist. . Using the information in any original records, Schatz would have assessed Obama’s constitutional eligibility and, therefore, if upon confirming that Obama was a Natural-born citizen, would have authorized an Official Certification of Nomination (OCON) which would have included the explicit language required by HRS 11-113(c)(1)(B) thereby enabling the Hawaiian Chief Elections Officer, Kevin Cronin, to approve Obama’s placement on the Hawaiian ballot. However, Schatz did not do this.

Then, scandalously, one day after Schatz filed the DPH’s non-certification, the Democrat National Committee (DNC), chaired by Nancy Pelosi, issued a fraudulent Certification stating that Obama was constitutionally eligible to serve as president, even though the DNC had no original documented evidence to support such a claim.

On January 20th, 2010, Adams signed a sworn affidavit which reasserts testimony he gave in an interview with WLRM radio’s James Edwards, in early June of 2010, when he first publicly said that the state of Hawaii does not possess an original “long-form”, 1961 Certificate of Live Birth on file for Barack Obama, and therefore, Obama could not possibly have been born in the state of Hawaii. In the interview, Adams said, “There is no birth certificate – it’s like an open secret. There just isn’t one. Everyone in the government in Hawaii knows this.”

Adams managed the Absentee Ballot Office of the Honolulu County and City Elections Office. He served as the Senior Elections Supervising Clerk during the 2008 election and had access to vital records in his primary duty of verifying voters’ identities. Overseeing approximately 45 workers, it was his job to confirm the personal information of voters in collaboration with absentee balloting.

While serving in the Honolulu office of elections, Adams also checked with both major medical facilities in the city, Kapi’olani Medical Center and Queens Medical Center and was told by administrators of both hospitals that they possessed no medically verified record of Obama’s birth in their facilities, including any birth certificate signed by a doctor or hospital administrator.

Even to this date, no hospital in Hawaii, nor any agency within the government of the State of Hawaii has ever verified or confirmed possession of any original records documenting Obama’s 1961 birth there.

The Hawaiian Democratic Party refused to sign off on a certification that Barak Hussein 0bama II was eligible to be president. Instead, Nancy Pelosi herself signed that Hawaiian certification. The possible reason: the attorney who approved all legal paperwork that required signatures by the HDP just happened to be the same attorney who handled 0bama’s mother's divorce from her Indonesian husband. That attorney had seen 0bama’s original long form birth certificate.

This also means Pelosi committed fraud by certifying 0bama’s eligibility.

The proper legal text used on the DNC Party "Official Certification of Nomination" document (below) reads as follows;

"THIS IS TO CERTIFY that at the National Convention of the Democrat Party of the United States of America, held in Denver, Colorado on August 25 though 28, 2008, the following were duly nominated as candidates of said Party for President and Vice President of the United States respectively and that the following candidates for President and Vice President of the United States are legally qualified to serve under the provisions of the United States Constitution."

The document is signed by Chair of the DNC Convention and Speaker of the House Nancy Pelosi, DNC Secretary Alice Travis Germond and Colorado Notary of Public Shalifa A. Williamson. It is dated August 28, 2008.

However, this document was never delivered to a single state DNC Office for state certification, and it was therefore, never presented to any state Election Commission as certification of Obama and Biden.

Instead, a very similar (bogus)document (below) was delivered to fifty state DNC offices, that those offices certified to each of fifty state Election Commissions, who then date-stamped the document and stuck it in a file cabinet, and proceeded to place these "certified" candidates on the ballot.

This is the legal certification text on the DNC certified nomination document used for the DNC ticket:

"THIS IS TO CERTIFY that at the National Convention of the Democrat Party of the United States of America, held in Denver, Colorado on August 25 though 28, 2008, the following were duly nominated as candidates of said Party for President and Vice President of the United States respectively."

The reference to Obama’s constitutional eligibility is missing. It had been removed from the document sent to the states.

The bogus version is in the Election Commission files of all fifty state Election Commission offices, and state DNC headquarters, complete with date stamps, matching signatures, even the same Notary of Public authentication.

Over the past few weeks, a Kentucky resident and teacher named Timothy Adams has made the rounds online and on talk radio with an extraordinary claim -- he was the "senior elections clerk" for Honolulu in 2008, where it was an open secret that the city and state had no proof of Barack Obama's citizenship. As he told WorldNetDaily, the racing form for birtherism:

I had direct access to the Social Security database, the national crime computer, state driver's license information, international passport information, basically just about anything you can imagine to get someone's identity. I could look up what bank your home mortgage was in. I was informed by my boss that we did not have a birth record [for Barack Obama].

I checked with Glen Takahashi, the administrator of the Honolulu City Clerk's office, and while he verified that Adams worked there, he explained – gently making it clear he did not want to "call anyone a liar" -- that Adams never actually had access to information about Barack Obama.

"Our office does not have access to birth records," Takahashi said. "That's handled by the state of Hawaii Department of Health. Where he's getting that, I don't know. Put it this way: Barack Obama was not trying to register to vote in Hawaii. He is, as far as I know, not a registered voter here. So no one was looking that up."

Takahashi explained that the "senior elections clerk" job that Adams held was a low-level data entry position dealing with voter registration and absentee ballots -- Adams was one of dozens of temporary employees who staffed the pre-election rush. And he contradicted Adams's claims that Obama's lack of a birth certificate was an "open secret" or that voters contacted the office to ask about it.

"To be honest, I fielded no questions about that," Takahashi said. "Why would anyone ask us? We don't have those records."

The internal contradictions of Adams's story haven't stopped him from expanding his media presence this week, most recently with a local TV interview in which he repeated his claims (some of them based on popular "birther" rumors from the Web) while, confusingly, stating that he didn't think Obama's eligibility was an issue.

Why the crap website WND has any credibility is beyond me, but then there are still people who believe what they see on Fox News.

"I had a secretary, private office, two assistants and about 50 temp workers under me."

He (Adams) also notes he had access to numerous government databases, including police, Social Security, driver's license bureau and voter's registration, not to mention "unfettered Internet access , something else the workers didn't possess."

During the summer of 2008, there were conflicting reports Obama had been born at the Queen's Medical Center in Honolulu, as well as the Kapi'olani Medical Center for Women & Children, also located in the capital city. So Adams says his office checked with both facilities.

"They told us, 'We don't have a birth certificate for him,'" he said. "They told my supervisor, either by phone or by e-mail, neither one has a document that a doctor signed off on saying they were present at this man's birth."

"In my professional opinion, [Obama] definitely was not born in Hawaii. I can say without a shadow of a doubt that he was not born in Hawaii because there is no legal record of him being born there. If someone called and asked about it, I could not tell them that person was born in the state."

To date, no Hawaiian hospital has provided documented confirmation that Obama was born at its facility.
