It's unconstitutional to force people to buy coverage, which is hurting shares of the insurers like UnitedHealth Group Inc. (NYSE: UNH) and WellPoint, Inc. (NYSE: WLP). The insurance companies initially spiked on the news, but just as fast as the spike happened, shares are coming back down just as fast. This would mean less business for these insurance companies, so potential profits will be hit. Congress has exceeded its power said Judge Hudson, the ruling judge in the case. To: All (#0) (Edited) I've argued for a while that the individual mandate is indeed unconstitutional, but without it the requirements to cover pre-existing conditions are unworkable. And, the insurance companies want, and have lobbied for, the mandate. Next stop: USSC. Judd Gregg (R-N.H.), who once had been a part of the repeal-and-replace brigade, provoked the wrath of conservative pundits shortly before the midterm elections when he said, in a moment of unguarded candor, that repealing the law was not realistic. You can be certain that insurance-industry lobbyists will be helping their newly expanded congressional caucus determine what needs retooling.
