Saying that "broadband rationing is now the order of the day," Bernstein Research senior analyst Craig Moffett says that the FCC's just-circulated order on codifying and expanding network neutrality guidelines "specifically and expressly endorses usage-based pricing for broadband."

The item was circulated at around midnight Tuesday, just beating a customary deadline of three weeks before a public meeting, in this case the Dec. 21 meeting.

Moffett says that will be a big boost to cable operators, who should be able to boost penetration with lower-priced tiers, and help address the cord-cutting issue by migrating video customers to broadband, or discouraging cord-cutting altogether as broadband prices rose to offset the decline in video revenues.

"The tacit endorsement of UBP is, in our view, the biggest news of the day, and must be viewed as very positive for terrestrial broadband operators," Moffett said. "We would expect the introduction of UBP plans from major cable MSOs to follow in short order, and we would expect that their stocks will respond well to such introductions."

The National Cable & Telecommunications Association is said to support the chairman's proposal, though it would prefer no new rules.

with the GOP taking control of the house, the idea of net neutrality is now dead. Internet providers will be free to set usage-based rates, restrict or charge extra or competitive content on their networks (e.g. Netflix), and take whatever approaches best help their bottom line. In effect, the Internet will evolve into the cell phone network model - walled gardens, restricted access to apps/content, and tiered pricing models with usage caps.

Good news for investors. Crappy news for those who live in areas where there is little choice among competiting Internet service providers.

Wait a minute.

You can't compare land line internet and cellular.

The entire internet is based on the same single underlying technology -- the IP protocol. On the other hand, the cell phone market has competing technologies. Second generation cellphones (the first digital phones) had CDMA versus GSM. Third generation had UTMS versus W-CDMA. Forth generation will have WinMax versus LTE.

Companies have changed horses at each generation. For example, AT&T (GSM) and Verizon (W-CDMA) are moving to LTE, while Sprint (W-CDMA) is moving to WiMax. T- Mobile hasn't made a decision, but I'll bet they will move to LTE because that's what their parent company in Germany is doing.

Yes, cell companies do offer subsidized phones with lock-in contacts. You don't have to do this. You can can buy unsubsidized phones that will work on any network using the same technology. I'm in the software services business and a large part of my work involves mobile applications. So, I'm always buying the latest phones on the "grey market" to keep up.

Yes, some phone manufacturers (actually one Phone manufacturer named Apple) won't let you "unlock" the phone and use it on another network. This is a characteristic of Apple's draconian culture. I can give you many more examples of Apple's dictatorial culture.

Insofar as land line carriers are concerned, they are granted monopolies by local government. So, local governments should specify in their RFPs what the land line carrier must and must not do. If Comcast or AT&T or anyone else doesn't like it, they don't have to bid to get the local internet monopoly.

my point is that service providers wish to move to a walled garden model, we're now heading in that direction.

For example, expect to see "Want NetFlix when Comcast has their own streaming video service? - sorry, it will cost you $10 extra a month" or Comcast will simply slow NetFlix traffic down so the service is unusable.

The Internet itself is going to fracture in the next few years thanks to IPv6 and carrier-grade NAT. The smart end-point dumb core model is dead. Just my .02c.
