TSA Sued Over Naked Body Scanner Privacy Violation

(November 12, 2010) The Electronic Privacy Information Center (EPIC) is proceeding with a lawsuit against the TSA over its use of naked body scanners. Filed in the District of Columbia Court of Appeals, EPIC's lawsuit asks for the courts to halt the US government's use of naked body scanners altogether.

EPIC has brought claims under the Administrative Procedure Act, the Privacy Act, the Video Voyeurism Prevention Act, the Religious Freedom Restoration Act, and the Fourth Amendment.

(The TSA's naked body scanners and aggressive pat-down techniques violate all these federal laws and Constitutional protections.)

That effort has now been joined by consumer advocate Ralph Nader, who agrees that the TSA's use of naked body scanners must be challenged.

EPIC's lawsuit against the TSA alleges that the intrusive pat-downs are used by the TSA as a retaliatory punishment for those passengers who choose to opt out of the body scanners.

The EPIC lawsuit also submits that the capture of naked body scanner images is itself a violation of federal law.

Furthermore, there is concern that once those images are captured, they could be swapped by TSA employees because the naked body scanner machines are built with image capture and storage capabilities in addition to Ethernet networking.

At the same time, the pilots union Allied Pilots Association has urged all pilots to reject the naked body scanners and request to opt out, citing health hazards from radiation exposure as well as an assault on the dignity of airline pilots.

Libertarian party endorses EPIC lawsuit against TSA

The Libertarian Party has now officially backed this lawsuit against the TSA. Libertarian Party Chair Mark Hinkle said, "The TSA should end the strip-search machine program immediately. We've reached a point where our government has no qualms about humiliating us. We encourage Americans to call their newly-elected members of Congress and tell them that they don't want this expensive, worthless, intrusive, unconstitutional program."

The Fourth Amendment to the U.S. Constitution says... "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

What part of "unreasonable searches and seizures" does the TSA not understand?

As long as these TSA violations of our Constitutional rights continue, I urge you to avoid traveling by air altogether.

How many have been killed by hijackers since 911?

The citizens of Mexico are not permitted to be armed, but 31,000+ have been murdered since 2006....I'll put my trust, and safey, in the hands of everyday American passengers before I would some glorified pedophile man handling women and children, and if my numbers up, then it's up, but I'll go out on my feet, not on my knees, bent over for the TSA~

The TSA has been completely reactive. Someone puts a bomb in their shoes, so now we have to take our shoes off. Someone puts a bomb in his underwear, so now we are subject to x-rays or genital groping.

X-rays and groping won't find a bomb stuffed up your rectum or vagina. At some point, someone will place a bomb there. Be prepared for full cavity searches to board an airplane.

Same mindset anyone in the security industry encounters, Murron. You sucessfully protect the facility...home...business...or person...and eventually its 'why do we need you, nothing's happened!'

Its frustrating, you do the job, then you are asked to defend being paid because it appears there is no threat. So the company, or the person, drops the security.

Guess what happens eventually? Yep, they get attacked, or robbed, or burglarized...or hijacked and flown into a large building killing thousands.

Yeah, it's my mindset, and I'll keep it as long as I can still believe I live in a free nation.

I thought you were a fighter, not a quitter, you give the terrorist, and this overbearing government exactly what they want, complete control over every aspect of your life, do you actually believe their intrusion into our lives will stop at body scans and pat downs at the airports?

How far you willing to let these thugs go to secure your security? Forgive me, but are you really that naive enough to give away your human dignity and your privacy for some total BS sense of security?

Again, they confiscate piles of weapons every single day. That isn't 'BS' its fact.

Second, as I noted on one of these threads, I like my odds dealing with an unarmed hijacker type.

Finally, nobody can take my dignity away from me. Its mine, alone.

If they were not finding hundreds of weapons EACH DAY at every major airport, I'd feel more like you and jw and a few others do on this topic.

But they ARE finding hundreds of weapons each day, at every airport in the nation.

Show the weapons, or links to these weapons confiscated, surely there must be stories about them. Now tell us, were there arrests made, who are these people that dare come to the airports with all these weapons? Were they middle eastern terrorist, were they American terrorist, where did they come from, where where were they going? I must have missed these stories!

If what you say is true, then that should be the story everyone is talking about, and those who were caught with these weapons should be subjected to all this humiliation...not innocent passengers and their children.

What I'm telling you is 100% fact. I have no reason to lie about it. I've seen the 'daily take' at CVG, Atlanta, Vega, LA, NOLA, Orlando over the past few years due to my relationships within ASIS International.

As for why they don't highlight this...they think it will further undermine the public's confidence about airtravel safety.

I personally, and professionally, feel 'they' are making a HUGE MISTAKE in this regard. I'll also say I suspect - don't know this for sure like the above - that given the growing amount of attention, TSA is rethinking not making public what they find DAILY.
