After several rough weeks on the campaign trail, a new poll out of Alaska shows Republican Joe Miller has fallen to last place in the three-way Senate race.

A Hays Research Group poll released Thursday showed write-in candidates, presumably meaning Sen. Lisa Murkowski, in the lead with 34 percent, Democrat Scott McAdams with 29 percent and Miller with 23 percent. Murkowski is waging a write-in bid since losing the Republican primary to Miller.

Miller's plunge in the new poll comes on the heels of several misfires in the local and national press. Most recently, Miller's employment records from his job as a part-time attorney with local government were unsealed Tuesday, in which he admitted to using company computers for political purposes and then lying about it.

Miller had a high 68 percent unfavorable rating in the independent poll, which was taken Oct. 25-26. The poll appeared to ask the opinion of 500 respondents — not registered or likely voters, like most political polls. The poll appeared first on the local liberal blog The Mudflats.

But poll numbers aren't the only indicator that Miller could be in trouble. The National Republican Senatorial Committee has started running advertisements in Alaska, purchasing almost $564,000 in independent expenditures on Miller's behalf. The most recent advertisement paid for by the NRSC was a negative spot hitting McAdams that debuted earlier this week — a sign that the committee likely sees the Democrat, and not just Murkowski, as competition.

Until the Hays Research Poll was released, almost every public poll of the race since the Aug. 24 primary had shown Miller in the lead, with either Murkowski tied with or trialing him, and McAdams several points behind both candidates. Subscribe to *Tea Party On Parade*

Alaska Ruling Allows Write-In Lists

n a major boost to Sen. Lisa Murkowski’s campaign, the Alaska Supreme Court temporarily overturned a lower court's order late Wednesday, ruling to allow a list of write-in candidates at polling places.

The high court ruled just hours after attorneys for the state Division of Elections petitioned for a review of Anchorage Superior Court Judge Frank A. Pfiffner’s ruling earlier in the day barring the lists.

The Supreme Court ruled that the list of registered write-in candidates made available to voters must be limited to names only, with no party affiliations or other information. Voters must request the list, the court ruled.

Besides issuing the emergency stay, the high court said it would expedite a state petition for review of the lower court ruling, requiring responses from the Democratic and Republican parties by Thursday afternoon. The Supreme Court ordered that all ballots cast by voters who were given a list of write-in candidates should be separated from other ballots until a final ruling is issued.

Earlier in the day, Pffifner ordered the state Division of Elections to stop distributing lists of write-in candidate names because doing so constituted a “clear violation” of an existing state regulation.

The initial ruling was a major blow to Murkowski, who entered the race as a write-in candidate after losing the Republican Senate primary to attorney Joe Miller. Polls show the race between her, Miller and Democrat Scott McAdams to be very tight.

In Pfiffner’s initial ruling, which the court halted, the judge wrote: “The actions of the Division are in a clear violation of an Alaska administrative regulation. The court hereby grants a temporary restraining order enjoining the Division for allowing election workers and polling place workers to post write-in candidate names, to provide a list of write-in candidate names to voters, or to provide verbally the names of write-in candidates to voters at any place within 200 feet of a polling place for the November 2010 general election.”

Although the state Division of Elections had not printed lists of write-in candidates in previous elections, an attorney for the division argued there were “more voters than usual requesting assistance with write-in voting” because of Murkowski’s high-profile candidacy. In its own legal brief, the state Division of Elections argued that they were fulfilling their “statutorily mandated” obligations to assist voters at the polls.

The state Republican and Democratic parties joined forces earlier this week to protest the Alaska Division of Elections, which had been printing sheets with write-in candidate names and already posted one list at an early-voting location in Homer, Alaska.

The Alaska Democratic Party filed a suit Monday seeking a temporary restraining order, arguing that a list of write-in candidates would violate a state law prohibiting any campaign materials within 200 feet of a polling location.

“We have a law on the books that says you can’t have a list or post the names of write-in candidates in the polling area, and then they turn around and say there’s a law to that says they have to assist voters, and that preempts their regulation that they’ve had on the books for 10 years,” said state Democratic Party Chairwoman Patti Higgins.

Soon after the Democratic Party filed suit, the state Republican Party signed on as well. State Republican Party Chairman Randy Ruedrich said that if the state Division of Elections wanted to print a list of write-in candidates, it would have to go through the process of changing its regulations.

“The state Division of Elections’ regulations clearly prohibits having any campaign identifying materials within 200 feet of the voting place,” said Ruedrich. “The Division of Elections has, without modifying its regulations, left that regulation in place, and has taken to publish a list of write-ins. That has never been done.”

LOL!! You have to be right about that. I have had occasion to talk to several dozen Alaskans about the race and not a single one said they would prefer Murkowski over Miller.
