Lynne Stewart, the activist lawyer, was recently sentenced to 10 years in prison.

This outstanding lawyer, a 70 year old grandmother, who is facing the serious threat of breast cancer, was originally sentenced to 2 years and 4 months, but the federal appeals court apparently felt that wasn’t enough.

The same appeals courts that traditionally reverse the convictions of cops who torture or kill Black citizens, and who traditionally rely on the judgments of the trial courts, reversed Stewart’s sentence as not tough enough.

So much for judicial tradition.

For Lynne’s tradition wasn’t that of the tony, tie and tails law firms of downtown Manhattan. She didn’t represent the rich, the powerful, the well-heeled.

She represented the poor, the oppressed, the destitute and the dispossessed; the Black, the Latino, the Arab, the damned; those whom Frantz Fanon famously called “the wretched of the earth.”

A juxtaposition: Many, many lawyers on the Office of Legal Counsel, in the White House, the CIA, and the Defense Dept. violated criminal laws, the military legal code, the Geneva Conventions, and the Convention Against Torture (CAT) [not to mention the U.S. Constitution!] to aid and abet violations of law—for years.

Guess how many of them faced trial? Guess how many of them will in future?

How many of them will ever face prison?

None, None—and none.

For their crimes were on behalf of the powerful; the state; hence their immunity.

Or consider what is known in international law as the “supreme crime”: wars of aggression.

Iraq will be a basket case for generations, thanks to American arrogance and greed.

Will anybody be brought to book for this crime, that shattered a nation, that sent millions into exile, and killed perhaps a million men, women and children?

Don’t hold your breath.

There are still black sites, secret prisons, where tortures happen daily. There is still extraordinary renditions—clear violations of the Convention Against Torture (CAT).

But politicians are doing it—not to “protect” the nation—but to secure elections. Torture for votes.

And a 70 year old grandmother, a lawyer, is sent to prison for 10 years—for violating a prison rule that is an unconstitutional relic of the so-called war on terror.

This is what an empire in decline looks like.

The Supreme Court is going to review the penalty aspect of his case in November.

There has been much in the way of new information and evidence showing he is innocent. Confessions from the real killer who tells why he and another man killed Officer Faulkner, and the most reasonable thing to do would be to re-try the case.

He was an activist very unpopular with Philly PD, and much evidence people were bullied and threatened by the police to not testify revealing someone killed Faulkner before Mumia came upon the scene.

I would be more then happy to go over what I know on this case with anyone. I believe is is innocent, and should be completely exonerated for the crime he was falsely convicted of.

He's been through the system multiple times on this. He's appealed, and been denied repeatedly. I've seen the reports, watched the celebrity supporters like Mike Ferrell talk about it for decades now.

Years ago I watched Mike Ferrell (actor from MASH) on a show, and he called asserted the eye witness was wrong.

The problem for Ferrell was the 'eye witness' was on the program as well, and made him look quite insane.

Here's a guy who used his celebrity to get involved in this case, who was 3,000 miles away from the scene of the crime...telling the eye witness to her face 'you were mistaken'.

Its insane.

Except there has indeed been a large amount of eye witness testimony that some one else wearing a green coat completely different then what Mumia was wearing did the crime.

And there has been a confession by a man claiming he did it, not Mumia.

And there is a great deal of evidence that the police suppressed much of the eye witness evidence with coercion and threats.

No Badeye, he did not do the shooting. And the police went to a lot of trouble to shoot and beat him to try to off him in retaliation for his work as an activist. They actually had hoped he would die so there would not be a legal lynching of a trial. Which in Philadelphia of that era should surprise no one.

Arnold Beverly on 8 Jun 1999 signed a sworn confession of witness that he, Beverly, had shot and killed police officer Daniel Faulkner, and that "Jamal had nothing to do with the shooting."

Beverly confessed that he and another man were hired to kill Officer Faulkner, that organized crime leaders and police officers were involved in the plan to kill Faulkner, and that police officers were present at the shooting. Co- counsel Daniel Williams agreed with him and was complicit in the suppression of this evidence.

Rachel H. Wolkenstein signed a sworn deposition she resigned from Jamal's defense team because lead counsel Leonard Weinglass refused to submit this exculpatory evidence at the initial Petition for Post-Conviction Relief of Mumia Abul-Jamal in Pennsylvania state courts.

Beverly's confession does not stand alone but is supported by a wealth of evidence in the record.

This confession helped to lay bare the extent and consciousness of police and procecutorial misconduct in prosecuting and convicting this man for a crime he did not commit.

Now, if you and Badeye are so sure and know so much on the case, let's hear a coherent argument debunking the overwhelming evidence that Mumia is innocent and should be freed.

I am against capital Punishment, 'frying' the innocent, and I would never kill any cop unless he or she was wrongfully trying to kill me unjustly and I could not avoid doing so.

I do not like gratuitously attacking cops merely for doing a difficult job. In fact my niece is a police officer, and I have several friends on the Eugene, OR police force I would not take kindly to if anyone attacked.

I would also come to the aid of a police officer being attacked and in danger of being hurt or dying as I would for anyone. I generally loathe violence, but I don't turn the other cheek to those situations at all.

I was trained to the point in the Army I would act instinctively and default to helping without hesitation. I know because I've experienced the conditioning to not lose what advantage I have in those situation, and I think only old age would possibly change this personal paradigm.

And I am not a Hippie, dude. No doubt being a Eugenean I am highly influenced by that sub-culture; but I am not that laid back and structureless in my life.

But thanks for sharing. Hey, I give it to you that at least your post was entertaining. Which really stood out next to that one from the insane hairball who posted just before you.

Yeah, I haven't been spinning that issue - which isn't the header topic anyway, and he merely wrote the piece. I just respond as others bring the Mumia issue up.

This is not the sort of forum with that level of interest in open debate on the case where I would look to do a structured run through like I would have on say Time.Com/Politics which was more an open forum with a more balanced mix of viewpoints on the issues and politics.

No problem Badeye, I definitely don't agree with you on many things. But respecting your disinterest in an exchange on any topic is not a problem. Hope your weekend is a good one.

The cult of Mumia is reacting accordingly–by trying to bully and intimidate Mrs. Faulkner. Mumia has received decades of slobbering press coverage worldwide. God forbid his victim’s family and supporters receive a fraction of airtime. The NYPost reports:

Supporters of cop killer Mumia Abu-Jamal are threatening to storm the streets of Rockefeller Center Thursday morning to protest the “Today” show. The New York-based “Free Mumia Abu-Jamal Coalition” is infuriated that Maureen Faulker – the widow of Philadelphia police office Daniel Faulker, whom Abu-Jamal was convicted of murdering 25 years ago – is scheduled to appear on the show Thursday to promote her new book, “Murdered by Mumia: A Life Sentence of Pain, Loss and Injustice.” The activists – who claim on their Web site to have demanded “equal time” but “as of yet have gotten no agreement to that” -will protest outside. Faulkner told Page Six via a statement, “After 26 years of this harrowing experience, the purpose of writing this book is to finally find a peaceful closure to my husband’s tragic ending. A jury of 12 convicted Mumia Abu-Jamal of murdering my husband, and for 25 years Abu- Jamal has been on death row acting as if he was a Hollywood superstar or political prisoner . . . He has a voice, and my late husband doesn’t.”

The International Concerned Family and Friends of Mumia Abu-Jamal (FreeMumia.com), Journalists for Mumia (Abu-Jamal-News.com), and Educators for Mumia (EmajOnline.com) have initiated a media-activist campaign urging people to write The Today Show at today@msnbc.com asking them to fairly present both sides of the Mumia Abu-Jamal / Daniel Faulkner case, by also featuring as guests, Linn Washington, Jr. (Philadelphia Tribune columnist and Associate Professor of Journalism at Temple University) and Dr. Suzanne Ross (Clinical Psychologist and Co-Chair of the Free Mumia Abu-Jamal Coalition, NYC).

Please take a minute and contact them to ensure fair media coverage of this controversial and important case.
