This afternoon U.S. District Judge Vaughn Walker ruled in the case brought before him by lawyers Ted Olson and David Boies, which argued that the Proposition 8 ballot initiative denying marriage rights to same-sex couples in California was unconstitutional. In a decision just handed down to lawyers for both sides, Walker ruled that Proposition 8 is "unconstitutional under both the due process and equal protection clauses." The court, therefore, "orders entry of judgment permanently enjoining its enforcement." We're staying tuned for more updates and details on the 136-page decision, but these two sentences from the conclusion are critical:
That's what history sounds like. Of course, before the ruling was released, lawyers for the opposing side filed a motion to stay his ruling pending an appeal to the 9th Circuit Court of Appeals.

Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.

Who appointed Judge Walker?
Walker was appointed to the federal bench by Ronald Reagan in 1987, and promoted by George H.W. Bush to sit on the U.S. District Court for the Northern District of California in 1989.
Controversial cases
Aside from the Prop 8 case, Walker is currently presiding over a case regarding the U.S. Government's warrantless wiretapping of U.S. citizens during the presidency of George W. Bush.
Is Judge Walker gay?
As reported in the San Francisco Chronicle, Walker is homosexual. The Prop. 8 case was assigned to him, and most observers say his sexual orientation did not factor in to his decision.
"He has a private life and he doesn't conceal it, but doesn't think it is relevant to his decision in any case, and he doesn't bring it to bear in any decisions," a judge who wished to remain anonymous told the Chronicle.
As a lawyer, Walker represented the U.S. Olympic Committee in a suit seeking to prohibit a group from using the term "Gay Olympics."
What is Walker's political persuasion?
Walker is known as a judge who prizes personal privacy. As the Bay Citizen reported, he is said to hold political views that put him slightly right of center. and Wired magazine has termed him a libertarian.

Walker is considered to be a fiercely independent judge. "I think he's fearless," Judge Charles Breyer, one of Walker's colleagues on the federal bench told Bay Citizen. "I think that he decides cases based on what he thinks is right rather than what somebody else might think is right."
