Ousted USDA employee Shirley Sherrod says she will sue conservative blogger over edited video Ousted Agriculture Department employee Shirley Sherrod said Thursday she will sue a conservative blogger who posted an edited video of her making racially tinged remarks last week. Sherrod made the announcement in San Diego at the National Association of Black Journalists annual convention. The edited video posted by Andrew Breitbart led Agriculture Secretary Tom Vilsack to ask her to resign, a decision he reconsidered after seeing the entire video of her March speech to a local NAACP group. In the full speech, Sherrod spoke of racial reconciliation and lessons she learned after initially hesitating to help a white farmer save his home. Vilsack and President Barack Obama later called Sherrod to apologize for her hasty ouster. Vilsack has offered her a new job at the department, which she is still considering. Obama said Thursday morning on ABC's daytime talk show "The View" that the incident shows racial tensions still exist in America. "There are still inequalities out there. There's still discrimination out there," Obama said. "But we've made progress." Obama pinned much of the blame for the incident on a media culture that he said seeks out conflict and doesn't always get the facts right. But he added, "A lot of people overreacted, including people in my administration."

This is good news.Breitbart is claiming he didn't edit the video,and nobody is paying any attention to his claims. This way we get to find out in court if he is lying,and if he isn't,we will find out which Dim and which Dim organization is responsible for planting the doctored footage with him.

I agree. Sunshine on this issue is a good thing. One troubling thing I heard Bitemark claim on Savage a couple of days ago was that he received the video in edited form because the entire 45 mins of the event was to large to send to him in unedited form. Bullshit I say. A 45 min video should top out at somewhere around 1 gig.

I know he is young,but you would think he would be clever enough to not accept a edited tape from someone he doesn't know and put his own reputation on the line by publishing it as accurate. Who cares if he did edit it. It is not against the law the edit a video and distribute it. If it was then every news organization except CSpan should be sued. There is more of a case against war then Breitbart.

It is the text that introduces the edited tape stating that Sherrod committed a crime that is problematic.
I not only watched the video,I watched a video of the white farmer saying she is responsible for him saving his farm and that she did everything she could do to help him. BTW,it is NOT against the law to be a racist,regardless of what race you are. Which is a good thing,but we are all racists at one level or another. It is a perfectly natural human reaction. What is illegal and unethical is allowing your private thoughts to influence your public actions if you are a government employee. Individuals can be as racist as they want to be for any reason or for no reason at all. Government isn't allowed this freedom because they are supposed to represent all of us equally.

In 1997, 400 African American farmers sued the USDA, alleging discrimination in subsidy policy, and a range of other areas over the preceding 15 years. In the resulting court case, Pigford v. Glickman, the USDA agreed to pay $50,000 to each farmer. By then, the suit had become a class action, and USDA expected to have to pay roughly 2,000 farmers. 22,505 joined the suit. Two years later, the USDA agreed to pay 16,000 of those farmers the agreed-upon $50,000 in compensation - just over $1 billion in total. But according to the USDA, a full 70,000 additional farmers claimed that they had submitted petitions for damages, but that those petitions were received late due to bureaucratic incompetence or poor legal representation. The matter remained unresolved until 2008, when Sens. Chuck Grassley, R-Iowa, and Barack Obama, D-Ill., teamed up to earmark $1.25 billion in that years farm bill to pay the outstanding claims. Members of the Congressional Black Caucus are outraged, claiming that "if the administration can find $1.5 billion within its administrative funds to pay mostly white farmers in Arkansas and other states, it should be able to pay black farmers who suffered discrimination." As for Sherrod's role in the case, the farm cooperative owned by her and her husband was awarded a $13 million settlement last year, shortly before she was appointed to her post at the USDA. In addition, each of the Sherrods was paid over $150,000 for their "pain and suffering" - more than triple what was given to any other farmer, total. All of these facts point to some sketchy practices at the USDA. Those practices, it seems, only came to light due to increased public attention given Sherrod and the USDA. Still, the mainstream media is fixated on the more sensationalist aspects of the story. It should turn its attention towards what could be a serious case of political malfeasance. As San Francisco Chronicle columnist Willie Brown wrote on Sunday, "you don't fire someone without at least hearing their side of the story unless you want them gone in the first place." Editing the tape (any tape) isn't illegal. However,it is illegal to edit a tape in a manner that the makes it seem like the person in the tape committed a crime when the truth is they didn't.

Not only did he edit it, he misrepresented WHEN she made the remarks. He represented that the remarks were made about an event that occurred WHILE she worked for USDA. As a result of his act, she suffered a material loss of employment which would be a tort of defamation.

Sherrod's words are her own words though, aren't they? If she's abusing her office, any indictment of a "crime" is up to an investigation by the DoJ. The corrections center around the printed comments that preceed and follow the video, not the speech of Ms. Sherrod. Breitbart apparently felt the need to correct the record on the printed comments in the video, which is an acknowlegement of some level of repsonsibility for them.
