Ousted USDA employee Shirley Sherrod says she will sue conservative blogger over edited video Ousted Agriculture Department employee Shirley Sherrod said Thursday she will sue a conservative blogger who posted an edited video of her making racially tinged remarks last week. Sherrod made the announcement in San Diego at the National Association of Black Journalists annual convention. The edited video posted by Andrew Breitbart led Agriculture Secretary Tom Vilsack to ask her to resign, a decision he reconsidered after seeing the entire video of her March speech to a local NAACP group. In the full speech, Sherrod spoke of racial reconciliation and lessons she learned after initially hesitating to help a white farmer save his home. Vilsack and President Barack Obama later called Sherrod to apologize for her hasty ouster. Vilsack has offered her a new job at the department, which she is still considering. Obama said Thursday morning on ABC's daytime talk show "The View" that the incident shows racial tensions still exist in America. "There are still inequalities out there. There's still discrimination out there," Obama said. "But we've made progress." Obama pinned much of the blame for the incident on a media culture that he said seeks out conflict and doesn't always get the facts right. But he added, "A lot of people overreacted, including people in my administration."

Even if he can,he may be liable for slander for publishing it as her words and actions without first checking to see if it were true. Don't see it that way at all. Tapes are released of ALL public figures ALL the time without threat of suits. That's whether it's in OR out of "context." Sherrod's an uppity lawsuit freak and professional extortionist who deserves getting a PR pounding even more. She is also a nasty racist; We may all be "racists," by NOT while working for gubmint.
It'd have to be proven Breitbart's tape was "malicious." Not even F. Lee Bailey could prove that. She is afterall a public figure in any case.
Editing the tape (any tape) isn't illegal. However,it is illegal to edit a tape in a manner that the makes it seem like the person in the tape committed a crime when the truth is they didn't.

That's true,but they are not edited in a manner intended to defame an innocent person and make them look like they committed a federal crime. Or I guess two federal crimes,since abusing a office is a crime in itself. She is also a nasty racist; I agree,but so what? She rose above her personal views to do the right thing. We should all strive to do that in our lives.

I don't think that is illegal either. If so MSNBC should be sued for editing a tape saying tea partiers are racists. Anyhow can you shed some light on the subject by showing me the law you are talking about? Now if someone doctored a video and presented it under oath falsely. I would agree with you.

You aren't stupid and you KNOW people have been successfully sued for slander (BTW,the case of Carol Burnette comes to mind,and she was and is a actual celebrity/public person) and other cases where state and feral employees have actually gone to jail for misusing their office.

Not only did he edit it, he misrepresented WHEN she made the remarks. He represented that the remarks were made about an event that occurred WHILE she worked for USDA. As a result of his act, she suffered a material loss of employment which would be a tort of defamation.

Sherrod's words are her own words though, aren't they? If she's abusing her office, any indictment of a "crime" is up to an investigation by the DoJ. She or other people can't just arbitrarily claim she's been "defamed," "slandered," or "libeled"....well...actually they can claim anything they want. I agree [she's a racist] ,but so what? She rose above her personal views to do the right thing. We should all strive to do that in our lives.
