Lifetime Sex Offender Registration for 18-Year-Old Who Chatted Online with 15-Year-Old

Actually having sex would just be a misdemeanor.New Hampshire's state Supreme Court has upheld a young man's harsh sentence—which includes lifetime registry on the sex offender list—for propositioning a 15-year-old girl over the internet. The man, Bailey Serpa, was 18 at the time. According to New Hampshire law, Serpa would have been guilty of a mere misdemeanor had the two actually had sex. But online solicitation of a minor is considered a felony. Serpa appealed the sentence on grounds that it was "unconstitutional and grossly disproportional," The New Hampshire Union Ledger reports. Last month, he lost in court: The ruling is the latest chapter in a series of ...

Mueller accuses Paul Manafort of witness tampering

Federal prosecutors accused former Trump presidential campaign chairman Paul Manafort of witness tampering late Monday in his tax and lobbying case and asked a federal judge to consider revoking or revising his release pending trial. In a late Monday filing in Washington, prosecutors accused Manafort and a longtime associate they previously linked to Russian intelligence of repeatedly contacting two members of a public-relations firm since February to secure false testimony about their collective work involving a group of former senior European politicians. The group, informally called the “Hapsburg group,” was secretly retained in 2012 by Manafort to take positions favorable to ...

Veteran can't sue for false arrest

Army veteran suffering from PTSD tells VA therapist he thought about shooting Louisville, Ky. police officer (who cited him for minor traffic violation) but that he did not intend to do it. A VA staff member informs the police (without the therapist's say-so). The (Louisville, Ky) officer gets the veteran charged with making terroristic threats, neglects to mention therapist's belief that veteran was not a risk. The veteran spends 10 days in jail before charges dismissed. Sixth Circuit Decision: The officer had a warrant, so the veteran can't sue for false arrest (though he might have been more successful had he raised different claims).

The Masterpiece Cakeshop Decision Leaves Almost All the Big Questions Unresolved Eugene Volokh June 4, 2018 10:49 am Do bakers have a First Amendment right to refuse to bake cakes for same-sex weddings, even if there's a state law banning sexual orientation discrimination by such businesses? Do they have a First Amendment right to refuse to bake such cakes that contain text or symbolism (e.g., rainbow striping) that the bakers disapprove of? How about wedding photographers or videographers, who create products that (unlike most cakes) are traditionally seen as speech? How about calligraphers or graphic designers, who have an objection to personally writing or typing certain ...

Clapper: The U.S. Meddled In Foreign Elections And Conducted Regime Change In The "Best Interests Of The People"

Former head of US Intelligence James Clapper just admitted that the United States was simply looking out for citizens of various countries "when we tried to manipulate or influence elections or even overturned governments," a statement directly at odds with the moral high ground claimed by President Obama and other US officials on the topic of Russian election meddling. In an interview with Bloomberg's Tobin Harshaw published Saturday, Clapper - who is promoting his new book "Facts and Fears," said "I guess the way I think about that is that through our history, when we tried to manipulate or influence elections or even overturned governments, it was ...

Trump Says He Has the Absolute Right to Pardon Himself
Post Date: 2018-06-04 11:02:38 by Deckard

President Trump tweeted Monday morning that he has the right to pardon himself, but that he has no reason to do so, because he’s completely innocent. His bold, frightening assertion comes after a weekend in which the Trump administration’s legal argument — that the president can basically do whatever he wants with no repercussions — came into sharper focus. On Saturday, the New York Times reported that Trump lawyers had sent Special Counsel Robert Mueller a letter in January arguing that their client should not be forced to sit for questioning because, as the president, he could not by definition have obstructed justice. Then, on Sunday, Trump lawyer Rudy Giuliani ...

Supreme Court sides with Colorado baker who refused to make wedding cake for same-sex couple

The Supreme Court ruled Monday in favor of a Colorado baker who refused to bake a wedding cake for a same-sex couple. In a 7-2 decision, the justices set aside a Colorado court ruling against the baker -- while stopping short of deciding the broader issue of whether a business can refuse to serve gay and lesbian people. At issue was a July 2012 encounter between the couple and baker Jack Phillips. The battle has since developed into perhaps the most closely watched appeal so far this term before the high court. At the time, Charlie Craig and David Mullins of Denver visited Masterpiece Cakeshop to buy a custom-made wedding cake. Phillips refused his services when told it was for a ...

The State Will Gladly Protect You From Freedom of Conscience

For hundreds of years, western cultures have been refining what is known as Freedom of Conscience. One of the outcomes of this refinement is Freedom of Speech, a Liberty that is relatively new to the human political experience. Not long ago, being critical of a government, for instance, could get you killed by that government. Merely speaking out of turn or having critical thought towards the State religion meant torture or death. But, we have advanced through time to understand that free thought and critical speech is something that a free people must protect and encourage. Thomas Jefferson went as far as to say that repressing Freedom of Conscience was a “Sin against God”. ...

A trade war Canada will lose to its larger, louder counterpart [Trump] [Full Thread]

Presumably Donald Trump was warned of the furious response he could expect from the United States’ trading partners were he to proceed with his threatened tariffs on their exports of aluminum and steel. He went ahead and did so anyway. This is one problem with trade wars: they seek to achieve in retrospect what they failed to achieve in prospect. Were he likely to have been deterred by retaliatory tariffs, of the kind that Canada, Mexico and the European Union have just applied to a fantastic assortment of U.S. goods, he would have been already. And yet, deterrence having so conspicuously failed, they feel obliged to carry out the threat regardless. It is difficult to see how the ...

Dozens of FBI Agents Admit Agency Corrupted Hillary Probe, Considering Legal Action

Being subpoenaed to appear in front of a judge is something most people want to actively avoid, but a report regarding the Obama-era FBI suggests dozens of agents want to have their day in court to expose government corruption. During Sean Hannity’s Fox News program Friday, the conservative host said he has learned that more than two dozen FBI agents want to be subpoenaed in order to testify about widespread abuses and political bias that occurred at the bureau during the Hillary Clinton email scandal. “We have an (Inspector General) report coming out, and I’m told as many as 28 people that have knowledge of the Clinton email server scandal want to be ...

Law Prof: Trump can pre-pardon all in Russia probe, kill Mueller's inquest

President Trump is not only right in claiming he can’t be subpoened in special prosecutor Robert Mueller’s Russia investigation, but he can also issue a blanket pardon to any targeted in the probe, a move that would essentially shut it down, according to a top legal expert. By offering a pre-pardon, Trump could signal to potential “flippers” that they won’t have to go to jail for refusing to testify against the president or his 2016 presidential campaign. According to George Washington University Law School Professor John F. Banzhaf, the president has several ways to thwart Mueller, including a move “to directly or indirectly assure those under investigation ...

[what is justification] Dikaiosyne Theou (The Righteousness of God)

[...] In the interpretation of the theme righteousness of God, the problem begins when one considers the meaning of words. Words neither exist by themselves without a context, nor are texts written as free-floating packages of meaning without a historical basis or a place in their cultural milieu. The language Paul used was Greek, but as a Jew he participated in a culture that was Hebrew as well as Greco-Roman. Since Paul quotes passages of the OT throughout his letters, one must understand Paul as writing within the tradition of the Hebrew Bible. By reason of Paul’s frequent use of the Septuagint version of the Hebrew Bible, the same concepts in the LXX should be given due ...

During the month of Ramadan, Muslims fast from dawn to sunset and they break the fast with a meal known as an iftar. The White House faced criticism last ...

Black unemployment rate hits a record low

The black unemployment rate fell to 5.9% in May — the lowest since the government started keeping track in 1972. It's a notoriously volatile number, but the trend is clear: This economy is strong, and everyone is reaping the rewards. "The jobs market is firing on all pistons. It is benefiting all workers," said Tony Bedikian, head of global markets at Citizens Bank. "There are more jobs to be had for all Americans." As the overall unemployment rate continues to fall — the lowest since 2000 — it's also shrinking the gap between black and white unemployment. It is the narrowest on record. Black unemployment dropped sharply last month, down from ...

The National Football League has done nothing to recover during the off season from it’s miserable popularity ratings that are now at the lowest ever. Rocked by the issues of players taking a knee during the playing of the National Anthem, overly long games, and scandalous players, just 35 percent say they have a favorable view of “America’s sport.” According to an Economist/YouGov poll taken May 27-29 another 47 percent have an “unfavorable” view of the NFL. What's more, only 15 percent called the NFL a "top interest," and 37 percent said that they are "Not at all interested" in the games. Many teams are already in early training camp ...

Generation Z, the first generation of digital natives, has a relationship with phones and the internet like no other generation before. Notably, it is the first generation to learn to navigate an iPhone at the same age they learn to walk. While many say the proliferation of loneliness and unhappiness among this rising generation is phone-related, it’s safe to say the phone is not ...

If there is one thing that most conservatives have in common it is their support for the federal government’s war on drugs. Here is the conservative drug war creed. I believe in the Constitution, but I also believe in the unconstitutional federal war on drugs.I believe in a smaller federal government, but still support a federal Drug Enforcement Administration (DEA).I believe in federalism, but not when it comes to the federal war on drugs.I believe in free markets, but not when it comes to a free ...
