What is the efficient way to run a railroad or a government, as the case may be? I’m of the minority opinion that presidents should be given more power for less time. Let him—no “her” yet!—put the ideas he campaigned on into play, like a new tax code, and let’s see if it works or fails, quickly. If it doesn’t, then two years later the people who said it would never work get their chance. A watered-down version of an idea isn’t a good indicator of whether it’s a good idea. I read this great book by Daniel Lazare—The Frozen Republic: How the Constitution Is Paralyzing Democracy. The Founders very clearly indicated that they had no idea what ...

The Danger of a ‘We Must Do Something’ GovernmentJanuary 30, 2013 By Jennifer Burke TPNN Contributor The Obama Administration has demonstrated repeatedly the love of the phrase “We must do something.” This phrase has been used to tug at the heartstrings of Americans during our most fragile of times. The cost, however, has been great ranging from an infringement on our God-given rights to a usurpation of our Constitution, to the indebtedness of the people and the financial ruin of our nation. Today, during hearings related to the government’s continued attack on our Second Amendment rights, with testimony on the merits of gun control, we heard those words ‘we ...

Politics in Absurdistan: Skeet Shootergate (WH pic of Obama shooting)

Obama has to cover for a remark he made insisting he's a Camp David skeet shooter. So the White House has produced a photo of Barry shooting to put the issue to rest. But what's really silly is the bloviation passing as discussion by the usual establishment vetted talking heads. For instance, the neocon and former Bush speechwriter David Frum. Frum insists Americans don't need firearms for self defense because, well, America is safer than ever. Those of us with a decent grasp of reality, however, know there are places where criminals victimize the disarmed – for instance, the Second Amendment free zones of New York City and Chicago. Mr. Frum, as a member of the ...

Violate the 2nd Amendment? Civil War’s A-Brewin’

A pretty, young, auburn-haired woman – mid-20s – drove down a lonely country road somewhere in Oklahoma. Appearing in her rear-view mirror, at the back windshield, were two menacing orbs of light floating amid ashen dusk. The guttural roar of a souped-up big block shook the tiny Volkswagen Rabbit as a van-load of inbred thugs lurched left and drew alongside her. A pony-tailed passenger taunted inaudibly and blew foul kisses between crude hand gestures. He pointed for her to pull over as the van repeatedly swerved dangerously close. Inside the car a man, asleep in the reclining passenger seat, was startled awake by the commotion. He rose and darted his head about, calmly assessing ...

Tomorrow, Enforce the Twentieth Amendment, Section Three and OBAMA is GONE

The Constitution does not allow someone who does not meet the eligibility requirements for President to legally serve no matter what the election results are. It's right there in the Constitution under the Twentieth Amendment, Section Three: "3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the ...

Why I Brought Piers Morgan That 'Little Book'

When I appeared on CNN’s Piers Morgan Tonight to debate gun control on Thursday night, I came armed with a copy of the Constitution of the United States.  I did so for a very simple reason: for too long, the left has been getting away with the lie that they are pro-Second Amendment. Then they proceed to violate the most basic concept of the Second Amendment: that we have a right to keep and bear arms. It is fine to have a rational conversation about how to balance rights with the risk and rewards of particular firearm ownership. But that is not what the left does. They loudly proclaim support for the right to bear arms but then ask, “Why should you be ...

The Second Amendment … Where’s the Line? (Citizen Drone Warfare)

The Right to Bear … Drones? Gun advocates say that the Second Amendment guarantees the right to bear arms to prevent a tyrannical government from oppressing us. They quote the Founding Fathers: Laws that forbid the carrying of arms, disarm only those who are neither inclined, nor determined to commit crimes. Such laws make things worse for the assaulted and better for the assailants. They serve rather to encourage than to prevent homicides, for an unarmed man may be attacked with greater confidence than an armed man. – Thomas Jefferson, 1764 What country can preserve its liberties if their rulers are not warned from time to time that their people preserve the spirit of resistance. ...

Morsi Flees Palace

(Reuters) - Egyptian police battled thousands of protesters outside President Mohamed Mursi's palace in Cairo on Tuesday, prompting the Islamist leader to leave the building, presidency sources said. Officers fired teargas at up to 10,000 demonstrators angered by Mursi's drive to hold a referendum on a new constitution on December 15. Some broke through police lines around his palace and protested next to the perimeter wall. The crowds had gathered nearby in what organizers had dubbed "last warning" protests against Mursi, who infuriated opponents with a November 22 decree that expanded his powers. "The people want the downfall of the regime," the demonstrators ...

Cops to Congress: We need logs of Americans' text messages State and local law enforcement groups want wireless providers to store detailed information about your SMS messages for at least two years -- in case they're needed for future criminal investigations. AT&T, Verizon Wireless, Sprint, and other wireless providers would be required to record and store information about Americans' private text messages for at least two years, according to a proposal that police have submitted to the U.S. Congress. CNET has learned a constellation of law enforcement groups has asked the U.S. Senate to require that wireless companies retain that information, warning that the lack of a ...

U.S. Supreme Court Blocks Illinois Law Prohibiting Taping Of Police

The U.S. Supreme Court has rejected a plea from the Cook County state's attorney to allow enforcement of a law prohibiting people from recording police officers on the job. The justices on Monday left in place a lower court ruling that found that the state's anti- eavesdropping law violates free speech rights when used against people who tape law enforcement officers. The law sets out a maximum prison term of 15 years. The American Civil Liberties Union filed a lawsuit in 2010 against State's Attorney Anita Alvarez to block prosecution of ACLU staff for recording police officers performing their duties in public places, one of the group's long-standing monitoring ...

Daddy / daughter lunch with my 16 yo today. Marissa told me that she has to write an essay on gun control from a pro or con position for her "history" class. She, on her own, has already picked the Second Amendment position. She has a very left-wing "progressive" (regressive / illiberal) history teacher. But, Marissa told me that she is not afraid to state her opinion. I was surprised to learn how much research she has already done and how solid her arguments already are. I was impressed. Battle Over Coastal Xmas Display Goes to LA Court

Damon Vix didn't have to go to court to push Christmas out of the city of Santa Monica. He just joined the festivities. The atheist's anti-God message alongside a life-sized nativity display in a park overlooking the beach ignited a debate that burned brighter than any Christmas candle. Santa Monica officials snuffed the city's holiday tradition this year rather than referee the religious rumble, prompting churches that have set up a 14-scene Christian diorama for decades to sue over freedom of speech violations. Their attorney will ask a federal judge Monday to resurrect the depiction of Jesus' birth, while the city aims to eject the case. "It's a sad, sad ...

The Taming of the Tea Party

It wasn't a pretty year for the Tea Party movement—unless you were in the Ron Paul wing. When you're listing the losers of this election cycle—not just on Tuesday but all year—be sure to include the Tea Party movement. You might have missed the sustained beating it took throughout the campaign, given how hard the Democrats worked to paint the Romney/Ryan ticket as a tricorne-wearing Godzilla lurching toward a helpless village. But consider this sequence of events: • A wave of weak candidates—Michele Bachmann, Herman Cain, Rick Perry—attracted a Tea Party following and then imploded. The only one of these who ever had a credible path to the nomination ...

TAMPA, November 2, 2012 – It wasn’t so long ago that the following statement could only appear in a dystopian novel or movie script: The U.S. President has killed an American citizen without due process, without even charging him with a crime. His decision to do this has been challenged by members of neither party. While the media-fueled frenzy goes on about how supposedly different Romney and the conservatives are from Obama and the liberals, no one even raises an eyebrow about this terrifying political development. Not even the left, which quite correctly howled at passage of the Patriot Act and the Bush administrations’ other assaults on freedom. Bush and the Republicans ...

New Jersey makes plans for makeshift voting places; deploys military trucks to serve as polling places (National Guard)

Many people have said that the only good thing about Hurricane Sandy is that it made people forget about the election bickering. But New Jersey is making contingency plans for communities in the state’s 3,000 polling places whose regular voting machines were destroyed or are without power. According to the Associated Press, Governor Christie announced that the application to apply for mail-in ballots has been extended until Friday and military trucks will be set up as polling sites in areas that have been affected. Some voters will be using paper ballots for voting. Fox News reports that Department of Defense trucks will be parked at accessible polling places that have lost their ...

Court Oks Warrantless Use Of Hidden Surveillance Cameras

Police are allowed in some circumstances to install hidden surveillance cameras on private property without obtaining a search warrant, a federal judge said yesterday. CNET has learned that U.S. District Judge William Griesbach ruled that it was reasonable for Drug Enforcement Administration agents to enter rural property without permission -- and without a warrant -- to install multiple "covert digital surveillance cameras" in hopes of uncovering evidence that 30 to 40 marijuana plants were being grown. This is the latest case to highlight how advances in technology are causing the legal system to rethink how Americans' privacy rights are protected by law. In January, the ...

AVON LAKE, Ohio — Facing off in last week's foreign policy debate, Mitt Romney nodded in agreement with much of what President Obama has done with his powers as chief executive — including a full-on embrace of the president's claim to sole authority to expand drone strikes to kill terrorist suspects. The Republican presidential nominee has reserved the right to deploy U.S. military power to world hot spots, as Mr. Obama did in Libya, and to greenlight unilateral action against Iran. To the dismay of civil liberties activists, he has shifted his position on indefinite detention, agreeing with the president that U.S. citizens deemed "enemy combatants" are not ...

Supreme Court Lets At&T Wiretapping Immunity Stand
Post Date: 2012-10-09 23:53:41 by Brian S

WASHINGTON — The US Supreme Court let stand Tuesday an immunity law on wiretapping viewed by government as a useful anti-terror tool but criticized by rights activists as a flagrant abuse of executive power. The top US court declined to review a December 2011 appeals court decision that rejected a lawsuit against AT&T for helping the National Security Agency monitor its customers’ phone calls and Internet traffic. Plaintiffs argue that the law allows the executive branch to conduct “warrantless and suspicionless domestic surveillance” without fear of review by the courts and at the sole discretion of the attorney general. But President Barack Obama’s ...

Supreme Court Case: Right To Resell Your Own Stuff Is In Peril...

CHICAGO (MarketWatch) — Tucked into the U.S. Supreme Court’s agenda this fall is a little-known case that could upend your ability to resell everything from your grandmother’s antique furniture to your iPhone 4. At issue in Kirtsaeng v. John Wiley & Sons is the first-sale doctrine in copyright law, which allows you to buy and then sell things like electronics, books, artwork and furniture, as well as CDs and DVDs, without getting permission from the copyright holder of those products. A Supreme Court case could limit the resale of goods made overseas but sold in America. Under the doctrine, which the Supreme Court has recognized since 1908, you can ...

This talk was presented in Roanoke at the Third Annual Liberty Tree Dinner of the 2nd Tuesday Constitutional Group on September 15th, 2012. Good evening. I’m delighted and honored to be here. I want to talk today about liberty, how it is defined in practical terms, and what is required of us to gain and preserve it. I’ll talk about a man, dead for centuries, who spent much of his life in exile or in prison. A man who led a movement that inspired and informed our own founding fathers, a man whose ideas and example may well be appropriate for our own era of reclaiming liberty in our own country. Before we examine the life of this hero of liberty, I’d like to mention another ...

(Kansas) State Officials Considering Obama Citizenship (British subject, Romney Mexican)

President Barack Obama faces a question over his citizenship in Kansas. Kansas officials plan to hold a hearing Thursday afternoon to weigh whether President Barack Obama is a citizen and should appear on the state's November ballot. The Kansas Objections Board will be considering a challenge filed by Joe Montgomery, a Manhattan resident, who Monday objected to Obama being on the ballot. He claims the president is not an American citizen since his father was a citizen of the United Kingdom and Kenya. The all-Republican board -- which consists of Secretary of State Kris Kobach, Lt. Gov. Jeff Colyer and Attorney General Derek Schmidt -- has the power to remove Obama from the ballot in ...

Why is it that libertarians – who don’t revere the Constitution – have no trouble understanding the Constitution but conservatives – who do revere the Constitution – have so much trouble? In a letter to the editor of The New American published in its August 20, 2012 issue, someone who believes "in the constitutional right of citizens to keep and bear arms for self-defense – the protection of life and property" and in "the right of a person to hunt and harvest a natural resource for food" is nevertheless troubled about Americans having guns for other purposes. In a letter sent via e-mail, Richard Moore writes about military-type guns being ...

The case is Embody v. Ward, handed down today by the Sixth Circuit in an opinion by Judge Sutton. It begins: Tennessee law allows individuals with gun permits to carry handguns in public places “owned or operated by the state” such as “public park[s]” and “natural area[s].” Tenn. Code § 39-17-1311(b)(1)(H). The statute defines a “handgun” as “any firearm with a barrel length of less than twelve inches” that is “designed, made or adapted” to be fired with one hand. Id. § 39-11-106(a)(16). Armed with knowledge of this law and one thing more — a Draco AK-47 pistol — Leonard Embody went to Radnor Lake State ...
