Banning Prayer in Public Schools Has Led to America's Demise Post Date: 2013-12-30 22:10:30 by A K A Stone

A recent statistical analysis by David Barton graphically illustrates how America has plummeted from righteous living, prosperity and success in the last quarter century. Consider the following chart compiled from his study, America: To Pray or Not to Pray. 1 As you might have already noticed on Mr. Bartons graph, Americas moral decline rapidly accelerated following one event the U.S. Supreme Courts removal of prayer from our nations schools. On June 25, l962, 39 million students were forbidden to do what they and their predecessors had been doing since the founding of our nation publicly calling upon the name of the Lord at the beginning of each ...
Judge: NSA domestic phone data-mining unconstitutional Post Date: 2013-12-16 20:19:24 by buck

Washington (CNN) -- A federal judge said Monday that he believes the government's once-secret collection of domestic phone records is unconstitutional, setting up likely appeals and further challenges to the data mining revealed by classified leaker Edward Snowden. U.S. District Judge Richard Leon said the National Security Agency's bulk collection of metadata -- phone records of the time and numbers called without any disclosure of content -- apparently violates privacy rights. His preliminary ruling favored five plaintiffs challenging the practice, but Leon limited the decision only to their cases. NSA phone surveillance unconstitutional? "I cannot imagine a more ...
Supreme Court won’t hear challenge to NSA’s phone-records collection Post Date: 2013-11-24 09:24:16 by We The People

The Supreme Court refused an unusual petition Monday from a privacy group that sought to stop the National Security Agency from collecting the telephone records of millions of Verizon customers. The Electronic Privacy Information Center bypassed lower courts because it said only the Supreme Court could review a decision by the Foreign Intelligence Surveillance Court (FISC) that exceeded its statutory jurisdiction when it ordered production of millions of domestic telephone records that cannot plausibly be relevant to an authorized investigation. The lawsuit was considered a long shot the Supreme Court rarely takes cases that have not gone through the lower courts ...
FBI, using secretive DITU department, aids NSA’s surveillance work Post Date: 2013-11-22 14:47:09 by We The People

While much of the American public and international community have expressed alarm at the far-reaching US National Security Agencys surveillance programs, the FBI has quietly avoided scrutiny while carrying out intelligence programs of its own. The bureau, using legal rationale that would make former director J. Edgar Hoover proud, has facilitated the data collection method employed by the NSAs PRISM program and pressed Verizon to turn over the call records belonging to millions of customers. Much of the FBIs clandestine activity originates in a shadowy department known as the Data Intercept Technology Unit (DITU). A senior official in the US department of Justice ...
Obama Birth Certificate: New Hard Document Evidence ‘It’s Gotten Deeper, Darker than You Can Imagine’ Post Date: 2013-11-09 09:44:17 by We The People

As reported here Carl Gallups of Freedom Friday gave an update in the investigation into Obamas forged birth certificate and forged selective service registration. Gallups just gave another update on his radio show reiterating the investigation has not gone silent or stopped. He says it has gotten deeper and darker than ever imagined saying it is now much bigger than the birth certificate. He says the implications are astounding and could be history changing. Its gotten deeper, deeper, deeper, darker than you can imagine The evidence collected is astounding, its beyond monumental, it could be historical, history-changing.

Gilardi v DHHS, DC Cir 13-5069 (1 Nov 2013), OPINION, upholds Ohio challenge to Obamacare birth control mandate [Footnotes omitted] [At 8-9] At the time of the Framing, a great debate raged on the precise formulation of what we now know as the Free Exercise Clause. See Michael W. McConnell, The Origins and Historical Understanding of Free Exercise of Religion, 103 HARV. L. REV. 1409, 148085 (1990). The earliest drafts from the House of Representatives focused on the protection of conscience, rather than the exercise of religion. Dual citizenship may pose problem if Ted Cruz seeks presidency (Birth Certificate) Post Date: 2013-08-19 20:59:00 by Hondo68

Sen. Ted Cruz's birth certificate shows he was born in Canada in 1970. It was released exclusively to The Dallas Morning News. WASHINGTON Born in Canada to an American mother, Ted Cruz became an instant U.S. citizen. But under Canadian law, he also became a citizen of that country the moment he was born.Unless the Texas Republican senator formally renounces that citizenship, he will remain a citizen of both countries, legal experts say. That means he could assert the right to vote in Canada or even run for Parliament. On a lunch break from the U.S. Senate, he could head to the nearby embassy the one flying a bright red maple leaf flag pull out his Calgary, Alberta, ...
The American Right to Revolt Against Tyranny: Part C—Founders & John Locke Post Date: 2013-08-18 21:06:16 by A K A Stone

The Founding Fathers were in favor of the right to revolt against tyranny. This is obvious despite widespread current attempts by progressives to suggest armed revolt and the 2nd Amendment would be opposed by the Founders today. But how logical would be the notion that Americans could own guns, but not use them to defend themselves? Or that Americans could arm to defend their lives and liberties, but only against invadersnot against tyrants? Of course, such a position is transparent nonsense. In fact, the American Revolution itself is the most eloquent testimony illustrating the right to bear arms against government subjugation imaginable. Consider the definition of Tyranny in ...

Lavabit Competitor Silent Circle Shuts Down Its Secure Email Service, Destroys Servers Post Date: 2013-08-10 19:31:33 by Brian S

Silent Circle, a secure communications company founded by PGP creator Phil Zimmerman, has pre-emptively shut down its secure, encrypted email service and destroyed the servers so that it cannot be forced to reveal its customers' secrets to NSA spooks. In a letter entitled To Our Customers that echoed (and was inspired by) yesterday's letter from Lavabit founder, Silent Circle co-founder and CTO Jon Callas explained "Silent Mail was a good idea at the time, and that time is past" because, unlike its other products, it is theoretically possible for Silent Circle to snoop on email, and thus they may be forced to do so. Weve been thinking about this for some time, ...

So the paranoid hippie pot dealer you knew in college was right all along: The feds really were after him. In the latest post-Snowden bombshell about the extent and consequences of government spying, we learned from Reuters reporters this week that a secret branch of the DEA called the Special Operations Division so secret that nearly everything about it is classified, including the size of its budget and the location of its office has been using the immense pools of data collected by the NSA, CIA, FBI and other intelligence agencies to go after American citizens for ordinary drug crimes. Law enforcement agencies, meanwhile, have been coached to conceal the existence of the ...
Republican Blocks Bill That Would Require Warrant for Feds to Access Email Post Date: 2013-08-06 17:32:01 by We The People

08/06/13 Who said Republicans were for privacy rights? Every court in the country would approve a search warrant for terror suspects. To think we need to give away our rights to email privacy in exchange for safety is a faux argument. From The Hill: An anonymous Republican senator has delayed a vote on legislation that would require police to obtain a warrant before accessing emails and other online messages. Senate Judiciary Committee Chairman Patrick Leahy (D-Vt.) pushed for a vote on the bill before Congress left for its August recess. He secured unanimous support from Democrats, but at least one Republican objected to the bill, according to a Democratic Senate aide. Leahy had hoped ...
Seattle To Ban ‘Potentially Offensive’ Words Like ‘Brown Bag’ And ‘Citizen’ Post Date: 2013-08-03 10:14:36 by We The People

Government workers in the city of Seattle have been advised that the terms "citizen" and "brown bag" are potentially offensive and may no longer be used in official documents and discussions. KOMO-TV reports that the city's Office of Civil Rights instructed city workers in a recent internal memo to avoid using the words because some may find them offensive. "Luckily, we've got options," Elliott Bronstein of the Office for Civil Rights wrote in the memo obtained by the station. "For 'citizens,' how about 'residents?'" In an interview with Seattle's KIRO Radio, Bronstein said the term "brown bag" has been used ...

Cook County sheriff’s team taking guns if FOID card is revoked Post Date: 2013-07-31 05:55:50 by We The People

A new Cook County Sheriffs team is crisscrossing the suburbs to seize guns from thousands of people whose Firearm Owners Identification Cards have been revoked. More than 3,000 people in Cook County have failed to surrender their revoked FOID cards to the state. Sheriff Tom Dart said he thinks many of them continue to possess firearms. The Chicago Police Department conducts regular missions to recover revoked FOID cards and seize guns from the holders, but there wasnt a concerted effort to do that in Cook Countys suburbs, Dart said. The system is broken, the sheriff said. The system revokes cards, but the guns are of no consequence. . . . Our ...
Appeals Court: NYC's Big-Soda Ban Unconstitutional Post Date: 2013-07-30 21:37:58 by Murron

New York City's crackdown on big, sugary sodas is staying on ice. A mid-level state appeals court ruled Tuesday that the city's Board of Health exceeded its legal authority when it voted last year to put a size limit on soft drinks served in restaurants, theaters, stadiums, sidewalk food carts and many other places. The ban, which would have stopped the sale of many high-calorie beverages in containers bigger than 16 ounces, had been lauded by some health experts as an overdue attack on one of the primary contributors to a national obesity epidemic. But in a unanimous opinion, the four-judge panel of the state Supreme Court Appellate Division said that the health board was ...

Supreme Court shutouts reveal reckless decisions Post Date: 2013-07-29 16:17:24 by We The People

When the White House loses cases 9-0, the president is going too far. Those of us who follow Supreme Court decisions spend most of our time debating the contentious issues that divide justices 5-4 along predictable ideological lines. Often, that's where the loudest public debates are as well. Just consider the recent rulings on gay marriage. But we might do well to pay more attention where the court rules unanimously, particularly when they go against the White House. When a president pursues policies that require such expansive federal power that he can't get a single justice to agree, something is probably amiss. Such overreach, though, has become a part of our political culture. ...
United States v. Jones : GPS Monitoring, Property, and Privacy Post Date: 2013-07-29 16:13:26 by We The People

Richard M. Thompson II Legislative Attorney April 30, 2012 Summary In United States v. Jones , 132 S. Ct. 945 (2012), all nine Supreme Court Justices agreed that Jones was searched when the police attached a Global Positioning System (GPS) device to the undercarriage of his car and tracked his movements for four weeks. The Court, however, splintered on what constituted the search: the attachment of the device or the long-term monitoring. The majority held that the attachment of the GPS device and an attempt to obtain information was the violation; Justice Alito, concurring, argued that the monitoring was a violation of Joness reasonable expectation of privacy; and Justice Sotomayor, ...

I know were all very upset about whats happening in DC. For many people, todays events are extremely upsetting. Sadly, though, we need to accept facts. The federal government is filled with sociopathic criminals. But we can beat them. And we will. Here at the Tenth Amendment Center, were in the process of putting together a long-range strategy which helps people understand what needs to be done to advance liberty and the Constitution. So, as many of our nullification bills are moving forward, were becoming quite good at getting things done. Stay tuned for that. In the meantime
