House Votes To Expand National DNA Arrest Database Post Date: 2010-05-19 23:22:58 by Brian S

Millions of Americans arrested for but not convicted of crimes will likely have their DNA forcibly extracted and added to a national database, according to a bill approved by the U.S. House of Representatives on Tuesday. By a 357 to 32 vote, the House approved legislation that will pay state governments to require DNA samples, which could mean drawing blood with a needle, from adults "arrested for" certain serious crimes. Not one Democrat voted against the database measure, which would hand out about $75 million to states that agree to make such testing mandatory. "We should allow law enforcement to use all the technology available to them...to reduce expensive and unjust ...
Napolitano Admits She Hasn't Read Arizona Immigration Law in 'Detail' Post Date: 2010-05-18 15:21:44 by WhiteSands

Homeland Security Secretary Janet Napolitano admitted Monday that she has not read the controversial Arizona immigration law even though she's gone on television to criticize it, and continued to assert that it was "bad law enforcement law." The admission comes after Attorney General Eric Holder, who earlier warned the law could create a "slippery slope" toward racial profiling, told a House committee last week that he had not read the bill either. On Tuesday, State Department spokesman P.J. Crowley said he too had not read the bill, even as he defended diplomatic official Michael Posner for comparing the law to Chinese human rights violations. Napolitano ...

Arizona Passes Law Banning Multilingual Requirement for Businesses May 18, 2010 Author: Fenig: American Thinker Arizona did it again! Fresh from signing a law that reinforces a federal law giving police the right to ask a person stopped by police for an unrelated matter to produce papers proving the right to be legally in the US, followed by a law banning schools from teaching minority/ethnic studies courses advocating separatism, group superiority and subversion of this country, Arizona Governor Jan Brewer (R) signed legislation affirming that nothing in state law requires businesses to provide "trained and competent" interpreters when a customer comes in speaking a language ...
Arizona Immigration Law Divides Police Across US Post Date: 2010-05-17 19:20:30 by Brian S

PHOENIX (AP) -- Arizona's tough new law cracking down on illegal immigration is dividing police across the nation, pitting officers against their chiefs and raising questions about its potential to damage efforts to fight crime in Hispanic communities. Two officers are challenging the law in court, while police unions that lobbied for it are defending it against criticism from police officials. Both sides are debating how a law such as Arizona's can be enforced, without leading to racial profiling of Hispanics and without alienating residents in Hispanic neighborhoods with whom police have spent years trying to build trust. "Before the signing of this bill, citizens would ...

A Fox News legal analyst believes that a controversial Arizona anti-illegal immigration law could be tied up in court for years. Judge Andrew Napolitano told Fox News host Gregg Jarrett that he expects a federal court to enjoin a law that requires people to prove their residency if stopped by police.Several civil rights groups filed suit against the law Monday morning. AZCentral.com reports:Participants will include the American Civil Liberties Union, Mexican American Legal Defense and Educational Fund, National Immigration Law Center, National Association for the Advancement of Colored People, National Day Laborer Organizing Network and Asian Pacific American Legal Center. Sex-Offender Commitment Law Upheld by U.S. Supreme Court Post Date: 2010-05-17 11:22:11 by war

May 17 (Bloomberg) -- The Supreme Court upheld a federal law that allows the civil commitment of sexually dangerous people, including those whose federal prison terms have expired. The justices, voting 7-2, today ruled that Congress acted within its constitutional authority in enacting the 2006 measure, which affects people already in federal custody. The ruling bolsters the ability of the national government to play a role in preventing sex crimes, traditionally a state function. More than 100 people have been held under the law, which a lower court had declared unconstitutional. The case is United States v. Comstock, 08-1224.

Obama Said to Be Open to New Miranda Look By CHARLIE SAVAGE WASHINGTON David Axelrod, the top White House political adviser, said Monday that President Obama was amenable to Attorney General Eric H. Holder Jr.s call for a new law allowing interrogators to question terrorism suspects for lengthy periods without informing them of their rights. In an interview on CNN, Mr. Axelrod said Mr. Obama was open to looking at changing the Miranda rule, which generally bans prosecutors from using as evidence statements made by suspects in custody before they have been warned that they have a right to remain silent and to consult a lawyer. There may be some things that ...

Despite repeatedly voicing concerns about Arizona's new immigration enforcement law in recent weeks and threatening to challenge it, Attorney General Eric Holder said Thursday he has not yet read the law -- which is only 10 pages long. "I have not had a chance to -- I've glanced at it," Holder said at a House Judiciary Committee hearing when asked had he read the state law cracking down on illegal immigrants. Holder told reporters last month that he fears the new law is subject to abuse and that the Justice Department and the Homeland Security Department are in the midst of conducting a review. The Arizona law requires local and state law enforcement to question ...
Kagan Was ‘Not Sympathetic’ as Law Clerk to Gun-Rights Argument Post Date: 2010-05-13 12:22:39 by Brian S

May 13 (Bloomberg) -- Elena Kagan said as a U.S. Supreme Court law clerk in 1987 that she was not sympathetic toward a man who contended that his constitutional rights were violated when he was convicted for carrying an unlicensed pistol. Kagan, whom President Barack Obama nominated to the high court this week, made the comment to Justice Thurgood Marshall, urging him in a one-paragraph memo to vote against hearing the District of Columbia mans appeal. The mans sole contention is that the District of Columbias firearms statutes violate his constitutional right to keep and bear arms, Kagan wrote. Im not sympathetic. ...

Kagans 'Judicial Hero' by Charmaine Yoest 05/11/2010 President Obamas Supreme Court nominee has no track record on the bench as shes yet to ever wear a robe. But her judicial philosophy is no mystery, and that is troubling. You can tell a lot about people by their role models. For prospective judges, the convictions and philosophy of their heroes tells even more. The Presidents nominee to the Supreme Court, Elena Kagan, called Aharon Barak my judicial hero. He is the judge who has best advanced democracy, human rights, the rule of law, and justice. One of the troubling things about Kagans 2006 statement is her assumption that the role ...

NEW YORK In her undergraduate thesis at Princeton, President Obama's nominee for the Supreme Court, Elena Kagan, lamented the decline of socialism in the country as "sad" for those who still hope to "change America." Titled "To the Final Conflict: Socialism in New York City, 1900-1933," Kagan opined that infighting caused the decline of the early socialist movement. She asked why the "greatness" of socialism was not reemerging as a major political force. "In our own times, a coherent socialist movement is nowhere to be found in the United States. Americans are more likely to speak of a golden past than of a golden future, of ...

In commenting on the "Real Enforcement with Practical Answers for Immigration Reform" (REPAIR) proposal offered by Senate Democrats, the top Catholic in the U.S. on immigration issues says that it spends too much money on border enforcement and not enough on bailing out the economies of Mexico and Central America. Bishop John C. Wester, Chairman of the U.S. Conference of Catholic Bishops (USCCB) Committee on Migration issued a statement on Friday declaring that the Bishops "have concerns about the increases in enforcement resources contained in the framework" because "the United States has poured billions of dollars into immigration enforcement" and the ...

Fearful that Americas Supreme Court will soon strike down Chicagos handgun ban, frustrated by the Illinois legislatures rejection of his anti-gun agenda, and repudiated by American courts and legislatures over his plan to sue federally licensed manufacturers and dealers of firearms for third-party crimes, Chicago Mayor Richard Daley (D) is showing contempt for his own countrys and states institutions, by seeking a foreign entity to enforce his anti-gun agenda against the American people. This week, Daley called for redress against the gun industry in the World Court, in The Hague, Netherlands. Forgetting or not caring who his constituents are, ...
Arizona immigration law: Changes sought by lawmakers Post Date: 2010-04-30 10:40:02 by go65

The Arizona House approved several new changes to Arizona's new immigration law. The changes still need final approval from the Senate before being passed along to the governor. If Gov. Jan Brewer supports them, they would go into effect at the same time the new law would. The phrase "lawful contact" would be changed to "lawful stop, detention or arrest" to clarify that an officer would not need to question a crime victim or witness about their legal status. The word "solely" would be eliminated from the sentence "A law enforcement official or agency
may not solely consider race, color or national origin" in establishing reasonable ...

Blasting Arizona's tough new immigration law as "unpatriotic and unconstitutional," Los Angeles Mayor Antonio Villaraigosa on Thursday backed a boycott of the state and urged Southern Californians to join an immigrant and labor rights march this weekend that police say could swell to 100,000 participants. "The debate has caused a call to action," Villaraigosa said. Organizers of the May Day march, scheduled for Saturday morning in downtown Los Angeles, say that the outcry over the Arizona law and the slow pace of congressional action on immigration reform have prompted renewed activism. The law, set to take effect in midsummer, makes it a state crime for illegal ...

Just more than half of the country is in favor of a tough new immigration law in Arizona, according to a new Gallup poll out Thursday. Fifty-one percent of those polled nationwide who said they have heard of the new law favor the measure, which grants police to right to ask to see proof of citizenship from anyone they suspect of being an illegal immigrant. Thirty-nine percent said they oppose it. Three-quarters of the Republicans and half of the independents polled said they approve of the law. Only 34 percent of Democrats said the same. Seventy-eight percent of the people contact by Gallup said they had either heard a "great deal" or a "fair amount" about the state ...

The US Catholic church on Tuesday condemned Arizona's "draconian" new immigration law, saying it would alienate immigrant communities across the United States. "This new law, although limited to the State of Arizona, could have impact throughout the nation in terms of how members of our immigrant communities are both perceived and treated," Bishop John Wester said in a statement issued on behalf of the US Conference of Catholic Bishops (USCCB). "It certainly would lead to the rise in fear and distrust in immigrant communities," Wester, who chairs the USCCB migration committee, said. The law signed by Arizona's Republican Governor Jan Brewer on Friday ...

Republican Senate hopeful Marco Rubio's criticism of Arizona's law attempting to curb illegal immigration represented a break with many conservative base voters. It also highlights a spirited debate on the right over the law and immigration policy. The Washington Examiner's Byron York says those, like Rubio, who have qualms about the Arizona law's "reasonable suspicion" language are ignoring the fact that the law allows police to act on that suspicion only if they have already initiated "lawful contact" with a person, such as for a traffic infraction. But conservative operative and National Review contributor Cesar Conda says the law gives ...
Removal Of California Memorial Cross Blocked By U.S. Supreme Court Post Date: 2010-04-28 11:28:35 by Brian S

The U.S. Supreme Court blocked the removal of a congressionally endorsed war memorial cross from its longtime home in the Mojave Desert, saying a federal court went too far in ordering that it be taken out. At issue is a cross that sits atop Sunrise Rock in a remote part of California's Mojave National Preserve. Since 1934, the cross has existed, in one form or another, as a war memorial. Different court documents refer to it as 5 to 8 feet tall. A decade ago, it came under legal attack from a former National Park Service employee who, though a Catholic, thought it was inappropriate to favor one religion over another in the preserve. The park service had turned down a request to have ...

(04-27) 11:12 PDT WASHINGTON (AP) -- Attorney General Eric Holder says the federal government may challenge Arizona's new law on immigration. The attorney general told reporters Tuesday that he fears Arizona's new law is subject to abuse. At a news conference, Holder said that the Justice Department and the Homeland Security Department are in the midst of conducting a review of the state law. The Arizona law requires state law enforcement officials to ask people for documentation if they are suspected to be in the country illegally. The attorney general says a number of options are under consideration including the possibility of a court challenge.

Republican Sen. Lindsey Graham (S.C.) said Tuesday he thinks Arizona's new immigration law is unconstitutional and that "it doesn't represent the best way forward" when it comes to addressing illegal immigration. He added, however, that the law reflects "what good people will do" when they are left with no other options. Speaking at a Senate Judiciary Committee hearing today with Homeland Security Secretary Janet Napolitano, Graham said Congress eventually needs to tackle immigration reform but that it will be "impossible" to achieve reform until citizens in states like Arizona feel that the borders are secure. MSNBC host Joe Scarborough has an odd obsession for criticizing conservatives for calling Mr. Obama a "Nazi" all the time, yet he has no problem comparing the newly signed Arizona immigration law to "Nazi guards asking to see your papers." Even President Obama did not go that far, but he did call the new law "misguided." On both accounts Mr. Scarborough is wrong. One day he will hopefully realize that LaRouche Democrats who attend various protests with Nazi images of Mr. Obama are not conservatives and Arizona's new immigration enforcement law is designed to mirror federal immigration laws already in place. Federal law mandates that aliens register and ...
