Constitutional Remedies to a Lawless Supreme Court Post Date: 2015-06-27 09:17:12 by tpaine

http://www.nationalreview.com Constitutional Remedies to a Lawless Supreme Court by Ted Cruz June 26, 2015 5:39 PM his week, we have twice seen Supreme Court justices violating their judicial oaths. Yesterday, the justices rewrote Obamacare, yet again, in order to force this failed law on the American people. Today, the Court doubled down with a 54 opinion that undermines not just the definition of marriage, but the very foundations of our representative form of government. Both decisions were judicial activism, plain and simple. Both were lawless. RELATED: More Supreme Court Coverage As Justice Scalia put it regarding Obamacare, Words no longer have meaning if an ...

GOVERNMENT CAN GET YOU ANYTIME IT WANTS. If a person, group of people, or a government has power over you, that means they can control what you do, or force you to do what you don't want to do. That power comes either by the force of law with corresponding punishments for not obeying the law, or by force of violence using the gun or other weapons that can threaten or take your life, or rob you of your liberty. In many of our articles over the last 10 years, we have written about the growing power of the American government, at all levels, but mostly at the federal level. No matter what anyone thinks, the evidence points directly at a trend towards absolute power. That is what governments ...
Worse than Obamacare: Housing Case Lets Feds Target ‘Unconscious’ Racism Post Date: 2015-06-25 19:07:05 by cranky

As bad as the Supreme Courts ruling in Obamacare was, the other decision it handed down on Thursday, in Texas Housing v. Inclusive Communities, is even worse. Like the opinion in King v. Burwell, in which the Court effectively rewrote the plain language of the so-called Affordable Care Act, in Texas Housing the 5-4 majority decided that Congress had allowed claims of housing discrimination to be brought based on population statistics, when in fact it has never done so. Now, plaintiffs do not need to show there was actual racial discrimination, or an intent to discriminate. Instead, they can just point to the racial makeup of a neighborhood and infer that discrimination must have ...

The Washington raisin thief gets busted [Takings Clause] Post Date: 2015-06-25 09:35:39 by Tooconservative

Back in April I wrote about one of the more curious cases to hit the Supreme Court in a while. It dealt with the the Raisin Administrative Committee, which is apparently a real thing and occasionally scoops up (pun intended) the crops of raisin farmers for the general good. This alleged use of the Takings Clause was designed to keep prices up at a certain level to benefit the farmers. The filched raisins would later be sold on the international market with some of the proceeds going back to the farmers, but not at anything resembling the fair market price. Yesterday the Supremes rendered their verdict and in an 8 -1 decision they said the practice failed to meet constitutional muster. (New ...

Warning: Federal Court Rules that 2nd Amendment Right is Now a Reason for Cops to Detain You Post Date: 2015-06-18 08:56:15 by Deckard

In a stunning violation of 2nd Amendment rights, the U.S. District Court of Western Michigan ruled police have the legal authority to detain individuals that choose to exercise their constitutional right to open carry a firearm. Open Carry is also specifically allowed under Michigan law. The ruling means that people in Michigan who choose to exercise this constitutional right are now subject to being stopped by law enforcement for engaging in a completely lawful activity. Officers detained Johann Deffert in early 2013. He was walking down the sidewalk with a holstered FNP-45 pistol, after receiving a 9-1-1 call from a woman who spotted Deffert with the open carried, but holstered, handgun ...

A man exercising his First Amendment right to film in public was confronted by police who proceeded to interrogate, search, handcuff and detain him in what appears to be a blatant violation of his civil rights. The man, who goes by the handle The Battousai on Youtube, routinely conducts what he terms First Amendment audits to ensure police around Central Texas are upholding their fellow citizens constitutional rights. Last Tuesday, while filming a police substation in North Austin, the activist was approached by three uniformed Austin police officers who demanded to know what he was up to. The activist, in accordance with his right to remain silent, refused to answer any ...

Ive previously written about Ross Ulbricht, an American political prisoner sentenced to life for the crime of running a business without the US governments permission. Among libertarians, the response to Ulbrichts abduction and show trial has been, in some cases, less than polite and temperate. Now, the state is moving against its critics. Last week, as Ken White of Popehat reports, the US Department of Justice served Reason a popular libertarian magazine and web site with a grand jury subpoena demanding that it provide any and all identifying information it possesses regarding certain commenters on reporter Nick Gillespies ...

from the 'past-performance-ALWAYS-indicative-of-this-thing-that-just-now-happened' dept Cops kill a lot of people. Depending on who's counting, they've already killed between 385 and 470 people this year. This isn't to say that some of these killings weren't justified, but when details begin leaking out about the those killed, the amount of force in relation to the threat posed is often questionable. Because no PD wants to look like the home of trigger-happy thugs, the media spin begins almost before the "suspect" has expired. Usaamah Abdullah Rahim, shot by Boston cops, was instantly memorialized by law enforcement and a compliant press with the ...

What evidence did he have? He arrived and detained exclusively Blacks, and almost exclusively black males. No male was engaged in the reported physical altercation. United States v. The Second Amendment to our U.S. Constitution states, A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. That statement is pretty clear to understand and comprehend, yet some folks just cant seem to get over it. There are liberal progressive folks of the left who feel it is their mission in life to relegate the Second Amendment as meaningless. Now, what I am about to say will probably anger some people but so be it. Im often asked about FEMA camps along the interstate, Walmart stores closing, and the impending Operation Jade Helm. I continue to tell people that while ...
Department Of Justice Uses Grand Jury Subpoena To Identify Anonymous Commenters on a Silk Road Post at Reason.com Post Date: 2015-06-09 15:25:18 by Hondo68

The United States Department of Justice is using federal grand jury subpoenas to identify anonymous commenters engaged in typical internet bluster and hyperbole in connection with the Silk Road prosecution. DOJ is targeting Reason.com, a leading libertarian website whose clever writing is eclipsed only by the blowhard stupidity of its commenting peanut gallery. Why is the government using its vast power to identify these obnoxious asshats, and not the other tens of thousands who plague the internet? Because these twerps mouthed off about a judge. Last week, a source provided me with a federal grand jury subpoena. The subpoena1, issued by the U.S. Attorney's Office for the Southern ...

Can a Christian Be a Cop? Post Date: 2015-06-01 12:48:24 by Deckard

Can a Christian in good conscience be a cop? Can a libertarian with principles be a cop? Can anyone with respect for individual liberty, private property, and morality be a cop? I have spent many years making the case that Christians have no business serving in the U.S. military, including as chaplains who serve two masters and medics who are accomplices to murder. But in addition to questions about military service, I have also received many e-mails over the years from Christians, libertarians, and Christian libertarians asking me some question about Christians and/or libertarians serving on the police force. I usually refer them to the writings of Will ...

WASHINGTON (AP) -- The National Security Agency lost its authority at midnight to collect Americans' phone records in bulk, after GOP Sen. Rand Paul stood in the way of extending the fiercely contested program in an extraordinary Sunday Senate session. But that program and several other post-Sept. 11 counter-terror measures look likely to be revived in a matter of days. With no other options, Senate Majority Leader Mitch McConnell, in an about-face, reluctantly embraced a House-passed bill that would extend the anti-terror provisions, while also remaking the bulk phone collections program. Now, the question is whether the Senate will pass a bill the House can live with. If so, the ...

Freedom of speech does not include questioning me, it doesnt work like that. On his YouTube channel, Picard explains how the night progressed: On Friday, May 15th, I cop blocked a DUI checkpoint in Hartford, CT, holding up a sign that read, Cops ahead (Turn now). A federal appeals court upheld an injunction against President Obamas new deportation in a ruling Tuesday that marks the second major legal setback for an administration that had insisted its actions were legal. The U.S. Court of Appeals for the Fifth Circuit ruled in favor of Texas, which had sued to stop the amnesty, on all key points, finding that Mr. Obamas amnesty likely broke the law governing how big policies are to be written. The public interest favors maintenance of the injunction, the judges wrote in the majority opinion. Mr. Obama had acted in November to try to grant tentative legal status and work permits to as many as 5 million illegal immigrants, ...

Next Thursday I am scheduled to debate Robert White, co-author (with Bill Bennett) of Going to Pot: Why the Rush to Legalize Marijuana Is Harming America, on Glenn Becks radio show. Each of us will get half an hour or so to make his case before taking questions from Beck and each other. Here is what I plan to say: Marijuana Prohibition Is Unscientific A few days before the House of Representatives passed a federal ban on marijuana in June 1937, the Republican minority leader, Bertrand Snell of New York, confessed, I do not know anything about the bill. The Democratic majority leader, Sam Rayburn of Texas, educated him. It has something to do with ...

Proponents of drug decriminalization, with their cry of personal liberty
have about wrecked the true concept of government control of evils, complained John A. Lapp, President of the National Conference of Social Workers. From Lapps perspective, opposition to the federal War on Drugs is itself a gateway drug to outright anarchism, which is the ultimate goal of destructionists who conceal their true intentions behind cynical appeals to personal liberty. To be consistent those same destructionists go so far as to condemn any and all control of conduct, Lapp insisted. What may the government regulate, control, or prohibit if not such ...
