Health-Care Ruling May Delay Final Answer From U.S. High Court
Post Date: 2011-09-09 12:05:17 by Brian S

A federal appeals court decision cast doubt on the prospect that the U.S. Supreme Court will rule on the constitutionality of President Barack Obama’s health-care overhaul before the 2012 elections. The three-judge panel said yesterday it didn’t yet have the power to consider a challenge to the law’s requirement that Americans, by 2014, either acquire health insurance or pay a penalty. The court ruled that judicial review must wait for the assessment of a fine -- something that wouldn’t occur until the following year. The health-care law, which has divided courts around the country, was already in line for possible Supreme Court review early next year, with a ruling ...

Tropical Storm Nate Likely to Become Hurricane

Tropical Storm Nate is expected to become the third hurricane of the Atlantic season today or tomorrow as it forced energy companies to evacuate platforms in the Gulf of Mexico and shut oil ports. Tropical Storm Maria is forecast to strengthen, churning through the Virgin Islands today or tomorrow, the U.S. National Hurricane Center said in an advisory. Hurricane Katia may weaken in the Atlantic. Nate’s top winds are 65 miles (100 kilometers) per hour, below the threshold of 74 mph needed to be a hurricane, according to an NHC advisory at 8 a.m. East Coast time. The storm has been lashing Petroleos Mexicanos rigs in the Bay of Campeche and its final track is still in question. ...

Some of Sarah Palin's Ideas Cross the Political Divide

CAMBRIDGE, MASSACHUSETTS — Let us begin by confessing that, if Sarah Palin surfaced to say something intelligent and wise and fresh about the present American condition, many of us would fail to hear it. That is not how we’re primed to see Ms. Palin. A pugnacious Tea Partyer? Sure. A woman of the people? Yup. A Mama Grizzly? You betcha. But something curious happened when Ms. Palin strode onto the stage last weekend at a Tea Party event in Indianola, Iowa. Along with her familiar and predictable swipes at President Barack Obama and the “far left,” she delivered a devastating indictment of the entire U.S. political establishment — left, right and center — and ...

Breaking: Specific, Unconfirmed Terror Threat Received Having To Do With New York Or Washington

(09-08) 16:42 PDT WASHINGTON, (AP) -- Officials have received a credible but unconfirmed terror threat having to do with New York or Washington. A counterterrorism official tells The Associated Press that law enforcement officials have been investigating the intelligence since it was received late Wednesday night. The official spoke on condition of anonymity to discuss sensitive security information. The counterterrorism official says the information in the threat is so specific and comes just days before the 10th anniversary of the 9/11 attacks that it could not be ignored. Security measures around the country, including in New York and Washington, have been enhanced in the weeks ...

‘Copyright Troll’ Righthaven Loses Key Client

The company Righthaven, LLC., known to its critics as a "copyright troll" that earns its money by suing media organizations over copyright claims, has been struggling lately thanks to a string of court losses -- but on Thursday the company may have sustained a fatal blow. With over 50 newspapers, including The Denver Post, MediaNews Group is one of Righthaven's largest clients. The two companies joined forces a year ago, but that contract is soon to expire. In a feature published Thursday by Wired Magazine, MediaNews Group's new CEO says the deal is through. "The issues about copyright are real," CEO John Paton told Wired. "But the idea that you would hire ...

Our Creeping Police State: How Going To The Mall Of America Can Land You In An FBI Counterterrorism Report

On May 1, 2008, at 4:59 p.m., Brad Kleinerman entered the spooky world of homeland security. As he shopped for a children’s watch inside the sprawling Mall of America, two security guards approached and began questioning him. Although he was not accused of wrongdoing, the guards filed a confidential report about Kleinerman that was forwarded to local police. The reason: Guards thought he might pose a threat because they believed he had been looking at them in a suspicious way. Najam Qureshi, owner of a kiosk that sold items from his native Pakistan, also had his own experience with authorities after his father left a cell phone on a table in the food court. Two new polls today find that just one third of the public feels President Obama deserves re-election while five times more Americans think Obama has done a worse job fixing the economy than Jimmy Carter, the modern era's Herbert Hoover. Washington Whispers contributor John Zogby tells us that his new polling is spirit-crushing for the depressed White House. "It was a very bad week for Barack Obama. Our polling shows his job approval at 39 percent and the percentage saying he deserves re-election at 33 percent, both the lowest of his term, while the percentage of voters saying the nation is on the wrong track reached a high since he took office at 75 percent," he said Click ...

Obama Now Underdog for Re-election

Independent pollster and political analyst Scott Rasmussen tells Newsmax that Wednesday night’s GOP debate was “rockier” than expected for leading candidate Rick Perry, and says his stance on the Social Security issue could be the “chink in the armor” of his campaign. But Rasmussen asserts that the Texas governor now has all the “excitement and charisma” in the Republican race and could prove difficult to beat, while leading challenger Mitt Romney is an “awkward position.” And Rasmussen believes that President Obama would be the underdog in a head-to-head race against any of the leading GOP candidates. FBI Searches Bankrupt Solar Energy Company (Solyndra) Touted By Obama

(CNN) -- FBI agents on Thursday were searching the offices of a California solar energy company touted by President Barack Obama that recently halted operations, FBI spokesman Peter Lee confirmed to CNN. Search warrants were executed at the Fremont, California, offices of Solyndra, which recently filed for bankruptcy, in a joint operation involving the FBI and the Department of Energy, Lee said. Solyndra received a $535 million government loan guarantee from the Obama administration under the stimulus bill of 2009, and the president visited the company last year to demonstrate his support for alternative energy sources made in the United States. Congressional Republicans have called for ...

BREAKING SCANDAL! Obama involved in corrupt deal with energy company!!!!!

The Obama administration bypassed procedural steps meant to protect taxpayers as it hurried to approve an energy loan guarantee to a politically-connected California solar power startup, ABC News and the Center for Public Integrity's iWatch News have learned. The Energy Department in March 2009 announced its intention to award Solyndra Inc. a $535 million loan guarantee before receiving final copies of outside reviews typically used to vet such deals. An independent federal auditor who has reviewed the energy loan program said moving so quickly without completing thorough reviews risked exposing the program to claims of political influence and put taxpayers at greater risk. ...

More than 120,000 people in Pennsylvania and parts of upstate New York were ordered from their homes as rivers continued to rise Thursday in the wake of heavy rainfall from the remnants of former Tropical Storm Lee. Evacuations in Luzerne County in Pennsylvania were moved up about eight hours to 4 p.m. on Thursday as the Susquehanna River began rising faster than expected. About a third of the county, 100,000 people, was told to leave, including about 20,000 from the county seat of Wilkes-Barre, city spokesman Drew McLaughlin said in a telephone interview. The evacuations represent about half the population of the city, McLaughlin said, adding that people have been asked to bring supplies ...

GOP House Chairman Warns of Impact of Increasing Defense Cuts

The chairman of the U.S. House Armed Services Committee is warning against indiscriminate cuts in defense spending without a national security review to inform any budget reductions. “If you are going to do it responsibly, that’s what you do instead of throwing out a number,” California Republican Howard P. “Buck” McKeon told reporters in Washington yesterday. “You’d have some kind of idea of what the impact of that number would be.” President Barack Obama signed a measure into law on Aug. 2 that calls for trimming $350 billion from planned defense spending over 10 years. The law calls for a special congressional supercommittee to find $1.5 ...

Officials Triple Number Of Homes Charred In Texas Fire

(Reuters) - Some 1,386 homes have been destroyed in a monstrous fire burning southeast of Austin that has destroyed more homes than any other blaze in Texas history, county officials said on Thursday. The devastating new number -- nearly triple what officials had said earlier in the week -- is the county's "best estimate" of the 35,000-acre fire that's been ripping through this rural, historic community since Sunday, said Bastrop County Emergency Coordinator Mike Fisher. "This is based on everything we had in (the count) before, plus a house by house and driveway by driveway count we did last night," Fisher said. Officials said that number is likely to ...

A Pyric Victory (Texas heat/drought)

The preliminary numbers from the National Climatic Data Center (NCDC) are in: the Texas average temperature in August was 88.1 F, 2.4 F above the previous warmest August (1952). This also breaks the all-time record for hottest month in Texas history. The records go back to 1895, but the previous record, 87.1 F, was set just last month. Whatever the contribution from urban warming and poor station siting, it’s quite small compared to the temperature extremes we’ve been seeing this year. Combined, the three months June-August averaged 86.8 F. This sets the all-time record for hottest summer in the lower 48 states. Oklahoma was running neck and neck, but came in at 86.5 F. Both ...

Contract Dispute Grounds Firefighting Planes by Audrey Hudson Nearly half of the federal government’s firefighting air tankers are siting idle at a California airport, grounded by the Obama administration in a contract dispute just weeks before wildfires swept through Texas killing a mother and her child, and destroying 100,000 acres. The massive blazes forced Texas Gov. and Republican presidential hopeful Rick Perry to abruptly call off a campaign appearance in South Carolina earlier this week to respond to the crisis, and may force him to cancel his first debate appearance Wednesday night. The U.S. Forest Service terminated the contract with Aero Union five weeks ago to operate ...

The latest Rasmussen Reports national telephone survey of Likely U.S. Voters finds the generic Republican earning 49% support, while the president picks up 41% of the vote. Who is this Mr. Generic and how can we get him to start campaigning?

Grassley Challenges DOJ, FBI On Findings Of Anthrax Probe

WASHINGTON -- A senior Republican senator has asked the Justice Department to explain why its civil lawyers filed court papers questioning prosecutors’ conclusions that an Army researcher mailed the anthrax-laced letters that killed five people in 2001. In a letter this week to Attorney General Eric Holder and FBI Director Robert Mueller, Sen. Charles Grassley of Iowa said the department’s decision to quickly retract the contradictory filings “has produced a new set of questions regarding this unsolved crime.” Grassley, who's among several members of Congress who've been outspoken skeptics about the FBI’s conclusion, homed in on a development first ...

Guess Who Called Opponents ‘Extremist Group,’ Urged Supporters To ‘Take Them Out’: Michele Bachmann

In the aftermath of the Jimmy Hoffa Voter Encouragement Crisis/Incendiary Rhetorapocalypse, conservative media figures have been selectively freaking out, and the White House response to ABC’s Jake Tapper has led to a newly-coined “Hoffa standard” by which campaign surrogates are to be judged. As Alan Colmes points out, though, perhaps James Hoffa‘s remarks ought to be judged by the “Bachmann Standard,” since current GOP hopeful Rep. Michele Bachmann used nearly identical rhetoric to encourage voters in 2010. That’s right, at the Tax Day Tea Party in 2010, Bachmann told supporters ““I am the No. 1 target for one more extremist group to defeat ...

Showdown at the Post Office

Showdown at the Post Office John Watson The New York Times reported on September 4, 2011 ("Postal Service Is Nearing Default as Losses Mount") that the Post Office is close to default and may have to shut down this winter, unless, of course, Congress "intervenes." The report cites that 80% of the postal service's cost is labor, as compared with only 53% at UPS and 32% at FedEx. It also cites that postal workers get more generous health benefits than even most other federal employees. The Postmaster said they may need to lay off 120,000 workers, among other cost cutting measures like closing 3,700 post offices, but there's one major problem: the American Postal ...

Perry "Frustrated" By Fed Response To Central Tx Fires

Three days after fires started to burn in Central Texas, Gov. Rick Perry today expressed frustration that federal firefighting support, including equipment from Fort Hood, has yet to make its way to the firefighters. Perry said the firefighters could use heavy equipment such as bulldozers to clear fire breaks. “It’s more difficult than it should be,”he said. “When you have people hurting, when lives are in danger, I don’t care who owns the asset.” While Fort Hood is battling its own large wildfire — a 3,700-acre blaze on an unoccupied section of the post jumped a fire line Monday night — that might not be the main obstacle. It appears Perry’s ...

CARSON CITY, Nev. (AP) — A man with a rifle shot an entire group of five uniformed National Guard members eating breakfast at a Nevada IHOP on Tuesday, killing two of them and another person in a hail of gunfire, authorities and witnesses said. The suspect also shot himself and later died at a hospital. Six people were wounded in the attack. Authorities weren't saying whether the gunman targeted the Guard members. But Nevada National Guard spokeswoman April Conway said there's no indication he had any connection with the Guard. Conway didn't know why the five Guard members had met at the IHOP, in a strip mall on Carson City's main street. But she noted the restaurant ...

America’s Unique Fascism

Five years ago, antiwar liberals calling the Bush administration fascist were labeled as kooks, marginalized by their own party leadership, accused by conservatives of treasonous thoughts worthy of federal punishment, even deportation. A few years pass, the policies hardly change, and the political dynamic turns upside down: Tea Party conservatives accusing the Obama regime of fascist impulses are compared to terrorists, accused of being racists, told that their hyperbole is a real threat to the country’s security. The establishment derides both groups for their fringe outlook on America, convinced that the United States is anything but a fascist country. After all, isn’t America ...
