The justices will hear from lawyers affiliated with the Pacific Legal Foundation (PLF) representing Geraldine Tyler, a 94-year-old grandmother, and lawyers representing the county where she used to own a one-bedroom condominium. The facts, on the surface, are simple. When Tyler fell behind on paying the real estate taxes on her condo, the county sold it. North Dakota has banned almost all abortions. A new law signed by governor Doug Burgum makes it a felony for doctors to perform abortions in most cases. Rape and incest victims are exempt, but only during the first six weeks of pregnancy. Last year the U.S. Supreme Court’s Dobbs decision triggered an abortion ban in the state. However, in March the North Dakota Supreme Court blocked that ban until an ongoing lawsuit over its constitutionality is complete. This month a Texas jury found Army Sgt. Daniel Perry guilty of murdering Garrett Foster, a protester he encountered at a Black Lives Matter demonstration in July 2020. Less than 24 hours after that verdict, Texas Gov. Greg Abbott said he would pardon Perry if asked. Abbott's hasty announcement, which seemed to be driven by conservative complaints that Perry had been unjustly prosecuted for shooting Foster in self-defense, illustrates how political prejudices convert empirical questions into tests of team loyalty.
