Health Care Bill Could Face String of Legal Challenges
Post Date: 2009-12-23 08:28:54 by A K A Stone
2 Comments
Organizations and lawmakers opposed to the health care reform package are getting their legal briefs in a bunch, threatening to challenge the constitutionality of the sweeping overhaul should it make its way to President Obama's desk. Republicans have agreed to allow the Democratic-led Senate to move up the time for a final vote to 8 a.m. Thursday so that lawmakers and their staff can go home for Christmas. But GOP supporters aren't backing down on their threats to put a stop to the legislation using whatever legal means possible. Two key issues seem to be attracting the bulk of the legal threats: a mandate for individuals to purchase health insurance and the special treatment ...

Illegal Alien Murders Teen for Speaking English in America!

I swear we don’t plan this stuff out. But no sooner than does a series of articles about the Collier County Sheriff’s Office program to deport troublesome illegal aliens conclude than an illegal alien is in the headlines, and not in a good way. The sheriff’s program, as outlined in stories Sunday and Monday, targets illegal immigrants who run afoul of the law. Deputies, through extra training, are empowered to enforce federal laws and begin deportation proceedings as they see fit. In places without the program, local authorities have to rely on federal agents to undertake the deportation process against known illegal immigrants residing in their jails, a demand the feds are ...

ANNAPOLIS, Md. — A Delaware pediatrician is accused of molesting at least 16 patients, including some who appear to be no more than 6 months old, and police said the doctor used video cameras to record some of the brutal attacks in exam rooms. Dr. Earl B. Bradley, 56, was being held on $2.9 million bond Tuesday, said Sgt. Walter Newton, a Delaware State Police spokesman. Police believe there could be more victims. Bradley, of Lewes, faces 29 charges, including rape. He was charged last week with sexually abusing nine girls. "Forensic evaluation of seized video files and software has to date discovered 15 more unidentified victims," according to a detective's sworn ...

WASILLA, Alaska - Former Alaska Gov. Sarah Palin autographed copies of her memoir during her first public book signing in her home state. Palin, the former 2008 Republican vice presidential candidate, signed copies of her best-selling book, "Going Rogue," Tuesday at the Curtis C. Menard Memorial Sports Center in Wasilla, her hometown. Enthusiastic fans began lining up at 5 a.m. for the three-hour event, which kicked off at 11 a.m., with early crowd estimates at more than 800 people. Earlier this month, Palin signed copies at Elmendorf Air Force Base in Anchorage and Eielson Air Force Base near Fairbanks, but neither of those events were open to the public. The events wrap up ...

Chrysler Says It Won't Pay U.S. (Us) Back

If you're keeping a list of who's been naughty or nice, you might want to sharpen your pencil for Chrysler and GM. In a special message of holiday cheer, Chrysler announced through filings last week that its pre-bankruptcy self doesn't appear to want to make good on its $3.7 billion loan from U.S. taxpayers. The money went to Chrysler (now called, officially, the "OldCar Co") through the Troubled Asset Relief Program (TARP) in April of 2009 when the company announced its "fast track" Chapter 11 bankruptcy. Counter that against the letter then-CEO Bob Nardelli wrote to stakeholders before the money came through: "Our viability plan demonstrates that ...

Two Pierce County Sheriff's deputies were shot shortly before 9 p.m. Monday night outside Eatonville, Detective Ed Troyer said. Both were in critical condition. The suspected shooter also was shot and killed, Troyer said. The deputies responded to a domestic violence incident in the 34300 block of Tanwax Court East. Two brothers were involved, and one invited law enforcement inside. Police said the initial call was for an unwanted guest, and there was a fight with a 15-year-old girl in the residence. One of the brothers was hiding upstairs and "basically ambushed the deputies," Troyer said. One was airlifted to Harborview Medical Center in Seattle; the other was flown to ...

New York in Last Place in Happiness Rating

In this season given to tidings of comfort and joy, word has come that we New Yorkers are the sad sacks of the United States. This is something of a surprise. Sure, we complain a lot. Grumbling could qualify as the official state sport. But are we really the unhappiest of them all? It seems so, judging from a study by two economics professors, newly published in Science magazine. The academics — Andrew J. Oswald, of the University of Warwick in Britain, and Stephen Wu, of Hamilton College in Clinton, N.Y. — examined piles of data, tossed them into a research Cuisinart and came up with a guide to American happiness, ranked by state. On the smiley scale, New York landed on the ...

(CNN) - He may have exited the national stage nearly one year ago, but former Vice President Dick Cheney has been named "Conservative of the Year" by the conservative Human Events magazine for his ardent and continuous criticisms of the Obama administration's national security policies. "What Cheney is saying, primarily on foreign policy, defense and anti-terrorism, makes sense to more and more American citizens growing increasingly worried by the Obama Administration's insouciance when U.S. national interests are threatened, both at home and abroad," former U.N. ambassador John Bolton writes for the magazine. Nathan Myhrvold is a former technology officer for Microsoft who has found his own company, Intellectual Ventures, which is involved in a number of technology development programs, including new forms of energy generation. Nathan Myhrvold also thinks that he has found a cheap and reliable way to solve global warming, which does not involve upending and perhaps destroying the world's economy. The global warming solution proposed by Nathan Myhvold involves Nathan Myhrvold's Anti Global Warming Scheme running a hose up to the stratosphere with balloons and using that hose to pump out enough sulfur particles to dim the sun's heat just enough to counteract the effects of global ...

John McCain Says He's Cool With Sarah Palin Visor Flap

The fallout out from Sarah Palin's latest, um, scandal, isn't nearly as devastating as gossip rags everywhere had probably hoped. Last week, Palin was spotted on a Hawaiian beach wearing a John McCain campaign visor with the senator's name scribbled out with black marker. The incident was caught on film by some paparazzi, and with a little help from the Internet, sent left-wing bloggers into a frenzy. John McCain was asked about visor-gate on Fox News Sunday yesterday, and Arizona's senior senator didn't seem to mind the seemingly symbolic gesture. "Oh, it's fine. Sarah said she wanted to be a little bit incognito," McCain says. "I don't blame ...

Reader Walter passed along this distressing sighting from Chris Floyd's blog. American civil liberties were gutted last week, and the media failed to report it. Anyone who is arbitrarily declared a "suspected enemy combatant" by the president or his designated minions is no longer a "person." The development? If the president or one of his subordinates declares someone to be an "enemy combatant" (the 21st century version of "enemy of the state") he is denied any protection of the law. So any trouble-maker (which means anyone) can be whisked away, incarcerated, tortured, "disappeared," you name it. Floyd's commentary: ...

(AP) Ford Motor Co. says it is offering buyout and early retirement incentives to all of its 41,000 U.S. hourly workers to further reduce its factory work force. Company spokesman Mark Truby said Ford still has too many factory workers for its current sales levels. He would not say how many workers the company wants to leave but said Ford is working that out with the United Auto Workers union. Ford currently has about 600 blue-collar workers laid off but available for recall. The buyout offer includes $50,000 cash plus a $25,000 car voucher or $20,000 more in cash. The retirement package includes $40,000 cash for skilled trades and $20,000 for production workers.

Washington (CNN) – Not every Republican is a critic of President Obama. At least one thinks the president is doing a fine job – at least when it comes to the effort involved in being the country’s chief executive. Asked to give Obama a grade as the end of the president’s first year in office approaches, Arnold Schwarzenegger, California’s Republican governor, gave Obama high marks. “When it comes to effort, [Obama] should get a straight A,” Schwarzenegger told CNN Chief National Correspondent John King in an interview that aired Sunday on State of the Union. “He’s out there with tremendous energy and he’s selling his ideas. The psychological operations conducted by the government of conditioning the public through covert mind control and subliminal influence has been documented for many years. This continued throughout Ron Paul's presidential campaign, and now that there is talk of a Ron Paul run in 2012 , even on Paul's own website, with 94% of respondants favoring a 2012 run in the latest poll, establishment pundits on the so-called right are amping up a marginalization campaign of Dr. Paul and his supporters. Last week, in a bizzare stretch that would make Orwell blush, Hannity called Ron Paul supporters extremists and claimed that the military industrial complex is what gives us freedom of speech. ...

There are not too many Obama fans in Fairfax but there are hundreds of people prepared to line up for hours in the snow for a chance to meet the one political figure they believe might still be able to rescue the nation from "socialised medicine", "Liberal intellectuals" and "elitist" newspapers like the New York Times. WASHINGTON — Unemployment is high, the economy is down. Yet for all the signs of recession, something is missing: More crime. Experts are scratching their heads over why crime has ebbed during this recession, making it different from other economic downturns of the past half-century. Early guesses include jobless folks at home keeping closer watch for thieves, or extra benefits keeping people from resorting to crime. Preliminary figures gathered by the FBI for the first six months of 2009 show crime falling across the country — at a time when many experts and police officials had expected crime to rise under the pressure of high unemployment, foreclosures and layoffs. Murder ...

WASHINGTON — Buried in the deal-clinching health care package that Senate Democrats unveiled over the weekend is an inconspicuous proposal expanding Medicare to cover certain victims of “environmental health hazards.” The intended beneficiaries are identified in a cryptic, mysterious way: individuals exposed to environmental health hazards recognized as a public health emergency in a declaration issued by the federal government on June 17. And who might those individuals be? It turns out they are people exposed to asbestos from a vermiculite mine in Libby, Mont. For a decade, Senator Max Baucus, Democrat of Montana, has been trying to get the government to help them. He is ...

The letter also called on members to send a message to Senate progressives such as Bernie Sanders of Vermont, Roland Burris of Illinois and Russ Feingold of Wisconsin to "block this bill until it's fixed."
