Prohibiting Guns for Marijuana Users Ruled Unconstitutional

A federal district judge in Oklahoma ruled Friday that a federal law prohibiting people who use marijuana from owning firearms is unconstitutional, citing a recent U.S. Supreme Court (SCOTUS) ruling that significantly expanded gun rights. This is the latest challenge to firearms regulations since the conservative-majority SCOTUS set new standards last year for interpreting the Second Amendment. In United States of America v. Jared Michael Harrison, defense attorneys argued that Harrison’s Second Amendment rights were being violated by the Gun Control Act, which makes it illegal for anyone “who is an unlawful user of or addicted to any controlled substance” to possess ...

A federal judge ruled Tuesday to block a New Jersey law that allows the state’s attorney general to take legal action against gun manufacturers. U.S. District Judge Zahid Nisar Quraishi, an appointee of President Joe Biden, granted a preliminary injunction against New Jersey’s “public nuisance” law Tuesday, saying is in “direct conflict” with the Protection of Lawful Commerce in Arms Act (PLCAA), according to the opinion in the United States District Court of New Jersey Trenton Vicinage. The “public nuisance” law allows the attorney general to seek legal action against gun manufacturers if it is deemed that they endangered public safety through sales ...

No Matter the 'Details on These Shootings,' Biden Says, Congress Should Respond by Banning 'Assault Weapons'

Los Angeles County Sheriff Robert Luna says the gunman who killed 11 people at a dance hall in Monterey Park, California, on Saturday used a "9mm caliber semiautomatic MAC-10 assault weapon." Citing "a law enforcement official," CNN reports that the gun was "a Cobray M11 9mm semi-automatic weapon," which is modeled after the MAC-10 but unlike the military version fires just one round per trigger pull. Police say the gunman who killed seven people at two farms in Half Moon Bay, California, two days after the Monterey Park massacre used a legally purchased semi-automatic handgun. So far they have not specified the make and model. Click for Full Text!

Did the Fourteenth Amendment Alter the Meaning of the Second Amendment?

When proposing the Fourteenth Amendment to Congress in 1866, Senator Jacob Howard referred to “the personal rights guaranteed and secured by the first eight amendments of the Constitution; such as freedom of speech and of the press; ... the right to keep and bear arms....” He averred that “the great object” of the amendment was “to restrain the power of the States and compel them at all times to respect these great fundamental guarantees.” The design was not to change the nature of the rights, but to prevent the states from violating them. The Second Amendment was ratified in 1791, and the Fourteenth Amendment was ratified in 1868. The Supreme Court stated in ...

Illinois Sheriff Won't Enforce Unconstitutional Gun Ban

A sheriff in southern Illinois has said the state's ban on the sale and possession of semiautomatic weapons, which was signed into law on Tuesday by Gov. J.B. Pritzker, is unconstitutional and that he won't enforce the ban. Edwards County Sheriff Darby Boewe posted a letter on the sheriff's department Facebook page that states, "Part of my duties that I accepted upon being sworn into office was to protect the rights to all of us in the Constitution. One of those rights enumerated is the right of the people to keep and bear arms provided under the Second Amendment." Click for Full Text!

Illinois Just Banned 'Assault Weapons' Because Their 'Only Intent' Is Mass Murder

This week Illinois became the ninth state to ban "assault weapons." What are those? Gov. J.B. Pritzker's triumphant press release about the new law does not say, because the explanation would reveal the futility of trying to reduce gun violence through arbitrary restrictions that leave mass murderers and other criminals with plenty of equally lethal alternatives. In Pritzker's press release, Illinois House Speaker Chris Welch (D– Westchester) describes the guns targeted by H.B. 5471, a.k.a. the Protect Illinois Communities Act, as "weapons of war." That phrase suggests Welch is talking about selective-fire rifles like those carried by U.S. soldiers, which ...

The 3rd Circuit Considers Whether Nonviolent Crimes Justify the Loss of Second Amendment Rights

Back in 1995, Bryan Range pleaded guilty to fraudulently obtaining $2,458 in food stamps by misrepresenting his income. He returned the money, paid a $100 fine and $288 in court costs, and served three years of probation. Although Range did not realize it, that Pennsylvania misdemeanor conviction also came with a lifelong penalty: He lost his constitutional right to keep and bear arms. His case, which the U.S. Court of Appeals for the 3rd Circuit will hear next month, poses the question of whether that policy, which prohibits gun ownership by millions of Americans with no history of violence, violates the Second Amendment. Authorities say Ewen Dewitt murdered 40-year-old Julie Minogue with an ax this month in her Milford, Connecticut, home. Two of her children were home when the murder occurred. Mr. Dewitt, an ex-boyfriend, had been stalking her. “I’m scared he’s going to kill me,” she told the police. In 2019, she had a protective order issued. Just a week before she was killed, a judge had granted her a full no-contact restraining order. Click for Full Text!

Who Wants to Tell California AG Bonta that Access to ‘Weapons of War’ as a Check Against Tyranny is a Core Tenet of the Second Amendment?

I spent much of the last week assisting my brilliant colleagues in preparing their supplemental brief in Duncan v. Bonta. This is the magazine-capacity case that kicked off the now-famous “freedom week” in California in 2019. Our win in district court was affirmed on appeal by a 3-judge panel, but then was reversed by the Ninth Circuit sitting en banc. Thankfully, the Supreme Court acted on our appeal by vacating the en banc decision and remanding the case for further proceedings in light of Bruen. Click for Full Text!

President Biden told reporters over Thanksgiving that he would use the upcoming lame-duck session of Congress to do something he has wanted to do for decades. He wants to ban what he routinely calls “assault weapons,” a term that includes virtually all other semi-automatic rifles, shotguns and handguns. Reasonable heads may try to walk back some of his distortions, but Mr. Biden’s misguided statements were all-encompassing: “The idea that we still allow semi-automatic weapons to be purchased is sick. It’s just sick. It has no, no socially redeeming value. Zero. None. Not a single solitary rationale for it except profits for the gun manufacturers.” Click for ...

A Federal Judge Suggests That Oregon's 10-Round Magazine Limit Does Not Implicate the Second Amendment

A state judge in Oregon this week issued a temporary restraining order (TRO) against the enforcement of new gun restrictions that were scheduled to take effect today. At issue is Measure 114, which Oregon voters narrowly approved last month. The initiative, which has provoked several lawsuits in state and federal court, requires permits to buy firearms and bans magazines that can hold more than 10 rounds. The federal lawsuits argue that the 10-round magazine limit violates the Second Amendment. The cases are notable because they will provide an indication of how judges are apt to apply the constitutional test that the Supreme Court prescribed in New York State Rifle and Pistol Association ...

Guest Post by Ann Coulter During a BLM “peaceful protest” in Omaha, Nebraska, on May 30 (over George Floyd’s dying of a heart attack while in police custody in Minneapolis), James Scurlock was peacefully protesting by breaking into an architecture firm — hoisting an office chair and hurling it into two computer monitors, then ripping a phone from a desk and throwing it against the wall, as his friend shattered another monitor — all of which was captured on video. Nearby, Jake Gardner, an Iraq War veteran and Trump supporter, was keeping watch over the two bars he owned, The Hive and The Gatsby, aided by his 68-year-old father and a security guard. Beirut blast: How does ammonium nitrate create such devastating explosions? Live Science 05 August 2020 Posted on 8/5/2020 by BenLurkin Ammonium nitrate is frequently added to increase a fertilizer's nitrogen content. It's relatively stable under most conditions and is inexpensive to manufacture, making the chemical a popular alternative to other, more expensive nitrogen sources. But ammonium nitrate has a potentially lethal downside: The compound is considered an oxidizer, meaning at an atomic level, it removes electrons from other substances in a chemical reaction. What that means in a more practical sense is that it increases the burning of fuels by increasing the oxygen ...

WESLEY CHAPEL — Two armed intruders were shot dead and a third was wounded when a homeowner fired on them early Friday, according to the Pasco County Sheriff’s Office. The homeowner said he was inside his home playing video games when at about 12:43 a.m. he heard the glass of his laundry room door shatter, according to a sheriff’s report. He saw an arm reach inside to unlock the door. Then the homeowner said he saw a masked man walk in and aim a gun at him. The homeowner said he grabbed his Glock 9mm pistol, which was just a few feet away, and fired several times at the intruder. He saw the intruder fall down, the report said. Then a second masked intruder entered the ...

A white couple was arrested after at least one handgun was pulled on a black woman and her daughters during a videotaped confrontation in a restaurant parking lot in Michigan, authorities said Thursday. Jillian Wuestenberg, 32, and Eric Wuestenberg, 42, were charged with felonious assault over the Wednesday incident, Oakland County Prosecutor Jessica Cooper said. The confrontation was captured on cellphone video. Takelia Hill, who is black, told the Detroit Free Press that her daughter asked Wuestenberg to apologize after she bumped into her outside of a Chipotle in Orion Township, about 40 miles outside of Detroit, but Wuestenberg instead started to yell at her. The video shows ...

Donald Trump Violated First Amendment by Blocking Critics on Twitter, Appeals Court Affirms The U.S. Court of Appeals for the 2nd Circuit denied the White House’s request for en banc review of a ruling that Donald Trump violated the First Amendment by blocking critics of the president on Twitter. The Trump administration had appealed for a review of the unanimous three-judge ruling by the 2nd Circuit in July 2019 finding that Trump’s @realDonaldTrump Twitter account constitutes a “public forum” under the U.S. Constitution’s First Amendment. That upheld a 2018 U.S. District Court judge’s ruling that Trump’s blocking of individual accounts on Twitter ...

He was the LGBT editor at ThinkProgress, director of the anti-gun organization Guns Down America, and vice president at the Center for American Progress, so you know just how much of a Lefty he is. He wrote an article I fled Soviet anti-Semitism: We need to fix lax gun laws as well as hate and bigotry, because the lesson he took away from the big-government persecution of the Jews was to disarm the Jews. So now he wants to make sure that Americans are not going out and buying guns during the Coronavirus crisis. Buying a gun isn’t the answer to coronavirus It’s ...
