FDA Cracks Down on Animal Tranquilizer That Is Sometimes Mixed With Fentanyl

The Food and Drug Administration (FDA) announced this week that it would crack down on imports of xylazine, a non-opioid veterinary sedative used on animals ranging from dogs and cats to deer and elk. The FDA is targeting the drug because black-market sellers have added it to various illicit fentanyl mixtures; the FDA said it has also turned up mixed with stimulants like cocaine and methamphetamine. If ingested by humans, xylazine "can depress breathing, blood pressure, heart rate and body temperature to critical levels"; if injected, it can cause tissue decay requiring amputation. It's also known by the street names "tranq" and "zombie drug." The ...

A judge has ordered the Tennessee Wildlife Resources Agency (TWRA) to return 13 birds it seized from falconer Holly Lamar. The agency seized the birds and confiscated some of her equipment, days after she filed a complaint against one of its agents for failing to respond to her requests for information for months and giving her conflicting information when the agent did respond. Three months later the agency charged her with 30 misdemeanors, mostly for failing to report the purchase or sale of a bird or to report the purchase or sale in a timely manner. Click for Full Text!

The latest threats to Proposition 13 in Sacramento

Nineteenth century lawyer and newspaper publisher, Gideon J. Tucker, once said that “no man’s life, liberty or property are safe while the Legislature is in session.” Well, the California Legislature is back in session and no truer words have ever been spoken. And, while we’re still waiting on a thousand or so more bills to appear in print, there are already several major concerns to taxpayers, and even a few direct threats to Proposition 13. Here are just two: ACA 1 and ACA 3. Click for Full Text!

SCOTUS Questions the Government's Absurdly Broad Definition of 'Aggravated Identity Theft'
Post Date: 2023-03-03 02:10:21 by Charles_Byrd

Back in 2004, Congress decided to tackle the problem of "identity theft." It was responding to much-publicized cases in which criminals obtained credit cards in other people's names, sticking them with the resulting bills and hurting their credit ratings. But instead of focusing on that paradigmatic situation and crimes of a similar nature, Congress passed the Identity Theft Penalty Enhancement Act, which prescribed a two-year mandatory minimum sentence for "aggravated identity theft." The law's definition of that crime is so broad that it can be read to cover myriad minor offenses that are nothing like identity theft as it is generally understood. Naturally, ...

Six leaders, including two commanders and four of their subordinates, at Minot Air Force Base, North Dakota, were abruptly relieved of their duties “due to a loss of confidence,” the US Air Force wrote in a press release Monday. Maj. Gen. Andrew J. Gebara, commander of the 8th Air Force, relieved Col. Gregory Mayer of the 5th Mission Support Group and Maj. Jonathan Welch of the 5th Logistics Readiness Squadron from their leadership positions at Minot AFB “due to a loss of confidence in their ability to complete their assigned duties.” Click for Full Text!

A local Massachusetts Democratic Committee chairman who suggested that unborn babies with disabilities should be aborted to save money on special education will retain his position despite a public outcry against him. According to the Boston Herald, “Committee members on Sunday voted unanimously, 27-0, to endorse a statement ‘repudiating’ chairman Michael Hugo’s comments, but the committee opposed a motion to add an agenda item to a future meeting to discuss whether Hugo should be removed.” Click for Full Text!

Biden Admin Using CHIPS Act to Force Taxpayers to Fund Daycare for Tech Workers

The Biden administration is using the recently enacted CHIPS Act to force Americans to subsidize childcare for people employed in the manufacturing of semiconductors. Rather than seeking for some sort of spending bill to work its way through Congress — as is required by the U.S. Constitution — the Biden Commerce Department is using the money being offered to the semiconductor industry to surreptitiously spend taxpayer funds to set up childcare facilities at all the factories receiving money from this latest act of the executive. Occupational Licensing: Giving Government Power Over Prosperity

The state Legislature of Virginia is poised to approve a bill that would grant comity to occupational licenses issued by other states. This event might not sound particularly newsworthy, but anything that takes prosperity out of the hands of the government and places it back in the hands of the people is good news for liberty and those who cherish it. Less than two weeks after a driver rammed into one of the bedrooms of his Austin, Texas, home, Chris Newby got a letter from the city telling him his house was now in violation of city code and that he had 30 days to get it repaired or he faced $2,000 a day in fines. The letter was dated on the day the driver smashed into Newby's home. City officials said the building inspector was notified about the accident by the fire department and that it is city policy to send such letters after a house is damaged. Click for Full Text!

The Department of Homeland Security Turns 20. Its Legacy Is Disastrous.

To those who don't remember the events of September 11, 2001, it can be difficult to convey the sense of dread and uncertainty that followed. As horrible as the attacks were, many of us wondered: What's next? It was in this context that Congress quickly passed, and President George W. Bush signed, such legislation as the USA PATRIOT Act, less than two months after 9/11. While that law was drafted with the best of intentions— strengthening the nation's defenses against potential future attacks—in practice, authorities overwhelmingly use it to circumvent Americans' basic freedoms like privacy and due process. Supreme Court Considers Domestic Spying Too Secret to Be Challenged

The Supreme Court of the United States has declined to review a lower court’s dismissal of the Wikimedia Foundation’s lawsuit against a National Security Agency (NSA) domestic surveillance program exposed in 2013 by Edward Snowden. With the Court’s citing of “state secrets privilege” as a prohibition against such litigation, debates in Congress on the question of whether to renew the statute authorizing the program might be the last hope of relief for Americans who cherish the U.S. Constitution and the freedoms protected by the Bill of Rights. How social networks became a 'subsidiary' of the FBI and CIA

The US Congress last tried to grapple with what the country’s ballooning security services were up to nearly half a century ago. In 1975, the Church Committee managed to take a fleeting, if far from complete, snapshot of the netherworld in which agencies such as the Central Intelligence Agency (CIA), Federal Bureau of Investigations (FBI) and National Security Agency (NSA) operate. Lightfoot’s Reign of Ineptitude in Chicago Will Come to an End

Chicago Mayor Lori Lightfoot finished a distant third in the city’s mayoral election on Tuesday. The night was won by former Chicago Public Schools CEO Paul Vallas, who garnered just under 34 percent of the vote. Cook County Commissioner Brandon Johnson, who is also a Chicago Teachers Union organizer, came in second with just over 20 percent of the vote. Vallas and Johnson will square off in five weeks, on April 4, to see who will become the next mayor of the Windy City. Lightfoot, the first black woman and openly gay mayor in the city’s history, could only manage to secure about 17 percent of the vote, despite being an incumbent. It would seem as if the city weren’t happy ...

A three judge panel of the U.S. Second Circuit Court of Appeals ruled Monday in favor of the pro-life Evergreen Association, which operates the Expectant Mother Care and EMC FrontLine Pregnancy Centers in New York City, in an important freedom of expressive association case. U.S. District Judge Thomas McAvoy Sr. dismissed the case in 2021, but Evergreen appealed and its president, Christopher Slattery “brought a civil suit against the state of New York in Northern District of New York in January 2020,” Josh Russell wrote. “They argued the state’s so-called Boss Bill of 2019 unconstitutionally infringed on its freedoms of speech and religious exercise…” Click ...

U.S. Drops in Human Freedom Index; Ranks Behind Ex-communist Nations

In the 1992 book The End of History and the Last Man, philosopher Francis Fukuyama posited that “liberal democracy” would become the world’s unassailable, default norm. Since then, many would argue, we’ve gotten much liberalism and the appearance of democracy, but the substance doesn’t match the style. And a recent study of liberty in the world vindicates that claim. In fact, finds the Cato Institute’s latest edition of the Human Freedom Index, after reaching a high point in 2007 (just before the Obama years, do note), worldwide freedom had been in steady decline. But that has changed: It entered steep decline with the Covid-19 situation in 2020. Click for ...

Virginia Next for Occupational Licensing Reform
Post Date: 2023-02-28 19:22:55 by Charles_Byrd

The General Assembly of Virginia this month approved a proposal to recognize out-of-state occupational licenses and work experience as per se qualifications for in-state credentials. To qualify, the applicant must have held her out-of-state license for at least three years and reside in good standing with that state's board. Individuals seeking a Virginia license for a profession that was not licensed in their previous state can qualify with three years of work experience and an examination. Both provisions will, in many cases, allow workers to avoid excessive time and money costs associated with seeking a license in a new state. Click for Full Text!

Copyright Is the Latest Battle in the War Over A.I.

Increasingly sophisticated artificial intelligence (A.I.) is inching further into the mainstream, and nobody is quite sure what to make of it yet. Students protested after university administrators used the A.I. text generator ChatGPT to craft a statement after a mass shooting. Systems like Midjourney can create pieces of art so sophisticated, they can win awards— to the chagrin of flesh-and-blood artists. Now the U.S. Copyright Office (USCO) has weighed in on the debate and determined that images produced by A.I. are not copyrightable. Click for Full Text!

Nebraska Heartbeat bill voted out of committee, heads to full legislature

LB 626, the Nebraska Heartbeat Act, was voted out of the Health and Human Services Committee last week! This is a vital step in the legislative process that paves the way for the bill to be debated by the full legislature in the coming weeks. If LB 626 is passed, it will protect preborn babies with heartbeats from abortion. It will require an ultrasound to be performed before an abortion, and, if a fetal heartbeat is detected, no abortion may be performed. Click for Full Text!

Idaho weighs three pro-life laws; decision expected in a few months

Earlier this year, on January 5th, the Idaho Supreme Court allowed three pro-life laws to go into effect. Last week the Justices “sharply questioned” attorneys for both sides—the state defending the laws, the ACLU challenging them. The laws were a near total abortion ban; a 6-Week Ban— the “Preborn Child Protection Act”; and a Civil Liability Law which “allows healthcare professionals who performed or induced an abortion in violation of the law to be civilly sued for attorney fees and statutory damages of not less than $20,000,” according to Skyler Lee.
