DOJ requests military lawyers to help prosecute immigration crimes: report

The Department of Justice (DOJ) has reportedly asked the Pentagon to provide military lawyers to help prosecute illegal immigration cases along the southern border.

MSNBC’s Rachel Maddow reported Wednesday night that the DOJ requested active-duty Judge Advocate Generals (JAGs) be dispatched to border states to assist with the influx of illegal immigration cases.

Maddow said the JAGs will serve six-month shifts as special assistant U.S. attorneys in Arizona, Texas and New Mexico. The Defense Department has agreed to the request, Maddow reported.

The DOJ's request comes amid an ongoing crackdown from the Trump administration on illegal immigration.

Earlier this year, Attorney General Jeff Sessions announced the Trump administration's "zero tolerance" policy, stating that federal agents would "aggressively" prosecute migrants crossing the U.S.–Mexico border illegally.

That policy led to the separation of thousands of children from their families at the border.

After days of growing outrage from both sides of the aisle, President Trump gave in to pressure on Wednesday, signing an executive order that would allow families to be detained together.

The executive order marked a sharp reversal for Trump and administration officials who had stated repeatedly that the issue of family separation could only be addressed by Congress.

The infusion of additional prosecutors would be the latest instance of the DOJ dispatching more personnel to address border crimes.

Sessions announced in May he was sending 35 additional U.S. state attorneys and 18 immigration judges to the southern border to handle the expected arrival of Central American migrants seeking asylum in the United States.

Not sure about this. Problem was discussed by an attorney on Mark Levin's program awhile ago where it was explained that there is a difference between immigration law and criminal law. Violating the sovereignty of the U.S. by breaking the border can have only one consequence and that is immediate deportation. On the other hand if the illegal alien is charged with a crime, then he or she is subject to all of the considerations and rights given to anyone who is being held under criminal statutes which means they have a right to legal representation plus a whole host of other rights which attend anyone who is charged with a crime within the U.S. judicial and court system. Then a judge can theoretically find the defendant "not guilty" and allow him/her to stay in country pending this or that. This plays right into the hands of the left because then the illegal alien must be treated in accordance with criminal law requirements as opposed to immigration law which is based upon the power of absolute sovereignty of a nation to protect its border from invasion. Which is not subject to criminal statute or judge's decisions. It is difficult to explain the difference here however the attorney on the program did a much better job than I am doing but I think you can get the gist of what I am trying to say. This difference has been getting lost in the media discussions on border breaking. And there is a reason for that, again because charging a border breaker with a "crime" is in the best interests of the illegal alien and the lawyers. They then are given all kinds of "rights" and avenues of process whereby they can defeat or do an end-run around the absolute sovereignty power of the U.S.

If it's just some minor infraction like pissing on an endangered species, President Trump can give them a pardon to facilitate deportation.

This is not correct. Aliens at the border have very limited rights.

Then a judge can theoretically find the defendant "not guilty" and allow him/her to stay in country pending this or that.

They all (or nearly all) plead guilty and the court proceeding takes a few minutes while they herd a group in, accept their guilty pleas, and herd them out. They get sentenced to time served and get turned over for deportation.

Pleading not guilty is not a winner, and means remaining detained awaiting trial. And then they will be deported. They just take the deportation and unlawfully enter again until they are not caught.

A person attempting to enter at a border crossing point, or who has recently entered unlawfully, may be deported without a hearing if an immigration officer determines he or she,

  • lied or misrepresented a material fact, including falsely claiming U.S. citizenship, in obtaining U.S. entry documents or admission, or

  • does not have a valid entry document (such as a visa or border crosser card) or travel document (such as a passport).

A request for asylum due to claimed credible fear of return requires a hearing to resolve. That is why they are scripted to claim they fear return.

The infraction being spoken of is unlawful entry. It is a misdemeanor.

California needs JAG's too. Sessions needs to deport the California AG, or at least check his immigration status.

Looks like Trump & Sessions are afraid of Governor Jerry Moonbeam Brown and his "dream student" AG, Xavier Becerra.
