After the three public shootings over the last two weekends in California, Democrats are again clamoring for even more gun control laws. To California Gov. Gavin Newsom, the solution is to ban more places where people can carry permitted concealed handguns. Unfortunately, the proposal has nothing to do with stopping these attacks, and more gun-free zones only encourage these attacks. Back in 1995, Bryan Range pleaded guilty to fraudulently obtaining $2,458 in food stamps by misrepresenting his income. He returned the money, paid a $100 fine and $288 in court costs, and served three years of probation. Although Range did not realize it, that Pennsylvania misdemeanor conviction also came with a lifelong penalty: He lost his constitutional right to keep and bear arms. Authorities say Ewen Dewitt murdered 40-year-old Julie Minogue with an ax this month in her Milford, Connecticut, home. Two of her children were home when the murder occurred. I spent much of the last week assisting my brilliant colleagues in preparing their supplemental brief in Duncan v. Bonta. This is the magazine-capacity case that kicked off the now-famous “freedom week” in California in 2019. Our win in district court was affirmed on appeal by a 3-judge panel, but then was reversed by the Ninth Circuit sitting en banc.
